P.
Owen: I agree.
R.
Carr: Yes.
G.
Luenzmann: I generally don?t have a problem with flag lots but
I did have a problem with this. This plan is much better.
G.
Monaco: Nothing.
T.
Hamilton: I agree.
G.
Lake: Dick?
D.
McGoey: Yes.
G.
Lake: We can send a letter to the Town Board on this?
D.
McGoey: If the Planning Board wishes to send a recommendation
to them.
E.
Johnson: As long as I am here, I would like that recommendation.

1. WAL-MART DISTRIBUTION CENTER - SITE PLAN/SPECIAL USE PERMIT
Route 17/Route 17K (1-1-66, 67, 44, 43, 1.2, 2.222) #057-002
CANCELLED.
2. TINTLE/LEARY - 3 LOT SUBDIVISION - Howells Road (32-1-23) #084-002
D.
Yanosh: I am the surveyor for the project. This is a 19.57 acre
parcel of land in the RA zone on the west side of Howells Road.
There is an existing two-story house and a barn and some old foundations
on it. The proposal is for a three lot residential subdivision.
Lot #1 would contain the existing house and barn 6.4 acres. Lot
#2 which has fifty feet of frontage, a small little flag lot would
have 6.54 acres. Lot #3 6.63 acres.
G.
Lake: I take it you have received Dick?s comments.
D.
Yanosh: Yes. The biggest thing I guess with his comments is the
flag lot.
A.
Dulgarian: A flag lot?
D.
Yanosh: We looked at it and thought we could put a small road,
a small cul-de-sac and develop it a little differently. They live
in the big house. They are nice big lots. Instead of coming in
with a cul-de-sac. We tried to keep lot #1 a little bit bigger.
If somebody wants to have horses for the barn or something later
on down the road. The Town is always looking for bigger lots.
P.
Owen: It doesn?t bother me.
R. Carr: No problem.
G.
Luenzmann: No problem.
G.
Monaco: No problem.
T.
Hamilton: No problem.
A.
Dulgarian: I know Mr. Yanosh is very good at this stuff. I just
don?t know any other way. I imagine it?s as good as it?s going
to get.
G.
Lake: Will you put a note on there, no further subdivision?
D.
Yanosh: Sure.

3. MILLER - 7 LOT SUBDIVISION - Old Timers Road/Mt. Hope Road
(14-1-13) #082-002
D. Yanosh: I am the surveyor for the project. This is a 33.57
acre parcel of land in the Town of Wallkill and also in the Town
of Mount Hope. Lots #3, #4, and #5 do encumber the Town of Mount
Hope. The proposal is for a seven lot residential subdivision
for single family homes with a cul-de-sac at the end of Old Timers
Road. This was previously subdivided on the southerly side of
Old Timers Road, we cut off three lots. That was approved back
in 2001 of July. We do have some flag lots. We have a cul-de-sac
at the end. You saw a sketch of this when I first did the original
subdivision. You asked for a future plan. I had more lots back
here at one time. We have scaled it down. Lot #3 is a big lot,
lot #4 is a big lot. We have some nice big lots back there. I
know I don?t meet the required two hundred foot lot width on the
roads. Lots #5 and #6 both are on the County Highway. We?re not
going to use the road frontage for lot #6 off the County Highway.
We?re going to come off of Old Timers Road and make it easier
that way. We do meet the length from the cul-de-sac. They are
one hundred fifty foot wide where the buildings are set back at.
It?s almost similar to the ones we did across the street. Lots
#1 and #2 are actually nicely wooded lots. They are three acres
a piece also and secluded. The smallest lot is 2.6 acres. We still
have lot #7 which is on the southerly side of Old Timers Road.
It is an existing lot owned by Mr. Miller. It?s been owned by
him for a while. We went to the Zoning Board of Appeals years
ago to get a variance to put a house on that lot and got turned
down. One of the recommendations of the Board at that time was
to build the septic across the street.
D.
McGoey: Dan, who owns the property around this?
D.
Yanosh: Mr. Miller. It doesn?t meet the side requirements. It
was just for sketch.
G.
Lake: That little lot, that?s #7?
D.
Yanosh: Yes. It?s across the street.
A.
Dulgarian: Nothing.
P.
Owen: Nothing.
R.
Carr: Nothing.
G.
Luenzmann: I have a problem with lot #5.
D.
Yanosh: The lots off of Mount Hope Road are existing.
G. Luenzmann: I see that.
D.
Yanosh: They?re existing lots that were created many years ago
and were given access to the back.
G.
Luenzmann: It?s almost like lot #6 shouldn?t be there.
D.
Yanosh: Lot #5 is 4.82 acres. Lot #6 is 2.6 acres. Nice sized
lots. My suggestion is to take a ride through there and see what
this looks like. Some of it is meadow and some of it is wooded.
We do have to delineate some Federal Wetlands in the back between
lots #3, #4 and #5 through there. We are in the process of doing
that now.
G.
Monaco: Nothing.
T.
Hamilton: Nothing right now. I?m having trouble following the
lot lines.
G.
Lake: Have you been in to a work session with this?
D.
Yanosh: Yes.
T.
Hamilton: I think he should try and work a little harder.
A.
Dulgarian: You?ve got to do something. This is pretty ambitious.
I don?t think it?s really good planning are our behalf to approve
this the way the lot lines are.
P.
Owen: I can?t really tell him to go ahead with this the way it
is.
R.
