G. Lake: Let me go through the Board.
P. Owen: Nothing.
R. Carr: Dick, is that fireproof mulch?
D.
McGoey: No, it’s fire resistible.
R. Carr: At this point, I see the Fire Departments. . .
G.
Lake: It’s becoming a real
problem for the fire departments in the malls. It just
sets right up.
R.
Carr: Over where Aldi’s is where we put in crushed
stone instead of mulch, it’s all over the parking lot.
I don’t know, there’s that many fires from the
mulch?
G.
Lake: Especially at the plazas. How about Mr. Smith’s
comments? Dick, did you see these?
D. McGoey: Yes I did.
G. Lake: Standard?
D.
McGoey: They’re standard.
There is nothing out of the ordinary.
G.
Lake: Do you want to look through Mr. Smith’s comments
first? I’m sure you’ve seen them already.
K.
Pinkham: Actually, no I haven’t.
G.
Lake: I mean, they’re pretty standard. All I’m
looking for is a yes or a no.
B. Gesztesi: Yes. We certainly have no problems.
G. Luenzmann: I have a couple of questions. The Mexican Restaurant
is going to locate in one of these buildings?
K.
Pinkham: That’s his plan at
this time.
G. Luenzmann: Will he be having a bar or a drinking establishment?
B.
Gesztesi: At this point, he doesn’t have a liquor
license. I don’t know what he’s intending beyond
that. I do know prior to that use, D.J.’s was there for
a long period of time. We’re not really looking for a
place.
G. Luenzmann: Dick, did he satisfy all your comments? Is there
anything outstanding in your mind?
D.
McGoey: Yes. It’s not totally.
I have issues with the plans not showing fire department
comments, etc.
G. Luenzmann: So, these are mostly technical comments?
D. McGoey: Yes.
G. Luenzmann: I have no further questions.
G.
Monaco: Aren’t there two new
houses being built near this?
G.
Lake: I think there’s only
one house.
G. Monaco: I was just thinking if a bar was going in. I have
no other questions.
T.
Hamilton: One question. Dick, did you look at the dumpster?
That’s pretty far away from the rest of the building,
especially if they have doors in the back of the whole complex,
they’re going to wheel this stuff all the way to that
location to accommodate these two buildings.
D.
McGoey: That’s all they need.
T. Hamilton: That size for that many square feet?
D. McGoey: The restaurant alone will probably take that one
alone.
T.
Hamilton: Just seeing where it is and how they’re
going to get to it. I don’t want to see any of those
rolling ones lined up all behind that building like we’ve
had problems in other areas.
D. McGoey: You should request another dumpster.
T.
Hamilton: No, if it’s big enough. I just want them
to know that we’re not looking to see all these portables
lined up behind each back door of the store. It has happened
to us because they don’t want to go all the way to the
dumpster location.
D.
McGoey: Have a note put on the plan, no dumpster’s
in the back.
G.
Lake: Okay. Do you understand? You’re
going to put a note on saying . . .
K. Pinkham: Absolutely.
G.
Lake: If they need another one, they’ve got
to come back, Dick?
D. McGoey: Back to the Board.
B. Gesztesi: Put another dumpster in.
G. Lake: Put it someplace else. You will have to come in to
amend your Site Plan. You can do that at a later date. Dick,
do you have any other comments?
D. McGoey: No.

