The Town Board of the Town of Wallkill held a regular meeting on March 11, 2004 at 7:30 PM at the Town Hall, 600 Route 211 East, Middletown, NY. Present were Supervisor Ward, Councilman King, Councilman Valentin, Councilman Mulqueen and Councilman Depew.

Pledge of Allegiance led by Councilman Depew.

As Public Relations Mgr. Of Eastern New York Bassmasters Inc. And Jrs. I met and spoke with Gary Lake about using your facilities for our Fishing Derby sponsored by Gander Mountain on May 2, 2004.

We would start setting up at 6:00 AM and leave by 5:00 PM. The event itself will be from 9:00 AM until around 1:00 PM.

We anticipate approximately 50 or 60 children competing in the Fishing Derby. After fishing we will give out trophies, prizes, etc., and serve some sort of food and beverage.

I am requesting a resolution authorizing a procurement of bids to repair electrical service at the Community Center. There is an urgent need to repair or replace the sprinkler system controls as well as smoke detectors in the system to prevent water damage to the building and ensure fire protection. Your prompt attention to this matter is greatly appreciated.

Please be advised that we are in receipt of a cost estimate for the establishment of a performance bond for the recreational improvements for the Regency Club Apartments located on Schutt Road from Depuy Engineering dated 28 January 2004. In line with our review we find that several items of work including the tennis courts, swimming pool and clubhouse are somewhat below that which could be constructed by prevailing wage in the opinion of our office. We have, therefore, modified the engineer's estimate as shown on the markup of the enclosed cost estimate.

On the basis of the above, if the Planning Board wishes to approve the establishment of a performance bond, in lieu of the requirements that the improvements be constructed prior to issuance of the first Certificate of Occupancy, we would recommend that the performance bond be posted in the amount of $365,000.00.

RESOLUTIONS

WHEREAS, the Superintendent of Water and Sewer has recommended the Town install an automatic meter reading system at an estimated cost of $990,000.00, and

WHEREAS, this is a project which must be publicly bid,

NOW, THEREFORE, BE IT RESOLVED as follows:

That Eustance & Horowitz, P.C. Consulting Engineers is hereby authorized to develop bid specifications to go to public bid after review by the Town Board on a proposal to replace all existing water meters with an automatic meter-reading system.

WHEREAS, the Town of Wallkill acquired a parcel of land on Crane Road in the Town of Wallkill by virtue of abandonment; and

WHEREAS, it is no longer necessary for the Town to retain said property; and

WHEREAS, it is in the best interests of the Town to transfer said parcel into private ownership, so that it may be placed back upon the tax rolls; and

WHEREAS, it is in the best interests of the Town to transfer said property for market value consideration to the highest responsible bidder;

NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wallkill, in regular session duly convened, does hereby authorize and direct the Supervisor of said Town to cause said real property, identified as Section 87 - Block 1 - Lot 155.1 on Crane Road in the Town of Wallkill and further identified as surplus property, be offered for public sale through the bidding process, as established and approved by the State of New York; and

RESOLVED, that the Town Board directs the Town Clerk of the Town of Wallkill to publish in the normal and legal manner a request for bids for the purchase of said property; and

RESOLVED, that the minimum acceptable bid is hereby set at $75,000; and

RESOLVED, that the time for the opening of such bids be set at two o'clock in the forenoon of the day of Thursday, April 15, 2004.

WHEREAS, the Town of Wallkill acquired a parcel of land in an area known as Keystone Park in the Town of Wallkill by virtue of abandonment; and

WHEREAS, it is no longer necessary for the Town to retain said property; and

WHEREAS, it is in the best interests of the Town to transfer said parcel into private ownership, so that it may be placed back upon the tax rolls; and

WHEREAS, it is in the best interests of the Town to transfer said property for market value consideration to the highest responsible bidder;

NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wallkill, in regular session duly convened, does hereby authorize and direct the Supervisor of said Town to cause said real property, identified as Section 37 - Block 2 - Lot 3.2 in the Town of Wallkill and further identified as surplus property, be offered for public sale through the bidding process, as established and approved by the State of New York; and

RESOLVED, that the Town Board directs that the sale of said property be subject to a permanent restriction placed upon the property and recorded in a subsequent deed that only a single one family residence may be erected on said property and that said property may not be further subdivided and directs the Town Clerk of the Town of Wallkill to publish in the normal and legal manner a request for bids for the purchase of said property; and

RESOLVED, that the minimum acceptable bid is hereby set at $75,000; and

RESOLVED, that the time for the opening of such bids be set at two o'clock in the forenoon of the day of Thursday, April 15, 2004.

COUNCILMAN DEPEW: Stated residents want to make sure only one residence can be build on the lot with minimum lot size of one acre.

WHEREAS, there exists a vacancy in the Town of Wallkill for a Parking Enforcement Officer, part time; and

WHEREAS, Russell Dodd fulfills the required of knowledge, skill, and experience for the part time parking enforcement officer position; and

WHEREAS, it is the opinion of the Chief of Police of the Town of Wallkill Police Department that Russell Dodd is qualified to fill said position;

NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wallkill hereby appoints Russell Dodd to the position of Parking Enforcement Officer, part time, to serve in said capacity at the Town of Wallkill Police Department.

WHEREAS, Town Board of Wallkill wishes to adopt a local law to amend Chapter 194, Article II of the Town Code of the Town of Wallkill to update the inspection fee schedule for residential hook-ups to the municipal sewer system in the Town of Wallkill; and

WHEREAS, the Town Board of Wallkill is empowered by the State to adopt such local law pursuant to Municipal Home Rule Law; and

WHEREAS, said code amendments are listed as Type I Actions under 617.5 of the State Environmental Quality Review Act (SEQRA); and

WHEREAS, in compliance with SEQRA, the Wallkill Town Board wishes to assume lead agency status and set a time and place for a public hearing for said proposed local law, so that the public may be heard;

NOW, THEREFORE, it is hereby

RESOLVED, that a public hearing be held by the Town Board with respect to the adoption of the aforesaid Local Law at 7:25 PM on April 8, 2004, at Wallkill Town Hall, 600 Route 211 East, Middletown, New York; and it is further

RESOLVED, that the Town Clerk is hereby authorized and directed to cause public notice of said hearing to be given as provided by law.
