Planning Board of the Town of Wallkill, Orange County, New
York, will be held at the Town Hall, 600 Route 211 East, in
said Town on the 16th day of October, 2002 at 7:30 P.M. or
as soon thereafter as the matter can be heard that day on
the application of H. O. Penn Machinery Co. Inc., 122 Noxon
Road, Poughkeepsie, New York 12603 for approval of H. O. Penn
Facility; Proposed Repair; Rental; Leasing and Sales Facility
for Caterpillar Equipment; County Road 76, Town of Wallkill,
under Section 249-40 of the Zoning Law of the Town of Wallkill.
All parties of interest will be heard at said time and place.

Lake: Can you please give us a brief description of the project
and what you want to do?
S.
Quinn: The proposed site is about thirty five acres. It consists
of six lots. We propose to combine them into two new lots.
Their proposed site is about 17.9 acres and the other lot
is about 17.5 acres. It was previously a sand and gravel mine.
The H. O. Penn Facility is for sales, rental, leasing, and
repairs fo caterpillar equipment. This site will consist of
the new building about 25,000 +/- building. There will be
a proposed storage shed area, a proposed wash loading storage
area with a large fenced area for caterpillar equipment in
the rear. A detention basin on site with landscaping. The
site is served by outside water well and on the site septic
system.

G. Lake: Do you want to go through them? The fire department
issues, did we receive a letter from them?

Kelly: No we did not.

Lake: You have to go to Eustance & Horowitz?

Quinn: We were there today on the septic system.
G.
Lake: And the drainage, Dick?
D.
McGoey: I have some concerns for the off-site drainage. They
are concentrating subsequent flows to the detention basin
and discharging it out onto the County Road and York Road.
Did you look at that at all?
S.
Quinn: No. I would like to see if we can change it a little
bit for the site to capture more site flow.
D.
McGoey: The off-site drainage is not adequate to handle that?
S.
Quinn: I didn?t check it but I may be able to change some
grading.
D.
McGoey: That will have to be resolved.

Lake: We?ve had a lot of work sessions on this one. Let me
go through the Board.

Dulgarian: Dick, you were satisfied with the landscaping plan.
Is there a mix of trees that will maintain year round?
D.
McGoey: Yes.

Dulgarian: What is the twenty five foot marker the footprint
on building #4?
S.
Quinn: That?s a concrete apron.

Dulgarian: What is the purpose of that?
S.
Quinn: (Not clear).
A. Dulgarian: Where is the equipment going to be displayed?
S.
Quinn: There is a display area in front?

Dulgarian: That?s it?
S.
Quinn: Yes.

Dulgarian: How many pieces of equipment are you going to have
on display at one time?
My question is, is this more of a repair facility?

Johnson: I?m the General Manager of Parts and Service for
H. O. Penn. We typically don?t display equipment out front
other than a couple of pieces that we may either have on special
or something new. All of our equipment is stored in the back
and when customers come in to purchase equipment that?s where
we take them. We don?t display equipment.

Dulgarian: So, everything?s going to be in a fenced in area
in the back?

Johnson: Correct.

Dulgarian: Is that lit?
O.
Johnson: It will be lit. We have lighting shown.

Dulgarian: That mounts on the building that will light that
area?

Quinn: The lighting actually won?t go back to cover the entire
fenced area. There is lighting around the facility.

Luenzmann: You?re going to store trucks, cabs, bodies and
stuff like that for sale?

Lake: Tell us what type of equipment.
G. Luenzmann: Can you point the area to me? That?s going to
be a fenced in area and you will be selling equipment from
that area.

Johnson: Everything that we sell basically is off the road
equipment.

Luenzmann: One thing, what is the visibility from Route 17?
O.
Johnson: You can see it.
G.
Luenzmann: G. Luenzmann: You won?t be able to see it.

Johnson: There is a hill that slopes up in the back.

Monaco: I have no questions.

Hamilton: The only thing, Dick, did they straighten out the
issue with displaying out in front?
D.
McGoey: Yes.
T.
Hamilton: You were looking for a letter from Dan or somebody?
D.
McGoey: He can?t be in the twenty five feet but he can be
within the fifty feet.

