WHEREAS, the Orange County Golf Club and the Town have come to an agreement on the terms of the acquisition, and

WHEREAS, it is necessary for there to be a subdivision and other engineering and surveying work to be completed before the acquisition of the property by the Town of Wallkill; now

THEREFORE, BE IT RESOLVED, as follows:

That the firm of Eustance and Horowitz, P.C. be authorized to prepare such engineering and surveying materials as may be necessary together with securing subdivision approval and such other approvals as may be necessary to accomplish the acquisition of a portion of the Orange County Golf Club property by the Town of Wallkill.

WHEREAS, pursuant to an agreement dated January 1, 1977 the Town of Wallkill has provided sewage treatment service to the Vincent Drive area of the City of Middletown, and

WHEREAS, pursuant to the agreement the City of Middletown is obligated to make certain payments to the Town of Wallkill for sewage treatment, and

WHEREAS, the City of Middletown has not made all of the required payments, and

WHEREAS, after discussions between officials of the City and the Town, the City proposes to pay the Town the sum of $120,000.00 for all monies due together with interest thereon up to and through December 31, 2001, and

WHEREAS, starting in January of 2002 the City has been making the payments required under the agreement, now

THEREFORE, BE IT RESOLVED as follows:

That the Town does hereby accept the offer from the City of Middletown to pay the sum of $120,000.00 to the Town in full settlement of all monies due the Town from the City for sewage treatment pursuant to the agreement dated January 1, 1977 through December 31, 2001.

WHEREAS, the Town Board has been concerned about the installation of new sanitary sewer mains connected to existing sewer mains all part of the public sewer because the new sanitary sewer mains have not been videotaped or reviewed by some similar electronic equipment, and

WHEREAS, the Town Board believed that it would be appropriate for better protection of the Town and the public sewer if all new sewer mains were videotaped or examined by similar electronic equipment and the results reviewed and approved in writing by the Superintendent of Water and Sewer or the Town Engineer prior to the connection to the public sewer, and

WHEREAS, the Town Board believes further that the best method to carry out the Town Board’s intent is to adopt a local law amending Chapter 194 of the Code entitled Sewers and Sewage Disposal providing for this procedure which local law will prohibit the issuance of certificates of occupancy for any new construction where the building sewer is connected to a new sanitary sewer main proposed to be connected to the public sewer and the Town Board determines further that it would be in the best interest of the Town and the public sewer that the requirements for inspection and approval not be satisfied by the posting of performance security, but that the Town mandate performance and approval prior to a certificate of occupancy, and

WHEREAS, a local law has been prepared to carry out the Town board’s intention, now

THEREFORE, BE IT RESOLVED, the movant of this resolution does hereby formally introduce the local law to the Town Board and move that a public hearing on the proposed local law be held on February 13, 2003 at 7:10 PM at the Wallkill Town Hall, following due notice.

BE IT HEREBY RESOLVED, by the Town Board of the Town of Wallkill,

1. that said Town board does hereby authorize the settlement of employment discrimination claim in the matter of Roland Mora v. Town of Wallkill by payment of $15,000 to the Claimant, specific to the terms presented by counsel; and
2. that the Town Board of the Town of Wallkill does hereby authorize the Supervisor of the Town of Wallkill to execute such documents as may be necessary to effectuate the settlement.

COMMITTEE REPORTS

COUNCILMAN KING: wants to start community garden project 1 ½ acre parcel- in water district. Residents would be able to grow veggies or flowers at very little cost.

MR. SMITH: town needs to have property survey by Eustance & Horowitz .

COUNCILMAN VALENTIN: read following:

Dear Board Members:
Your authorization is hereby requested to solicit bids for the following equipment purchases in accordance with the recently adopted 2003 Budget and the Highway Department’s 10 year Equipment Replacement Program:
1) 2003 Tandem Axle Dump Truck
2) 2003 Single Axle Dump Truck
3) 2003 1-ton pickup Truck with Utility Body

In conjunction with your authorization to solicit bids for these new pieces of equipment, we further request that the Town board declare the following items of equipment to be surplus in order that we may solicit bids for their purchase, and the surplus sale funds may be utilized toward the purchase of the new equipment items outlined above:

1) #145- 1986 International 12 yd Dump Truck with plow, wing and sander
2) #160- 1988 international 7 yd Dump Truck with plow, wing and sander
3) #514- 1982 Aeroil Tar pot

MR. LIPPERT: discussed state bids process

COUNCILMAN VALENTIN: parks meeting set for 1/28/03- upcoming summer camp, at 6:30 PM. Need to finish Circleville Park as money is left from this years grant.

