R. Carr: What kind of curbing?

A. Fusco: It will be installed curbing. It is just basically cleaning up the property. Like I said it started out re-paving and they said as long as we?re paving we might as well do curbs and sidewalks, hide the dumpsters, that type of thing.

T. Hamilton: What about the building facing?

A. Fusco: Nothing is being done to those at the present time. They have been painted. The wood features have been painted. There is quite a bit of brick. It?s clean and it?s neat and there is not much litter around. It?s a pretty decent spot.

P. Owen: Nothing right now.

R. Carr: Nothing right now.

G. Monaco: Nothing right now.

T. Hamilton: Nothing right now.

G. Lake: Do you have the letter?

A. Fusco: No.


W. Cummings: Gary, do you want me to go over it?

G. Lake: If it?s okay with the Board because it?s not a Public Hearing and basically I?m not even sure if we have it okayed by the applicant. Mr. Barone, it?s not a Public Hearing.

G. Barone: I?m sure he can explain his comments. There is no problem with that.

W. Cummings: We were first advised that there were only thirteen parking spaces going in. The first set of plans I got said forty five, now the second set Mr. Fusco just gave you says fifty one. We have a real tight problem in this facility at the present time because of the parking. It is very, very congested. We realize the applicant is trying to improve the property but to fire any fires it is almost impossible to take trucks in there.

G. Lake: How many new parking spots?

A. Fusco: Right now we have a total of forty five. The new map that I have here is forty five new spaces.

G. Lake: Can you please point out exactly where they are?

A. Fusco: Sure. Entering into the property off of Silver Lake Scotchtown Road you?ve got two spaces that would be tucked in the back right here. In addition to that coming around the area here we have fifteen new spaces along this section here. We have seven new spaces in that section.

A. Dulgarian: Where is that?

A. Fusco: It?s grass in the back area but it?s asphalt and what we?re looking to do is to try to increase some parking in that area.

G. Lake: Is the parking needed right there?

A. Fusco: They could be eliminated, that?s true.

G. Lake: I mean that does look pretty tight to me.


W. Cummings: Gary, I asked Dick to measure it today and when we measured we have less than twenty feet going through this and at some places we have eight feet. We can?t get through.

D. McGoey: The ordinance requires . . .

G. Lake: I realize that also but we?re also dealing with an older project. We need to get where the new parking spots are. My feeling is where you?re adding new parking spots there should be curbing. If you are cutting something done to twelve, eight feet and nobody can get through to add parking spaces I think you?re going to have to take them out. That?s only my opinion.

A. Fusco: Okay.

G. Lake: The old stuff I can live with, it?s there. They?ve had to live with it until this point. The new stuff should at least, if you need twenty feet it should be twenty feet. I will poll the Board on that.

P. Owen: I agree with you. The stuff that?s there, that?s one thing.

A. Fusco: Mr. Chairman, I have absolutely no problem with that. What we tried to do was to squeeze as many parking spaces on really to make the Board happy. Obviously the owner would like to have them for convenience but to be honest with you we sort of forced them on him because we?re trying to accommodate it since we were so sort on parking we thought since we were coming before the Board that you would look stronger at the parking than any other issue.

R. Carr: Where do all these cars park right now?

A. Fusco: There are enough parking spots there now for the tenants.

R. Carr: Like pulling up here on the grass?

A. Fusco: They?re not pulling up on the grass. They may be using public transportation. Instead of two cars, they have one car.

R. Carr: The only reason that you?re asking for the parking spaces is really to make sure that we?re happy?


A. Fusco: That?s why we?re adding so many. We can cut that in half. They can always use more parking.

G. Lake: Everybody can but at the same time we can?t cut it down to eight feet.

A. Fusco: Sure. We would be more than happy on the new spaces to meet all the requirements.

G. Monaco: On the fifteen spaces, is there any way you could take some of the seeded land out to open this up?

A. Fusco: Yes, absolutely.

G. Monaco: Would that help the situation a little?

W. Cummings: I have to be honest with the Board and ask for a work session for this and go out and see it. I just got the plans.

G. Lake: First off, he?s been to a work session. Let?s get back. He has agreed to open up the parking to code. That was one of your main concerns.

W. Cummings: One of the concerns is the additional parking coming to code but then the distance between the stops also is a problem.

D. McGoey: The width of the spaces don?t seem to be nine feet that we require.

G. Lake: He just said he was going to meet the code.

W. Cummings: And then the roadway itself doesn?t meet code either, the six spaces. Where he?s adding say the fifteen new ones here, we went from having a roadway to no roadway.

A. Fusco: We agree to eliminate the parking to keep the aisle width as it exists.

W. Cummings: Gary, I just got this plan as I walked in the door.

P. Owen: Is there any new item or improvement which would change the existing lot?

G. Lake: The next item is the traffic circle.


W. Cummings: Do you see the one in the middle?

G. Lake: Is that there now?

W. Cummings: It?s there now.

G. Lake: Can you get around it?

W. Cummings: If they put the curbing it, we won?t be able to. Curbing is pretty much destroyed at this time. We?re going over it now. We?re recommending no curbing there. We would rather see it eliminated. It does give us some room to make the turns.