5. JACKSON - 7 LOT SUBDIVISION - Reservoir Road (32-2-53) #011-003
- CANCELLED.
6. NICAJ - 8 LOT SUBDIVISION (FINAL APPROVAL) - Sands Road
(14-2-22.3 & 22.4) #040-001
G.
Lake: Tell us where you’re
at.
R.
Ferris: We’ve been back to the Health Department
on issues that we had to overcome. We had expected to have
Health Department Approval by tonight. It’s in the works
but we still don’t have it.
G.
Lake: You don’t have that
approval? How long have you been in there now?
R. Ferris: Just a year. We got caught with the bad weather
last year and then this year we excavated for the Health Department.
We had to have that stabilized. Then they wanted some water
testing to be done on some of the lots. If you notice one of
the lots was omitted from the original submission. Nine lots
is now eight lots. This has been a problem with the Health
Department.
G.
Lake: So basically, you don’t
have their approval yet?
R. Ferris: No.
G.
Lake: How about Dick’s comments?
Are these new Dick or are these the ones just left from.
. .
D.
McGoey: One is the reduction of the lots, that’s
new. He may be changing the lot lines.
R.
Ferris: There is only one line removed. There’s
a garage and a well. The site distances are on the plan.
These
are technical items.
G. Lake: Can we even do anything without Health Department?
D. McGoey: No. You can grant two extensions together.
G. Lake: Are you through the extension period? Are you going
to need an extension?
R. Ferris: Yes.
D. McGoey: He received a one year extension on the 19th of
November, 2003.
G.
Lake: So, he’s okay there.
You have been in the Health Department for a year now?
R.
Ferris: Yes. We got caught last winter and they couldn’t
do testing until May.
T. Hamilton: The Highway Department. Has he seen those comments?
G. Lake: They may be new because Mr. Lippert maybe just sent
them.
R.
Ferris: We didn’t receive
those comments.
G. Lake: So basically all we can do is table the application
until he gets final approval from the Health Department?
D. McGoey: Yes.

7. GOLF RIDGE ESTATES - 13 LOT SUBDIVISION (FINAL APPROVAL)
Sands Road (14-2-13) #058-002
R.
Ferris: I’m representing the applicant. This one
is also connected to the Health Department. The Health Department
has reduced the lots from fifteen to thirteen so two of the
lots were combined. Again, I thought we would have approval
from the Health Department. They’re response time is
taking longer and longer between submissions.
G. Lake: So, this is the same problem as the previous?
R.
Ferris: Yes. All the technical comments have been answered
so, it’s just Health Department.
G. Lake: Do you need an extension for this?
R.
Ferris: Yes, I’m going to
need one.
T. Hamilton: There are highway comments also.

8. BOWSER - 3 LOT SUBDIVISION (SKETCH) - Bowser Road (21-1-27.31)
#017-004
M.
Miele: I’m the Engineer for the applicant. First,
I know the somebody called several times. We just resolved
the owner’s endorsement. Do you want it now or come back
tomorrow? It is a proposed three lot subdivision on Bowser
Road. Two smaller acre lots and the remaining lands. Based
on work shops a while ago we wanted to see possible potential
future development after this subdivision that’s with
the cul-de-sac and potential lot lines represent. Right now
we’re just looking for lot #1 and lot #2 and the remaining
lands of lot #3 in the back. I got Mr. McGoey’s comments
which will be addressed, site distance, adjoining property
owners and stuff like that we will address. I am looking for
any comments on the layout or any problems.
G. Lake: Is that a ridge line back there?
D.
McGoey: I don’t know. I had a hard time finding it.
I went out there and couldn’t find the site.
G.
Lake: Mr. Owen, do you have any comments, it’s
only here for sketch.
P. Owen: Nothing right now.
R. Carr: Dick, your comment #4, the width of the access road.
M.
Miele: I can show you. It’s over fifty, I think it’s
fifty two.
G. Lake: And lot #1 and lot #2 is two hundred?
M. Miele: Over two hundred, two hundred fourteen and one hundred
ninety nine.
G.
Lake: Why don’t we get them
both at least two hundred.
R.
Carr: I really don’t have a problem with lot #1 or
lot #2. Lot #3, I don’t know. I wouldn’t want to
give any kind of indication that you can do anything with lot
#3 in terms of running a cul-de-sac back there.
M.
Miele: I mean, we’re not looking
for any king of approval. It was just for . . .
R.
Carr: I didn’t indicate that.