Carr: I don?t like it. It is unorthodox.
G.
Luenzmann: It is unorthodox, the lot configurations. If it could
be done better, I think he should give it another shot.
D.
Yanosh: Are you looking at #5 and #6? If I combine the two together,
you still have three different lots.
G.
Monaco: Is there some way to . . .
T. Hamilton: Let him go back and look at it again. Dick, what
about notifying the other Town?
D.
Yanosh: We have to do that with the Public Hearing. There are
no houses being built in the Town of Mount Hope. I can add a note
to that affect.
G.
Lake: I think you have the feelings of the Board. I think they
would like to see it cleaned up a little bit.
D.
Yanosh: You?re more or less concerned about the ones off of Mount
Hope Road?
G.
Lake: Right.
NO
ACTION TAKEN.
4. MT. MEDICAL ACUPUNCTURE CLINIC - SITE PLAN - Maltese Drive/Route
211 East (54-1-13) #070-002
G.
Smith: I?m an Engineer in Monticello. I?ve done a couple of minor
revisions to the plan based on Dick?s comments.
G.
Lake: Are they different from what we have?
G.
Smith: The changes on here are different from what you have in
front of you. Do you want me to explain briefly what we?re doing
here?
G.
Lake: Yes please.
G. Smith: This is a parcel situated on Route 211 East between
Route 211 and Maltese Drive. It used to be the New York Telephone
Company property. There is a building on there now a concrete
block building. It was changed to Verizon when they bought it.
Mr. Chee has purchased it from Verizon. I have a couple pictures
of it. The property is in the Highway Commercial zone district
of the Town. What we wish to do is to open an acupuncture clinic.
He has one up in Sullivan County now and I imagine this would
be similar to that one. The property is connected to Town sewer
and Town water. Right now it?s a one-story concrete block building
painted white with a lot of graffiti on it and garbage all around
it. The driveway is off of Route 211. There?s a driveway that
goes to the site back to Maltese Drive. The intent is to leave
the driveway on Route 211 and leave the driveway on Maltese for
egress and build another driveway for another entrance or ingress
off of Maltese Drive. The Town zoning requires ten parking spaces.
We are showing thirteen on the site. The second sheet or third
sheet on your package is the landscaping plan with a whole variety
of different shrubs and ornamental trees that are shown around
the building and the perimeter of the property. For storm water
we are showing a detention basin on the Maltese Drive side, which
is the down grade side of the property and the drainage from the
property goes to a culvert under Maltese Drive to a big field
which is next to Silver Lake Fire Department and goes eventually
into Silver Lake. That?s essentially the intent of this plan.
G.
Lake: I will go through the Board.
A.
Dulgarian: Can you come back to me?
G.
Lake: Sure.
P.
Owen: I have nothing.
R.
Carr: The only thing, can you upgrade some landscaping on Route
211?
G.
Smith: I had shown some shrubs and trees along there. We can add
some more.
G.
Luenzmann: I have nothing.
G.
Monaco: Just some more landscaping.
T.
Hamilton: Just Dick?s comments.
A.
Dulgarian: I agree that the landscaping could be upgraded a little
bit. Is there ingress and egress existing now on Maltese Drive?
G.
Smith: Yes. There?s a driveway that goes through from Route 211
down to Maltese Drive.
A.
Dulgarian: But there is no curbing and landscaping back there?
G.
Smith: No.
A.
Dulgarian: You might want to put a little bit in there also.
G. Smith: It?s wooded now but you?re right landscaping will make
it look better.
R.
Carr: I think that is one of Dick?s comments. Dick, you had a
comment about the landscaping around the detention pond?
D.
McGoey: Right.
A.
Dulgarian: I agree with the rest of the Board that it is a very
good use for that property.
G.
Lake: Dick?s comments, you have them?
G.
Smith: Yes. I revised the curbing on Maltese Drive. It was originally
up to the edge of the pavement. I moved it back about four feet
from the edge of the pavement where the ingress and egress are
on Maltese. That is shown at least about four feet back from the
edge of the pavement now. Item #2 kind of goes with item #1. I
haven?t yet submitted to the Department of Public Works, we?re
going to do that to get their comments. Item #3, I see Mr. Cummings
is here. We dropped the plan off actually at the Silver Lake Fire
Department earlier this week. Item #4 the landscaping plan, Dick
was asking if we could add some more on the Maltese side. We will
add more. Item #5 on the current USGS map that shows fire hydrants.
There is one about five hundred and twenty feet east of this site
on Maltese Drive and at the end of Water Edge apartments and there
is another fire hydrant about five hundred thirty feet to the
west in Lothar?s parking lot. There is a hydrant about five hundred
feet on both sides of this property, plus hydrants across on Route
211. Item #6 there is a water service on the property now. I have
shown that on the current plan I just handed to Dick. It comes
in from Maltese Drive, then it comes up into the building. Item
#7 I added a new detail on the first sheet of the Site Plan showing
the double striped parking spaces in accordance to the Town zoning.
The last item #8 I just showed the trench detail on the plan that
Dick pointed out. That?s on the plan also.
G.
Lake: Let me go through the Board again.
A.
Dulgarian: Nothing.
P.
Owen: Nothing else.
R.
Carr: Nothing.
G.
Luenzmann: Nothing.
G. Monaco: Nothing.
T.
Hamilton: Nothing.
G.
Lake: It?s going to be good to see that little place cleaned up.
That?s for sure.
