Lake: Public Hearing started at 7:37 P.M. M. Hunt read the
Public Hearing notice.

Hunt: NOTICE IS HEREBY GIVEN that a PUBLIC HEARING of the
Planning Board of the Town of Wallkill, Orange County, New
York, will be held at the Town Hall at 600 Route 211 East,
in said Town, on the 17th day of September, 2003 at 7:30 P.M.
or as soon thereafter as the matter can be heard that day
on the application of John L. Jr., and Doris Cieslewitz for
the approval of a two lot subdivision located on the west
side of King Road, 300 feet +/- west of Scotchtown Collabar
Road under Article III, Section 2 A of the Subdivision Law
of the Town of Wallkill. All parties of interest will be heard

Lake: Can you please bring us up to date?
D.
Yanosh: This is a one hundred thirty one acre parcel of land
on King Road. We were here about a year or so ago and cut
off one lot off of King Road which is on the opposite side
of that lot. It would be a 2.72 acre lot, fifty foot of frontage
on King Road. It comes back through the woods out to the open
field in the back. It will be a single family home, four bedroom
house. There will also be an individual well and septic.

Lake: Let me go through the Board before the Public?

Dulgarian: I will wait until after the Public Hearing.

Lake: Do you have Dick’s comments?

Yanosh: Yes I do.

Lake: Do you want to go through them real quick?
D.
Yanosh: I have mentioned the septic. That’s no problem.
Setting the monuments is the other one. It is a labeling problem.
The wetlands, I just gave Dick a map which was done by the
Department of Environmental Conservation and I will give you
a copy of that for the file. We are in the process of Eustance
& Horowitz approval for the septic system. The Agricultural
District, I did bring a list down to the Town. MaryLynn has
got a copy of what I mailed out to the individuals that they
said was in the Agricultural District. I don’t know
if you got any response back from that.

McGoey: How about the note for the Agricultural District?
D.
Yanosh: I need a note?
G. Barone: It is a note to notify the owners that there is
a farming operation happening near by.
D.
Yanosh: That won’t be a problem.

Lake: Are we also supposed to combine the Public Hearing with
the Agricultural District?
G.
Barone: No. There’s no requirement on the Agricultural
District to have a Public Hearing.
G.
Lake: I thought we did.
G.
Barone: A notice has to go out to the farmers that a Public
Hearing is taking place.
G.
Lake: Do we have the mailings for the Agricultural District?
D.
Yanosh: Yes, she has that.
G.
Lake: Let me go back through the Board.
A.
Dulgarian: Dan, why the fifty foot right-of-way? Why didn’t
you just put the lot all the way out to King Road?
D.
Yanosh: If you walked out there, the majority of the property
. . .
A.
Dulgarian: Is it a natural boundary?
D.
Yanosh: It is an open field through the rest of it. He may
want to put a couple more lots up there. It’s a pretty
open field from the rest of the area.
A.
Dulgarian: I just wish it were done a little differently.
I hate it when fifty foot right-of- ways to the back of the
lot just to make a couple more lots.
D.
Yanosh: The only reason we have this is everything to the
west of our lot is wetlands.

Owen: Came in at this time.
R.
Carr: The driveway is really tight with the neighbor. I don’t
know how close you are to the house. The other thing is the
site distance, is that really five hundred thirty feet coming
out of the driveway to the left?
D.
Yanosh: Four hundred fifty, I have.
R. Carr: Dick, I don’t know if you saw that but coming
out to the left.
D.
McGoey: I was out there but quite honestly I couldn’t
quite figure out where that driveway was coming in.

Carr: If the site distance is okay, I don’t have a problem
with the layout other than that driveway.
G.
Luenzmann: I don’t have anything.
G.
Monaco: Nothing.

Hamilton: Dan, what was your reasoning for the fifty foot
right-of-way?
D.
Yanosh: It’s not a right-of-way. It’s a fifty
foot flag, is what it is.
T.
Hamilton: But you said something about if he wanted to do
something further.
D.
Yanosh: The front parcel. He can’t do any more in the
back. The front piece back here is a nice open field. He may
be able to get two or three lots up here in this open field.

Lake: Do you have any problems with Dick’s comments?
D.
Yanosh: No.
G.
Lake: Are you going to check the site distance?
D.
Yanosh: Yes. The Highway Superintendent will have to look
at it.
T.
Hamilton: Dick, shouldn’t they make it easier on us
if they flagged it some how so we would know where the driveway
will go?
D.
McGoey: That would be nice to have.
R.
Carr: It’s flagged now.
T.
Hamilton: Was that flag the property line?
R.
Carr: It was the flag to the property line and not the driveway.
D.
Yanosh: The property line and then the driveway is up above.
A. Dulgarian: Just a question about the Agricultural District.

Jasko: It’s the car hop.

Hamilton: You have no approval for that.

Jasko: For the car hop.

Hamilton: There is no approval for anything. You shouldn’t
be doing anything until you receive approval from us. Are
you selling food there, also?
A.
Jasko: We do have a concession. We have a permit for it.

Hamilton: The motor home, what is that there for?
A. Jasko: That’s our office right now.

Hamilton: Nobody living there at night?
A.
Jasko: No.

Hamilton: Will that be taken out?
A.
Jasko: Yes, once we get into the building.

A. Jasko: No.

Hamilton: What is the car hop?
A.
Jasko: A car hop is a place that custom cars, etc., come in.
The car hop girls come up and serve you at your car. It’s
not eat in. What they do, they line up in the parking lot
and we give out trophy’s to the best car.

Lake: Any other questions? You realize, this is what you’re
getting your approval on. The trailer?
A.
Jasko: Once we get into the building.

Lake: Are you using the building yet?
A.
Jasko: No.

Lake: After the approval will you be using the building?

Jasko: Yes.

Hamilton: What about the time trials?

Jasko: We’ve dropped that also.

Dulgarian: I’m just trying to figure out, no modifications
to the existing building?
What about the parking lot?