Lake: I have no problem.
D.
McGoey: Someone said tonight you wanted to increase the building
size? I think you should put that on the record and it will
become part of the approval.
S.
Quinn: The proposal is to increase the size sixteen feet on
the front and fifteen feet on the side.
G.
Lake: That will meet all setbacks?
S.
Quinn: Yes.
G.
Lake: It won?t affect the site plan at all?
S.
Quinn: No.
D. McGoey: Can you move the building back fifteen feet to
make up that fifteen feet in the front?
S.
Quinn: I think we will.
D.
McGoey: I wouldn?t want to see the parking getting any closer
to the road.

Kelly: NOTICE IS HEREBY GIVEN that a PUBLIC HEARING of the
Planning Board of the Town of Wallkill, Orange County, New
York will be held at the Town Hall at 600 Route 211 East,
in said Town on the 16th day of October, 2002 at 7:30 P.M.
or as soon thereafter as the matter can be heard that day
on the application of ALDI, Inc., 300 State Route 281, Tully,
New York 13159-0584 for approval of two lot subdivision of
50-1-31 located on Route 211 East (old Rickles building property)
under Section 249-39 of the Zoning Code of the Town of Wallkill.
All parties of interest will be heard at said time and place.

J. Sweeney: I?m here on behalf of the applicant.

Lake: Can you please give us a brief description?
J.
Sweeney: Mr. Pilletteri will do that for you. Let us say that
it is an all purpose Public Hearing. We have subdivision,
we have Site Plan and Special Use. The essential part is this
subdivision approval because of it?s zero lot line. This is
the old Rickle?s building and before that it was the Big V
Shop Rite building. It will be divided essentially in half,
the dark area will be the area that?s going to be occupied
by ALDI, Inc. It amounts to about thirty thousand square feet
and the balance will remain in the ownership of the Rosenberg
family. That?s the essential part.
C.
Pilletteri: We?re essentially taking the existing building
and demolishing this portion of the rear thereby decreasing
the overall size of what is currently there. The new total
square footage is about thirty one thousand square feet. It?s
in a Highway Commercial district. We are proposing some substantial
increases in the amount of landscaping and green space on
the site. We performed our drainage analysis and addressed
Mr. McGoey?s comments on all his issues as well as a traffic
impact analysis of the site. There are some remaining technical
comments and some other issues that Mr. Sweeney will go through.
The Fire Department comments we believe have been addressed
regarding the turning radii and the additional fire hydrants
on the site. We have enough parking for the site. We?re proposing
exactly what is required per the code thereby not requiring
any variances. We have already received the zero relief from
the Town Board.

Lake: I will go through the Board.

Dulgarian: The red area is going to purchased or what ever
by ALDI, Inc. We?re looking at two different stores in there?

Sweeney: No.

Pilletteri: Yes.

Dulgarian: And they are going to take seventeen thousand square
feet.
C.
Pilletteri: Exactly and the other will have thirteen thousand
square feet will be retail.
A.
Dulgarian: So, that will be rented to somebody else?
C. Pilletteri: Yes.
A.
Dulgarian: Just for my own knowledge, seventeen thousand square
feet of a grocery store, is that smaller than what we have
in Town? Is it going to more of a speciality thing? It looks
small.
J.
Sweeney: Good question. I have Mr. Kibling with me who is
a General Operator of the business. He will explain it to
you. It?s interesting.
L.
Kibling: ALDI?s is a little unique. It?s a limited number
of grocery stores. They only carry about six to seven hundred
items. We have six thousand stores world wide. It is a large
operation and was developed in Germany back in the mid 1940's.
We have fifty stores in New York State. One store is in Newburgh.
That is our closest store here and we have a store in Kingston.
Basically they carry one type of item. We don?t need the shelf
space. We only carry six hundred or so of the quickest moving
type of items in a supermarket. It?s kind of a unique concept.
We keep over overhead very low and keep our prices much lower.

Dulgarian: So, you will be offering the community something
a little different than what we have?
L.
Kibling: An alternative to a supermarket size.

Owen: No. I?ve actually been to one of their stores. It?s
pretty unique.
R.
Carr: Nothing at this time.

Luenzmann: The only question I have is between the colors
is an open space. Is that going to be used?
C.
Pilletteri: Yes. They will be placed between the proposed
retail and the existing building.

Monaco: I was just concerned about the parking.
