to the drawings. Lot #1 will need a driveway culvert and that?s
been added. Lot #2 the grades into the parcel are so no culvert
is required. We would be asking for a Public Hearing to be scheduled.

G. Bergman: I?m an Engineer with Eustance & Horowitz. I?m
here representing Bryant Holdings LLC. We?re here requesting an
approval of a two lot subdivision. The property is located on
Crystal Run Road. The existing building was formerly Refrigeration
Resources which received Site Plan approval from this Board in
early 1999. The applicant has closed his business of which he
will sell the building and therefore subdivide off approximately
7.8 acre parcel from the parent parcel. He has no plans presently
for the parent parcel. The parent parcel contains probably about
ten to fifteen acres of wetlands however, there are several pieces
of it that could be developed. There is three and a half acres
adjacent to Crystal Run Road and at least seven acres in one contiguous
parcel at the rear of it and about five acres in another. He has
no plans to do anything. He is going to keep the remaining twenty
five acres. He wishes to subdivide off the 7.8 acre parcel with
the existing building on it.

Lake: When was that subdivided?

Bergman: We represented in 1999 and we represented the former
owner before that. I know of no other subdivision. We represented
the Taco Chip with Louis Barbone about 1989.

Bergman: We didn?t subdivide it then either.

Bergman: I have Dick?s comments. I?ve answered comment #1. The
side setback for the existing building on the westerly side should
be shown. I?ve shown it on the revised plan but I haven?t submitted
it yet.

McGoey: I missed your explanation of comment #1? Do you have a
sketch plan?
G.
Bergman: No I don?t have a sketch plan. We have no plans for doing
anything but we did calculate the acreage that was available for
development. There?s three and a half acres at the front portion,
that would be the northwest corner of the property adjacent to
Crystal Run Road. There?s approximately seven acres at the parcel
in the rear. He has no plans to do any development on the property.
There is usable property there.

McGoey: I just want you to make sure the Board knows the lot is
build-able.

Bergman: Absolutely. My client understood that also. The accuracy
of the wetland boundaries. I did verify that with Dick. The horizontal
and vertical datum. We will note that. We covered the previous

Johnson: I tried to get in touch with Mr. McGoey today. Dick,
I got your letter today stating that you never received the one
where the soil erosion is. I dropped off, when we talked that
day two sets of plans. One with the first proposal that we had
with the two driveways. And the second set of plans with one private
road in there. I had no idea until I got these comments today
that Dick never got those.

Lake: I think that?s when you gave us something like this. Then
we talked about . . .

at that work shop and that?s why we asked you if you wanted to
go the Town Board to see if they would even consider the open
development. This Board cannot grant you an open development without
going to the Town Board first.

Dulgarian: Can you explain open development?
G.
Lake: The Town Board can approve a road in there which will be
a private road and is maintained by them. It is shared. It has
to be a Town Board action.

Dulgarian: So, that?s not up to us to approve it then?
G.
Lake: No.

Johnson: I?m trying to propose it with the open development with
one private road going in serving the four lots with Mr. Sawka
holding the remaining 6.09 acres for his own house which has already
been built there instead of having the other plan where we had
the two driveways or three driveways serving the rest of the lots.

Dulgarian: What do we do? We send a recommendation to the Town
Board.

Dulgarian: The one you?re calling the open development private
road is substantially better than the alternative here in my opinion.
