W. Abt: He had wanted to have sidewalks in the front of the building.

A. Dulgarian: He just wanted the dimensions on it?

W. Abt: Yes.

A. Dulgarian: I do have a problem. All the details are minor. I don’t have an issue.

G. Monaco: No comments.

T. Hamilton: No comments.

12. A & D MANAGEMENT - SITE PLAN - East Main Street (50-2-21) #100-002

G. Lake: Tell us what you want to do.

S. Plass: It’s a Site Plan for an office building, part professional, part medical/dental. We’ve been to several work sessions. There are a few outstanding comments still we’re waiting to hear about from Orange County Department of Public Works. A couple of other little comments on here that actually I’ve taken care of some of them already. I don’t know if you want to go through them.

G. Lake: Yes, why don’t you go through the comments so we can see which ones you have taken care of.

S. Plass: The first one is sidewalks along East Main Street. We’re not proposing any due to the fact that there aren’t any on that side and the bridge is a few hundred feet down the road and we can’t get a sidewalk past there.

G. Lake: There are sidewalks on East Main Street.

S. Plass: Across the street there are sidewalks. On the south side of East Main Street there are sidewalks.

G. Lake: Mr. Dulgarian, do you have any comment on that?

A. Dulgarian: I tend to agree as much as I’m an advocate of sidewalks that it is on the other side of the street down to Schutt Road right up to Middletown but there is nothing on that side of the street.

G. Lake: Go ahead.

S. Plass: A ten foot separation must be provided from the proposed right-of-way line. I spoke with the County of Orange and we’re going to give an easement from the centerline because if we give the land then obviously we can’t meet any of the requirements. We are ten feet from our property line.

T. Hamilton: We know it is going to be widened.

A. Dulgarian: We already went through that with Stewart’s.

T. Hamilton: It wouldn’t meet.

A. Dulgarian: The taking has to be shown on the plan and it has to be incorporated in the plan and not just shown there because if it does happen then you lose all the landscaping you have put in.

S. Plass: Actually the landscaping is behind the proposed right-of-way line.

T. Hamilton: But we won’t have the separation.

S. Plass: We’re not going to lose any of the additional ten feet.

T. Hamilton: Why don’t you just move it back four feet.

S. Plass: Because the site is so small that you can’t get all the required parking in. There just isn’t enough room on the site. I spoke with the County and they had no problem with it.

T. Hamilton: Yes, but we’re talking our zoning.

S. Plass: That’s who asked for that right-of-way.

T. Hamilton: We’re looking for our setbacks that our zoning calls for.

S. Plass: I do have ten feet from the property line. There is ten feet from the property line.

P. Hines: From the existing but not from . . .

S. Plass: We’re offering an easement for that.

P. Hines: I realize that but I think the Board is aware that widening will occur at some time.

S. Plass: If it does occur we will have about six to seven feet in that area.

P. Hines: The one question, you have one additional parking space more than required?

S. Plass: Yes, we do have one.

P. Hines: What about #13.

S. Plass: Okay.

P. Hines: If you lost #13.

S. Plass: Knock that out and push everything back. That’s a possibility.

P. Hines: I’m not sure that it will work. You may have to change the design.

S. Plass: A Town road cut, we have a detail on that. I’m not quite sure why that comment keeps appearing.

P. Hines: It has to do with coming off the property.

S. Plass: There is a detail on page 2.

G. Lake: We were looking for . . .

P. Hines: He also had a comment on the lighting.

T. Hamilton: The light projection.

P. Hines: You can show it in detail.

S. Plass: At the work session he was concerned about the neighbors.

P. Hines: He is looking for the foot candles.

S. Plass: Item #4 is Orange County Department Public Works, which we’re waiting for. Item #5 was an error on the drafting. We have since fixed it. The new pavement is shown. I’m not sure. There is an existing gravel parking area. We added one more tree in the middle of the parking lot. There’s not really enough room for anything else.

P. Hines: Any additional landscaping there may create a site distance problem.

S. Plass: We have three trees proposed and then some little bushes. We went out and checked our site distances today and we have five hundred eight three feet from the traffic light at Schutt Road that you can see and four hundred fifty six feet in the other direction.

A. Dulgarian: You have four hundred fifty six?

S. Plass: Four hundred fifty six to the right towards Mechanicstown.

G. Lake: We’re waiting on the Department of Public Works yet from Orange County.

S. Plass: Yes.

G. Lake: You have a couple of changes to make.

S. Plass: Yes.

A. Dulgarian: The topography here, is that existing or proposed?

S. Plass: Both. The solid lines are existing and the dash lines are proposed.

A. Dulgarian: There is only a twenty foot difference between the front and the back?

S. Plass: Yes.

MOTION to TABLE for further review made by G. Monaco and seconded by A. Dulgarian.

13. PHILIPSBURG (TETZ) - SITE PLAN/SPECIAL USE PERMIT - Cemetery Road (78-1-29) #035-003

G. Lake: Please tell us where you’re at.

R. Stack: It is my understanding that the determination of SEQRA is coming up and a Positive Declaration and also a resolution adopting that Positive Declaration and confirming that the Planning Board is Lead Agency.

G. Lake: Let’s do a Positive Declaration on this. Did you get Dick’s comments?

R. Stack: Yes. We got Dick’s and your Attorney’s comments and they were both incorporated into the document.

G. Barone: I agreed to incorporate those comments.

R. Stack: Under SEQRA you have an option that you can scope the document or not scope it. We’re under a one year time frame here.

J. Ullrich: We’ve had two work sessions with Mr. McGoey which actually started back in July and he was in agreement that the issues were exactly the same.

G. Lake: I feel confident that our Engineers can work this out.

A. Dulgarian: I’m all for approving it at this location. We’ve seen this.

G. Lake: I just want to make sure the Board is comfortable.

G. Monaco: No problem.

T. Hamilton: No problem.
