WHEREAS, heretofore MGD Development Group, LLC has offered to donate to the Town a 4.14 acre parcel which shows on the site plan presently being reviewed by the Planning Board being a portion of Section 73, Block 1, Lot 31.2, and

WHEREAS, MGD and the Town have agreed on a Declaration of Covenants and Restrictions which would limit the use of the 4.14 acre parcel as well as provide protection to the Town's water facilities which are adjacent to the parcel, and

WHEREAS, the Town of Wallkill is a proposed signatory to the Declaration of Covenants and Restrictions,

NOW, THEREFORE, BE IT RESOLVED as follows:

That the Town of Wallkill does hereby agree to accept a gratuitous conveyance of a 4.14 acre parcel being a portion of Section 73, Block 1, Lot 31.2 from MGD Development Group, LLC and agrees to accept the conveyance subject to the Declaration of Covenants and
Restrictions, and

BE IT FURTHER RESOLVED that the Town Board does hereby authorize the Supervisor, John F. Ward, Jr., to execute the Declaration of Covenants and Restrictions on behalf of the Town consenting to their terms and conditions.

WHEREAS, heretofore the Wallkill Town Board at the recommendation of the Superintendent of Water and Sewer, Edward A. Smith authorized a preliminary investigation and sewer system evaluation and survey for inflow/infiltration, and

WHEREAS, the Town selected the firm of Malcolm Pirnie, Inc. as the consultant to perform the evaluation, and

WHEREAS, Malcolm Pirnie has submitted a proposal for Phase II inflow/infiltration services, and

WHEREAS, the Town board is now ready to proceed with this project,

NOW, THEREFORE, BE IT RESOLVED as follows:

That the Town Board does hereby agree to retain the firm of Malcolm Pirnie, Inc. to perform the Phase II inflow/infiltration investigation, all as set forth in a written proposal from Malcolm Pirnie, Inc. Dated February 19, 2004 and does appropriate the sum of not more than $200,000.00 for the Phase II study and authorizes the Supervisor to execute such other and further documents as may be necessary to proceed.

WHEREAS, those residents of the Town who have been designated as custodians of the -- Voting machines during all elections and primaries in the Town receive a fixed annual stipend for their services; and

WHEREAS, in this presidential election year of 2004, there will be at least one additional day where said custodians' services will be needed; and

WHEREAS, all other workers involved with said elections and/or primaries will be compensated on a per diem basis;

NOW THEREFORE, BE IT HEREBY RESOLVED, by the Town Board of the Town of Wallkill THAT the stipend paid to -- Voting machine custodians for the year 2004 and only for the year 2004 shall be increased by $210.00 per custodian.

COMMITTEE REPORTS

COUNCILMAN KING: Water & Sewer - Discussed meeting on I & I Study. Thanked Betty Jaroka and Lou Ingrassia, Jr. For their help. Explained automated water meter reading system.

COUNCILMAN VALENTIN : Parks & Recreation - Discussed drainage and electrical upgrade at Little League Park and upcoming Parks Dept. Projects. Police - Stated use of cameras will continue on Greenway Terrace.

COUNCILMAN DEPEW: Congratulated Belle Russell on her retirement. Discussed Parks & Recreation projects. Announced $60,000 grant for Washington Heights Park. Explained tree replacement system. Discussed Farmers Market proposal for end of June and July.

COUNCILMAN COMMENTS

COUNCILMAN KING: Announced Agricultural Assessment due Monday. Pamphlets available for tree seedlings.

COUNCILMAN VALENTIN: Attended Belle Russell's retirement brunch. Commended her for work with Boys & Girls Club. She will continue running Summer Camp. Discussed article on waste management. Asked Town Board to start legal action for reimbursement.

COUNCILMAN KING: Asked that this be brought uup at next work session.

COUNCILMAN DEPEW: Discussed grant for Pocatello Fire Dept. Thanked Ken Wilson and Donna Carroll for helping that Dept. Thanked Troop 273 for attending meeting and discussed Eagle Scout project. Also discussed seminar at Association of Towns.

SUPERVISOR'S COMMENTS

SUPERVISOR WARD: Reported $1,462,840.09 received from Pyramid for taxes. Discussed session at Association of Towns on moratoriums and meeting where resolutions are adopted. Explained some of the resolutions discussed included retirement, funding, Wicks Law, tort reform, mandates, lawsuits, property tax exemption, 207-C Disability for Police Officers, EMS for volunteers, speed limits, binding arbitration, condo assessments, cable franchise fees, equalization rates for commercial and residential property.

CHIEF HERTMAN: Discussed Grant received Stop DWI reported on status of Police Department including number of officers.

SUPERVISOR WARD: Stated Mr. Lippert is ill and Councilman Mulqueen if out of Town on business.

PUBLIC PARTICIPATION

G. Nemeth, resident and Scout Master, commented on United Way not contributing to scouting. He asked for contributions for Friends of Scouting.

SUPERVISOR WARD: Thanked the Scouts and recognized Judge Guertin.

M. Cody announced Easter Egg Hunt April 3, 2004.

N. Guenste asked about State of Town address and control of golf course. She discussed waste management.

Supervisor Ward will send letters to haulers.

V. Ferri asked about districts for Tower Drive project and cost maintenance for access roads of Galleria. In favor of moratorium. Suggested adding tax rolls on web site. Thanked Police Department for presence at peace vigil. Asked that Building Inspector be voted out.

J. Amato commended Building Department for helping to get a handicap rame at his residence.

D. Reid thanked neighbors for their support and stated children never caused problems. She stated a light is needed on Ontario Avenue. She discussed waste management.

N. Hermann discussed sewer plant. Asked about amount of water used per household. Also asked about reimbursement for road services and why Town has individual attorneys. Asked about building permit numbers being posted at sites. Asked about demolition building sites and Town's cell provider.

S. Labruna commented on Crotty Road site and new Town Hall location. Asked about CM & Sons issue.

N. Guenste commented on meter reading and condition of Town Hall.

D. Reid asked qualifications for Building Inspector.
