Kelly: NOTICE IS HEREBY GIVEN that a PUBLIC HEARING of the Planning
Board of the Town of Wallkill, Orange County, New York, will be
held at the Town Hall at 600 Route 211 East, in said Town, on
the 7th day of August, 2002 at 7:30 P.M. or as soon thereafter
as the matter can be heard that day on the application of Ronstein
Construction for Site Plan approval of property located on the
south side of New York State Route 17 and Route 17K approximately
250' west of Banke Road under Section 249-28 of the Zoning Law
of the Town of Wallkill. All parties of interest will be heard

Ptak: I am representing RONSTEIN Construction. We're here tonight
to request a Special Use/Site Plan for multiple uses of a 2.7
acre lot in the PID zone located on Route 17 and Route 17K about
two hundred fifty feet west of Banke Road. The proposed uses that
we are requesting include retail stores, service shops, offices
and banks, furniture and major appliances, carpet stores, eating
and drinking establishments, medical and dental offices, and clinics.
Since we don't know exactly what we're going to put in there it
would be on speculation at this time. We submitted as requested
to the Department of Transportation. We haven't finalized with
them yet. We don't have their final requirements. We also submitted
to the Bloomingburg Fire Department. I spoke with one of the members
about two weeks ago and he said that they had sent something in.
I haven't seen it but they said that they didn't have any major
problems with the project.

Lake: Do you want to go through Dick's comments, please?
T.
Ptak: The first comment about the Department of Transportation,
I've already said that we haven't got final on those. The thirty
five foot radius, the Department of Transportation usually requests
twenty five feet. I don't see that they will have a problem with
thirty five. I will approach them on that as well as the culvert
issue. They have not asked for a culvert and quite frankly there
is no ditch line up there. I will address that with them. I will
see what their comments are and if we have to we will need to
go over that. The other items are just details. The planting in
the strip, the handicap access onto the sidewalk.
G. Lake: Let's do the landscaping. Have you seen this? Has this
been revised?
D.
McGoey: Yes, it has. They have added some landscaping to it. I
don't have a problem.
G.
Lake: The sidewalk?
T.
Ptak: Those are details. We have no problem with any of those.
G.
Lake: The curb island planter?
T.
Ptak: Dick requested a detail of that which we will provide.
G.
Lake: And the dumpster?
T.
Ptak: The dumpster, it's there. It's just an arrow pointing to
it from the label which is missing. That's not a problem.

Lake: That's that little 8' x 8'.
T.
Ptak: Right.

Lake: Will that be sufficient?
T.
Ptak: For a dumpster for this, we have two. We're providing two,
one on each side.
D.
McGoey: That means they are all going to share the dumpsters?
R.
Steinberg: Basically it depends who we get. If it is an eating
establishment, they would have their own.
D.
McGoey: You may need to make these bigger.
R.
Steinberg: Depending on the use. If it is an eating establishment,
they need their own, I believe.
G.
Lake: Can you make them bigger?
T.
Ptak: Do you want us to double it?
D. McGoey: Yes. Two for each building.

Lake: Let me go through the Board.

Dulgarian: Just Dick's comments. We've been requiring new projects
to look as pleasing as possible. Normally we get a little bit
of a better landscape plan. I'm wondering what's going in the
end ones. Other than that, we have requested doubling the dumpsters.
How close is this to Bloomingburg?
T.
Ptak: I'm going to guess and say it is about a half mile from
where the Quickway crosses Route 17K. We're about a half mile
east towards Newburgh.
A.
Dulgarian: I'm just wondering where the line is?
G.
Lake: It's on a hill.
T.
Ptak: It's quite a ways away.
A.
Dulgarian: I don't really have anything else here.

Owen: I don't have anything else to add.
R.
Carr: No. Is there lighting here?
T.
Ptak: They will be on the building and we will provide that. That
will be on the building plans.
R.
Carr: The other comment is the fencing of the dumpster.
T.
Ptak: If stockade is more suitable to the Board?
R.
Steinberg: What about the green fencing?
T.
Ptak: We are providing slatted fencing. If you want stockade,
I don't think we any problems with that. How high do you want
it?
D.
McGoey: Six feet.
G.
Lake: Dick, the lighting? Did we check that?
D.
McGoey: No. They didn't give it to me yet.
G.
Lake: You will have to get that in.
T.
Ptak: Right.
G.
Lake: We will want to see how bright.
T.
Ptak: The owner wants to put it on the building and keep it so
it's not a real bright spot.
G.
Lake: We would like that information so Dick can check it.
G.
Luenzmann: I have no questions.
G.
Monaco: The line of sight you have here going westward five hundred
fifty feet. I don't think you have that. I've been out there and
you're on a hill and you can't see until things are right up on
top of you. I don't know how you can re-organize it so people
have. This is just a crest of a hill on Route 17K, yes.
T.
Ptak: It's not just on the crest. It's up near, there's a telephone
pole out in front of the site.
G.
Monaco: It's past . . .
R.
Steinberg: There is a trailer on the site.
T.
Ptak: The site itself is right up on the crest. You can see it's
clear.
G.
Monaco: Yes.
T.
Ptak: The proposed entrance is at where the telephone pole is.
The entrance would be at that point.
G.
Monaco: And your able to see from that position sitting at car
level down to Route 17?
T.
Ptak: Down to Route 17?
G. Monaco: Down to Route 17K?
T.
Ptak: Yes. You can see both ways and those are the distances that
we measured.
G.
Monaco: I was out there this afternoon and apparently I thought
differently. The second thing is I would like to see more landscaping.
The third issue is light pollution. That is kind of a rural area
and I would like to look at that when it comes in.
T.
Ptak: So, you would like to keep that minimized?
G.
Monaco: Yes I would.
G.
Lake: We just asked to double check so we didn't end up with light
pollution.

