The Town Board of the Town of Wallkill held a regular meeting on January 22, 2004 at 7:30 PM at the Town Hall, 600 Route 211 East, Middletown, NY. Present were Supervisor Ward, Councilman King, Councilman Valentin, Councilman Mulqueen and Councilman Depew.
Also present were Ed Smith, Superintendent of Water& Sewer, Robert Hertman, Chief of Police, John Lippert, Superintendent of Public Works, S. McLaughlin, Attorney for the Town and Louisa Ingrassia, Town Clerk.

I would like to request permission for our golf team to use the TOW Golf Course for the 2004 spring season. The season being March 8, 2004 through late May.

At this time we are also requesting the use of the TOW football fields located at Circleville Park for the 2004 fall season. That season beginning mid August (exact date TBA) and running through late October.

We have always enjoyed a positive relationship with the TOW and look forward to a continued successful relationship. Thank you for your consideration and cooperation.

Time Warner Cable has had a long-standing commitment to support educational excellence. As a founding member of Cable in the Classroom we began more than a decade ago to provide cable connections and basic cable service to schools, delivering more than 525 hours each month of commercial-free, high quality educational programming. As technology advanced we included high-speed cable modems and the Road Runner Internet service as part of our education commitment, all of which has been made possible at no charge to schools.

But technology alone cannot take the place of a dedicated classroom teacher whose enthusiasm and creativity motivates students to reach new learning heights.

For that reason I am pleased to announce our 15th annual Time Warner Cable National Teacher Awards. Twenty projects, based on innovative use off cable television programming and/or technology in the classroom, will be chosen from entries submitted from schools in Time Warner Cable divisions around the country. I have enclosed an entry form that explains the competition in detail for your information.

We hope to generate entries from Town of Wallkill and perhaps even a national winner. Whether or not that happens, however, the Awards give us a chance to acknowledge and encourage those model teachers who are preparing our students for their future.

I will be happy to keep you informed as the contest progresses and will gladly answer any questions you might have.

SUPERVISOR WARD: We have a letter from the Goshen Humane Society asking us to read a Resolution to create a National Spay Day USA.

Designating Tuesday, February 24, 2004 as "SPAY DAY USE"

WHEREAS, and dogs provide companionship to and share the homes of over 63,000,000 individuals in the United States; and

WHEREAS, two unaltered cats and their offspring can produce 420,000 more cats in seven years and two unaltered dogs and their offspring can produce 67,000 more dogs in six years; and

WHEREAS, humane societies and shelters have to kill five million cats and dogs each year, although many of them are healthy and adoptable, simply because there are not enough good homes; and

WHEREAS, the problem of companion animal overpopulation costs the taxpayers of this country billions of dollars annually through animal control programs aimed at coping with the millions of unwanted cats and dogs; and

WHEREAS, spaying and neutering cats and dogs has been shown to drastically reduce cat and dog overpopulation; and

WHEREAS, veterinarians, humane societies, national and local animal protection organizations, and private citizens worked together to ensure the spaying and neutering of an estimated 225,000 companion animals through "Spay Day USA" in 2003; and

WHEREAS, Veterinarians, humane societies, national and local animal protection organizations and private citizens have joined together again to advocate the spaying and neutering of companion animals on: "SPAY DAY USA 2004";

NOW, THEREFORE, BE IT RESOLVED by the Town of Wallkill that February 24, 2004 is designated "Spay Day USA". Supervisor John Ward is authorized and requested to issue a proclamation calling upon the people of the Town of Wallkill to observe the day by having their own cats or dogs spayed or neutered or by sponsoring the spaying or neutering of another person's cat or dog.

RESOLUTIONS

WHEREAS, petition has been made to the Town of Wallkill for the establishment of a lighting district in the proposed subdivision known as Alexandra Subdivision in the Town of Wallkill, and

WHEREAS, said petition has been deemed sufficient by this Board; and

WHEREAS, the Town Board of Wallkill is empowered by the State under NYS Town Law 194 to establish special lighting districts in the Town that it determines to be in the best interests of the public welfare of its citizens; and

WHEREAS, this board has determined that all property and property owners within the proposed district wil be benefited thereby; and

WHEREAS, this board did hold a public hearing regarding the establishing of a lighting district within Alexandra Subdivision on January 8, 2004, at 7:10 PM at the Town Hall, 600 Route 211 East, Middletown, NY 10940; and

WHEREAS, said establishment of lighting districts has been determined to be a Type II action
under the State Environmental Quality Review Act (SEQRA) criteria;

NOW, THEREFORE, IT IS HEREBY RESOLVED, as follows:

1. That the Wallkill Town Board hereby declares the establishment of lighting district in the proposed subdivision known as Alexandra Subdivision as a Type II action under the State Environmental Quality Review Act (SEQRA) criteria; and

2. That the Wallkill Town Board hereby establishes a lighting district proposed subdivision known as Alexandra Subdivision; and

3. That the Town Clerk be directed to file a certified copy of this resolution with the office of the state department of audit and control at Albany, NY, together with all appropriate papers with appropriate signatures where needed; and

4. All boards, agencies, departments, and contracted professionals of the Town of Wallkill are hereby authorized and directed to effect or otherwise facilitate the implementation of said District.

WHEREAS, a resolution was duly adopted by the Town Board of the Town of Wallkill for a public hearing to be held by said Governing Body on January 8, 2004 at 7:20 PM at Town Hall, 600 Route 211 East to hear all interested parties on a proposed Local Law entitled A LOCAL LAW AMENDING THE ZONING CODE OF THE TOWN OF WALLKILL, COUNTY OF ORANGE, NEW YORK, regarding a change in zoning designation of one parcel of property on Stony Ford Road in the Town of Wallkill (Section 61 - Block 1 - Lot 39.33); and

WHEREAS, notice of said public hearing was duly advertised in Times Herald Record, the official newspaper of said Town, on December 29, 2003, and

WHEREAS, said public hearing was duly held on January 8, 2004 at or about 7:20 PM at Wallkill Town Hall, 600 Route 211 East, Middletown, NY and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said Proposed Local Law, or any part thereof, and

WHEREAS, pursuant to part 617 of the implementing regulations pertaining to article 8 State Environmental Quality Review Act (SEQRA) it has been determined by the Town Board of said Town that adoption of said proposed Local Law would not have a significant effect upon the environment and could be processed by other applicable governmental agencies without further regard to SEQRA, and

WHEREAS, the Town Board of the Town of Wallkill, after due deliberation, finds it in the best interest of said Town to adopt said Local Law;

NOW, THEREFORE, BE IT

RESOLVED, that the Town Board of the Town of Wallkill hereby adopts said Local Law No. 1 of 2004, entitled A LOCAL LAW AMENDING THE ZONING CODE OF THE TOWN OF WALLKILL, COUNTY OF ORANGE, NEW YORK, a copy of which is attached hereto and made a part of this resolution; and be it further

RESOLVED, that the Town Clerk be and she hereby is directed to enter said Local Law in the minutes of this meeting and in the Local Law Book of the Town of Wallkill, and to give due notice of the adoption of said Local Law to the Secretary of State of New York.

WHEREAS, said public hearing was duly held on January 8, 2004 at or about 7:25 PM at Wallkill Town Hall, 600 Route 211 East, Middletown, NY and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said Proposed Local Law, or any part thereof, and