G. Lake: You want them taken out fully?

W. Cummings: That?s what we would like. Gary, you?ve been in there. We have buildings on both sides to the left and it?s impossible. We have to bring the aerial tower into this facility every time we go on a run.

A. Fusco: So you want us to eliminate the curbing on the island, is that what you?re saying?

W. Cummings: We would like to eliminate the island.

G. Lake: That?s up to the Board.

R. Carr: Is that an island right now?

A. Fusco: It?s a little bit of greenery.

A. Dulgarian: I haven?t had a chance to think about it. I respect Mr. Cummings opinion on this at least letting us know it?s a safety issue. Then maybe it does need to be removed. I don?t know.

G. Lake: Are you telling us it?s a safety issue?

W. Cummings: Yes.

P. Owen: I don?t know.


R. Carr: In the one sense when you?re coming in there, you come in to a nice grass seeded areas.

G. Monaco: If it comes down to aesthetics and safety, I?m all for the safety.

T. Hamilton: I will go with the safety.

P. Owen: Are we talking about eliminating the island?

G. Lake: Eliminating the island?

A. Fusco: That?s what we?re talking about.

G. Lake: Is it well maintained?

A. Fusco: It?s well maintained.

P. Owen: Is it a grassy island right now?

A. Fusco: Grass in front. It is a little bit of greenery.

G. Lake: You are concerned about the curbs?

W. Cummings: Yes.

A. Fusco: We will leave the curbs off.

A. Dulgarian: Is there any curb on that now?

A. Fusco: It?s crumbled.

A. Dulgarian: Then let them clean it up and let the grass blend in with the blacktop.

T. Hamilton: And eliminate those parking spaces.

A. Fusco: That?s fine. We will eliminate the new spaces.


W. Cummings: The only other problem we have is your plans now call to remove the walkway and on this new plan if you notice by building #3, they are moving the walkway and it?s going to become asphalt which I don?t think we really.

A. Fusco: It will be concrete. Dick asked us to do concrete.

W. Cummings: But you put parking spaces on the other side of that walkway also and we would be opposed to that because now we would have a double set of parking spaces and how do we get to the side of that building? On building #5?

G. Lake: You only had four items.

W. Cummings: He handed me a new set of plans this evening. This is different from the other set of plans I received this afternoon. There are brand new spaces behind building #5 that were not on the plans I had this afternoon.

A. Fusco: What we did is they?re parking on those now. We will put some no parking signs there. The reason we added them there is that people are parking there now. Originally what we had wanted to do was to eliminate all of that parking and put green grass in that area but we were advised that it wouldn?t be recommended. There was an intent originally to take that and make it all grass. I don?t mind eliminating that.

G. Lake: Those two parking spots, they are well outside the roadway.

W. Cummings: No. You have the wrong set of plans. He has a whole new set.

A. Fusco: We will put no parking signs there.

R. Carr: Now I know what you?re talking about.

G. Lake: There wasn?t supposed to be no parking there any way.

A. Fusco: They do park there. I saw it today. That?s why I added it on.

W. Cummings: We want to make sure that all turning radius meet for fire truck apparatus at all areas.

G. Lake: Anything you?re discussing will meet code.


A. Fusco: Absolutely.

W. Cummings: The only problem I have with that is who is going to determine what portion of the new construction requires new code because he?s on an existing roadway.

G. Lake: We can?t ask him to re-build the whole thing.

W. Cummings: I?m not asking for that.

G. Lake: Where ever if makes changes, he will meet code. I think that?s fair.

W. Cummings: I do too as long as we get an opportunity to review it with the Engineer to make sure it?s done.

T. Hamilton: Dick, can we get the dimensions on there so we know what we?re looking at?

D. McGoey: Yes. We need to see the revised plans.

A. Fusco: No problem.

G. Lake: Dick, do you want another work session?

D. McGoey: Yes.

1. HEIMBACH - 2 LOT SUBDIVISION - Maples Road (36-2-48.15) #061-001

A. Fusco: I am here for a two lot subdivision for Mr. Heimbach. We received Preliminary Subdivision approval. We had a review letter which indicated two items. One was that the Town did not receive approval of the septic system from Eustance & Horowitz. I did enclose a copy of a letter from him indicating that approval. The second item there was a question on relating to site distance. You had required on the map that we it have an enhanced area for the site distance. A twenty five area must be cleared and cleared of brush along the side of the road so that the visibility will be improved. Towards that end it was recommended that we check with the Planning Board Attorney to for some proper language of that note. I have submitted that to Mr. Barone and copies are included in the letter I gave to you, Mr. McGoey and Mr. Barone. I believe at this point we are in compliance. We will add that note to the plans if it meets with your approval.

G. Lake: I will go through the Board.

A. Dulgarian: No.

P. Owen: No.

R. Carr: No.

G. Monaco: No.

T. Hamilton: Department of Public Works comments?

D. McGoey: I didn?t get any.

A. Fusco: I had met with Dan Patenaude earlier on and he has no problem with it.

G. Lake: Did we get that letter on the septic approval?

D. McGoey: Yes, we received it.