COUNCILMAN McLEAN: met with CSEA Unit 2; discussed renovations for Police Department. Discussed search for building property; possibly separate court and police from regular Town Hall. RJ Smith (realtor) sent contract to help find property- 5% commission paid by seller, has not been signed.

COUNCILMAN DEPEW: Highway meeting with Mr. Lippert regarding drift problems on rural town roads; the golf course is looking for ideas to bring in golfers- specials, etc.


COUNCILMAN COMMENTS:

COUNCILMAN KING: discussed drifting snow and use of snow fence; needs plan for next year. Commended the water department for work done on water main break last Mon.

COUNCILMAN DEPEW: read the following letter:

Dear Sir:
I own the property as 38 Vanburenville Rd. (SWIS: 335200 SBL: 22-3-17). The property is across from Ingrassia Rd. The property has two 40 to 80 year homes existing homes on it, Both of which have been lived in by families for as long as I have owned the property.
I am interested in replacing the trailer with a newer one, I understand that the trailer is with in all legal Set Backs. In closed is a hand drawn plot plan of the property. Please get back as soon as possible with what I need to do to change this trailer with a newer one.

COUNCILMAN DEPEW: Pocatello Fire Co needs volunteers- contact the firehouse if interested. Howells has a Boy Scout can drop- someone is taking the cans during the night. Meeting regarding Townley hall purchase; tentative band concert at Washington Heights Park for May 24, 2003. Park land possibility on Shawangunk Kill off Meyer Road- 4 acre parcel- borders Sullivan County

SUPERVISOR WARD: Highway department holiday party awards- Ron Fello- 8 years with no sick days; Michelle White- 6 years with no sick days. Discussed the redistricting election districts- Ward 1, District 4 and Ward 2, District 2. Councilman Depew will undertake the re-districting. New York Security will allow the Town to use four cameras in Patio Road at cost of $40,000 to $50,000 for project. Golf Course winter recreation-

Friday 4 PM to 9PM and Saturday and Sunday 10AM to 7PM. Would like fireworks at the Golf Course on July 4th- looking for sponsors.

CHIEF HERTMAN: discussed non-specific threat against a public school in NYS. Within two weeks there will be a press conference concerning non-lethal device- they will start field testing. Will attend Project Linus blanket Day to give award for 40 blanket donations to the Police Department. Will put more patrols on areas of the graffiti.

MR. SMITH: with cold weather the water department has received calls regarding frozen water lines- suggests leaving closet doors open and heat tape on water lines.

MR. LIPPERT: Thanked board for support of vehicle replacement program; was at water main break- commends water department for a job well done. Discussed the snow fence- need permission from landowners.

SUPERVISOR WARD: number for golf course information and updates: 361-1392


PUBLIC PARTICIPATION:

N. Guenste; questions reserve fund- audit requested payment schedule; regarding the golf course would like to see money owed in budget.

SUPERVISOR WARD: explained method of repayment; to have line in budget is not workable.

N. Guenste; discussed Senior Way; survey of Town Hall

SUPERVISOR WARD: discussed Town Hall survey; new senior housing

P. Campbell; snow piles, walk at least a block to put out garbage; build a road between the Town Hall and the Community Center; questioned the survey by Eustance & Horowitz.

SUPERVISOR WARD: survey of Town Hall and Community Center property was rendered by Eustance & Horowitz; needed this to make decision on options.

Mike Cody; Vietnam; Easter egg hunt- April 19, 2003, needs money, donations, grass & top soil for park memorial.

Neil Hermann; Dec. 27, 2002 resolution regarding James Clark Drive- pending litigation with ownership of property, questioned snow removal prior to accepting.