Monaco: Double check the line site.
T.
Ptak: It has been double checked and will be verified by the Department
of Transportation.

Monaco: Okay.

Ptak: The entrances are subject to their approval also. What additional
landscaping would you like to see?

Dulgarian: We are talking quantity and location. I just know that
we've been looking for a larger quantity and in more areas.

Kelly: NOTICE IS HEREBY GIVEN that a PUBLIC HEARING of the Planning
Board of the Town of Wallkill, Orange County, New York, will be
held at the Town Hall at 600 Route 211 East, in said Town, on
the 7th day of August 2002 or as soon thereafter as the matter
can be heard that day on the application of CARRABBA's Italian
Grill, 2202 North Westshore Boulevard, Tampa, Florida 33607 for
the approval of Site Plan and Special Use Permit for Carrabba's
Italian Grill located on Crystal Run Road adjacent to the intersection
of Crystal Run Crossing and Exit 122 of New York State Route 17
West under Section 249-39 of the Zoning Law of the Town of Wallkill.
All parties of interest will be heard at said time and place.

T. DePuy: Carrabba's is proposing an Italian Grill on the corner
of Crystal Run Road and Crystal Run Crossing. It's occupying a
l.6 acre parcel. It has an access off of Crystal Run Road with
a right in, right out only here and then we would have another
access from the rear of the site toward the Hampton Inn and servicing
that to the rear part giving them a second means of access. Basically,
we had met with the fire department. We had installed an additional
hydrant adjacent to the siamese "Y". We also are including
a lock box on the building that they requested. We are also putting
some reflective letters on the building indicating the height.

Lake: Do you want to go through Dick's comments at this time?

DePuy: Yes. Verify with Ed Smith the water and sewer details are
acceptable. I sent stuff down. I haven't heard back from Ed but
I will meet with him to make sure it is acceptable.
Confirmation that the revised plans are acceptable to the Fire
Department. I hadn't heard back from them on that either. We continue
to have a concern with the lighting levels at the site. I had
Carrabba's Lighting Engineers notified of that. They were just
shipping out today a new lighting layout.
D.
McGoey: I have got to tell you, it's got to be cut by more than
half.
T.
DePuy: That's what we have at the Outback, also.
G.
Lake: I think what Dick is worried about is that particular location.
As far as this lighting Dick, you want that cut in half or higher?
D.
McGoey: The attempt of the engineer to reduce the wattage of only
one light on the site, I was a little bit upset about that. I
want to make it extremely clear that I'm looking at the lighting
levels on the site.

Lake: Do you agree with this?

Dulgarian: Yes. We questioned the lighting at the other building
there and that was offset from the road.

DePuy: I will have their Lighting Engineers redo it.

Lake: Ask them to have it cut in half, minimum.

DePuy: Okay.
G. Lake: It's a safety issue at this point.
T.
DePuy: The signal timing is to be modified by the Department of
Transportation. I know Phil Grealy had called up the signal division.
I don't know whether or not he has heard back from them. We will
make sure it is taken care of.
D.
McGoey: One more thing. We need a contribution to the slip ramp
at Exit 122.
T.
DePuy: Right.
D.
McGoey: That's on the basis of traffic similar to TGIF's.
T.
DePuy: Yes.
D.
McGoey: Dan Patenaude has some issues on drainage.
T.
DePuy: I met with him yesterday. I guess what's happened is there's
an old drainage system that has collapsed out on Crystal Run Road.
We're going to install two additional catch basins running up
the curb line and then pick up the last piping area there. We're
going to work with him to get that straightened out.

McGoey: I will need those revisions on the Site Plan.
G.
Lake: I did talk to Mr. Patenaude today and he did tell me that
they did work this out to his satisfaction.
