C. Kelly: NOTICE IS HEREBY GIVEN that a PUBLIC HEARING of the Planning Board of the Town of Wallkill, Orange County, New York will be held at the Town Hall at 600 Route 211 East, in said Town on the 2nd day of October, 2002 at 7:30 P.M. or as soon thereafter as the matter can be heard that day on the application of Roger J. Ferris, 16 Roberts Street, Middletown, New York 10940 for the approval of a four lot residential subdivision of a 21.11 +/- acre parcel. The parcel of land is located on t he northerly side of Coutant Road, Tax Map Parcel: Section 5, Block 1, Lot 36.25, under the Subdivision Regulations of the Town of Wallkill. All parties of interest will be heard at said time and place. S/Gary Lake, Chairman

R. Ferris: I am the owner of the property. The parcel is located on the north side of Coutant Road. It?s twenty one acres in size. We are proposing four residential building lots, each of the lots are over five acres in size. They would be for single family residences.

G. Lake: I will go through the Board.

R. Carr: Nothing now.

T. Hamilton: Nothing.

G. Lake: Is there anyone from the public for this application?

G. Lake: Do you have Dick?s comments?

R. Ferris: Yes I do.

G. Lake: Do you have any problems with them?

R. Ferris: The easement that was originally proposed the Town has re-graded the road there
so it is really not needed any more. They cut that shoulder all the way back through there.

D. McGoey: It still shows up on your plan.

R. Ferris: Yes. I can take that off.

D. McGoey: Take it off between now and final and show the new site distances.

R. Ferris: The site distances are great now.

T. Hamilton: Did they grade to where the easement lines are?

D. McGoey: They did major grading out there.

G. Lake: I do want to say that the Town guys who did work out there said that you were more than willing to talk to them. It was nice to here.

R. Ferris: I don?t have a problem with the second item which is the mitigation and I?ve got a review with Eustance & Horowitz tomorrow for septic.

G. Lake: Let me go through the Board.

A. Dulgarian: I like the plan, nice sized lots. My only concern is that there be no future subdivisions of these properties.


R. Ferris: I don?t believe your zoning would allow that because of the frontage.

A. Dulgarian: I wonder it that?s something you could put on the map stating no further subdivision of these lots.

R. Ferris: I don?t think the zoning is going to allow it. It would just re-enforce it.

G. Lake: So, you are willing to put that on?

R. Ferris: Yes.

P. Owen: I have no problems. I like it.

R. Carr: It is a nice project.

G. Monaco: It is a nice project with big lots.

T. Hamilton: No problem.

G. Lake: I don?t have any problems.

3. PUBLIC HEARING 7:35 P.M. - CHRISTIAN FAITH FELLOWSHIP - SITE PLAN/SPECIAL USE PERMIT - M & M Road (14-1-29.1) #056-002

G. Lake: Public Hearing started at 8:42 P.M. C. Kelly read the Public Hearing notice.

C. Kelly: NOTICE IS HEREBY GIVEN that a PUBLIC HEARING of the Planning Board of the Town of Wallkill, Orange County, New York, will be held at the Town Hall at 600 Route 211 East, in said Town on the 2nd day of October, 2002 at 7:30 P.M. or as soon thereafter as the matter can be heard that day on the application of Christian Faith Fellowhip, Inc., 10 East Main Street, Middletown, New York 10940 for approval of Site Plan and Special Use Permit for 44,000 square foot church, chapel and office with day care facility located on the southeast side of M & M Road and NYS Route 17M, Tax Map Parcel: Section 14, Block 1, Lot 29.1 under Section 249-39 of the Zoning Law of the Town of Wallkill. All parties of interest will be heard at said time and place. S/Gary Lake, Chairman


P. Cirillo: The Christian Faith Fellowship is proposing a 44,000 square foot building which would consist of a fellowship hall, sanctuary and some offices. It will have adequate parking. The zoning calls for two hundred fifty six spaces and we provide two hundred fifty nine spaces. There are two access points. In the development of the overall site, we did have a site distance problem here. We?ve shown that we?ve re-graded this area and enhances the site distance to about four hundred fifteen feet. In addition we will be taking the storm water and catching it in three different ponds which will act both as detention and pollution control. The two small ones are here near the secondary entrance and the large pond down here that goes parallel to a small stream over here. The majority will run off in that direction. The facility will get it?s water from an on-site well. We are proposing a two stage (not clear) for a sewage treatment which will collect to a pump station here and will eventually be discharged to a small stream. The permit has been applied for with the Department of Environmental Conservation. There are some wetlands which have been delineated. We are encroaching on about 20.09 acres. We are allowed under a tenth of an acre under the Nationwide Permit so we have worked the facility around those wetlands.

G. Lake: Before I go to the Public, I will go through the Board.

A. Dulgarian: How much area are you showing here? Is it three acres?

T. DePew: No. There?s fifteen acres. There?s three acres required under this Special Use Permit but we have fifteen.

A. Dulgarian: This parcel we?re looking at is on fifteen acres?

T. DePew: Yes. I think we are dedicating one acre for road use. There?s actually fourteen acres on the project.

P. Owen: Nothing now.

R. Carr: Nothing.

G. Monaco: Not right now.

T. Hamilton: Nothing.

G. Monaco: Is there anyone from the public who would like to comment on this application?

G. Lake: Dick?s comments. Dick, I know we?ve had a couple of work sessions already.

D. McGoey: Do you have a problem with any of these? You definitely have to look at the road shoulders for a guide rail.

T. DePew: Yes, in the one area by the pond that they were concerned.

D. McGoey: Are there any comments from the fire department?

T. DePew: Yes. They did want access on the back side and we?ve provided a fire lane access on the rear of the building. That was their only comment. I did get some wording on the clearing from the attorney?s office which I will put on the plan.

D. McGoey: And you?ve got clarification of the agricultural district verification?

T. DePew: Yes. We did the mailings and there were two other agricultural districts that were mailed to.

T. Hamilton: Did they get the landscaping at the detention pond, did they approve that?

D. McGoey: No. They still have to comply with that.

T. DePew: Yes, we don?t have any problem with that.

R. Carr: What type of guard rail are you putting in?


T. DePew: We?re going to put a double beam in. I think on the map the concern is the pond here.

G. Lake: Dick?s comments, you can comply with all of them?

T. DePew: Yes.

A. Dulgarian: Why are you discharging to the stream? Because of the size of the septic?

T. DePew: Yes. It?s actually not a septic. We had done soil tests out there and because of the percolation rate being so high we couldn?t get a standard septic system in so we went to a two-stage sand filter.

A. Dulgarian: Is that common practice?

T. DePew: Yes.

D. McGoey: It?s permitted by the State. You have to get a permit from the Department of Environmental Conservation for it.

T. DePew: That?s one of the conditions in Dick?s letter that we obtain the proper permit. They also review the plans and give approval on the plans.

A. Dulgarian: So, it?s just a matter of the soils wouldn?t handle the standard septic. It has nothing to do with size, just soils?


T. DePew: It?s a combination of size and soils. If we had really good soils we could have probably gone with a large septic but because of the percolation rate.

G. Lake: Is this something like the Village of Pine Bush uses?

D. McGoey: Bloomingburg has one.

G. Lake: I?m just curious about it.

A. Dulgarian: As long as Dick?s comments are complied with I have no problem.


P. Owen: I?m curious. What?s the square footage of the church itself?

P. Cirillo: I would say about fifteen thousand square feet.

T. DePew: The parking requirements are based on the number of seats.

P. Owen: Do we have any figures on how many people belong?

Unidentified Person: We have about six hundred members.

P. Cirillo: The sanctuary itself is nine thousand seven hundred and two square feet. It will have seating for seven hundred.

R. Carr: Is the parking lot lit?

T. DePew: We weren?t lighting the parking lot.

P. Cirillo: We have some lights on the exterior of the building.

R. Carr: It?s an attractive project. You?re going to put in the landscaping in the front?

T. DePew: Yes.

G. Monaco: No problem.

T. Hamilton: Nothing.
