WHEREAS, the Town Board of the Town of Wallkill intends to contract for bulk trash pick-up for residents of the Town of Wallkill on a one time annual basis, as part of its Bulk Pick-up Program; and

WHEREAS, the Town is required under New York State Law to award such a contract to the lowest responsible bidder;

NOW, THEREFORE, LET IT BE RESOLVED, that the Town Board hereby directs the Town of Wallkill Commissioner of Public Works to advertise for and solicit bids from qualified parties for the pick-up and disposal of bulk trash items on a one time basis as part of the Town's Bulk Pick-Up Program, according to parameters set by the Town Board.

WHEREAS, there exists a vacancy in the Town of Wallkill for a Dial-A-Bus driver, part time; and WHEREAS, Betty J. Pepper fulfills the required of knowledge, skill, and experience for thepart- time Dial-A-Bus position; and March 11, 2004

WHEREAS, it is the opinion of the Town Board of the Town of Wallkill that Betty J. Pepper is qualified to fill said position;

NOW, THEREFORE, BE IT

RESOLVED, that the Town Board of the Town of Wallkill hereby appoints Betty J. Pepper to the position of Dial-A-Bus driver, part time, to serve in said capacity in the Town of Wallkill Dial-A-Bus program.

WHEREAS, Town Board of Wallkill wishes to adopt a local law to amend Chapter 233, Article

II of the Town Code of the Town of Wallkill in order to designate a 3-way stop intersection of Bellvernon Avenue and Avenue C in the Town of Wallkill; and

WHEREAS, the Town Board of Wallkill is empowered by the State to adopt such local law pursuant to Municipal Home Rule Law; and

WHEREAS, said code amendments are listed as Type I Actions under 617.5 of the State Environmental Quality Review Act (SEQRA); and

WHEREAS, in compliance with SEQRA, the Wallkill Town Board wishes to assume lead agency status and set a time and place for a public hearing for said proposed local law, so that the public may be heard;

NOW, THEREFORE, it is hereby

RESOLVED, that a public hearing be held by the Town Board with respect to the adoption of the aforesaid Local Law at 7:20 PM on April 8, 2004, at Wallkill Town Hall, 600 Route 211 East, Middletown, New York; and it is further

RESOLVED, that the Town Clerk is hereby authorized and directed to cause public notice of said hearing to be given as provided by law.

WHEREAS, Gander Mountain Sports is preparing to open in the former Wal-Mart location on March 27, 2004, and

WHEREAS, Gander Mountain has completed all the work as required by the site plan approval granted by the Wallkill Planning Board, and

WHEREAS, the completion of the required access for Gander Mountain is part of the Middletown Honda project which has also received site plan approval from the Planning Board, and

WHEREAS, the Middletown Honda access work will not be completed by March 27, 2004, and

WHEREAS, it is appropriate for the Town to be secured that when the work is completed the access will be constructed as required,

NOW, THEREFORE, BE IT RESOLVED as follows:

That the Town of Wallkill agrees to accept performance security in the amount of $25,000.00 in such form as it satisfactory to the Attorney for the Town to insure that the access driveway to Gander Mountain is completed in accordance with the approved site plans for Gander Mountain and Middletown Honda, and

BE IT FURTHER RESOLVED:

That upon posting the required security and the work at the site being substantially completed that the Building Inspector is authorized to issue a certificate of occupancy or a provisional certificate of occupancy as he shall determine.

WHEREAS, the Town Board of the Town of Wallkill is desirous of offering its residents the fresh produce available at open air Farm Markets; and

WHEREAS, the Town Board of the Town of Wallkill is desirous of supporting the local agriculture industry in the region; and

WHEREAS, the Town of Wallkill Farmers Market will commence operation in June of this year; and

WHEREAS, the Town of Wallkill Farmers Market requires a central location for its operation one half day a week;

NOW, THEREFORE, BE IT HEREBY RESOLVED, by the Town Board of the Town of Wallkill

THAT the parking lot of the Wallkill Town Hall be designated as the location of the Town of Wallkill Farmers Market for the year 2004; and

THAT said parking lot shall be available for the use of said Farmers Market from 7:30 AM to 1:30 PM, each Saturday commencing June 19, 2004, through October 30th, 2004, but shall provide emergency access at all times for the Town of Wallkill Police Department and the Town of Wallkill Volunteer Ambulance Corps.

COMMITTEE REPORTS

COUNCILMAN KING: Thanked Board for two resolutions - Meter reading and Farmers Market.

COUNCILMAN VALENTIN: Reported on electrical upgrade at Little League Field and announced opening day of Little League is April 17th, opening day of golf course is March 26th weather permitting and Town of Wallkill Soccer opening day is March 27th. Easter Egg Hunt is April 3rd. Highway - Discussed upcoming pavement and drainage projects. Thanked Chief and Police Department for job well done.

COUNCILMAN MULQUEEN: Will get together with Councilman King for Finance Committee.

COUNCILMAN DEPEW: Thanked Mike Cody and Highway Department for work on Easter Egg Hunt. Discussed complaints of speeders on Pocatello Road.. Also discussed noise at 711 on North Street. Looking for volunteers interested in restoring VanBurenville Road cemetery. Presented Board with copies of conservation overlay for Shawangunk Kill.

COUNCILMAN KING: Discussed new resident package. Handed out copies of Local Law on moratorium.

COUNCILMAN VALENTIN: Discussed shed law changes. Supports extra money for Easter Egg Hunt.

COUNCILMAN MULQUEEN: Pointed out the rich texture of the community with so many ways people can take part in making the Town a better place. Congratulated Chief Hertman on favorable report. Discussed letter from Board of Elections.

COUNCILMAN DEPEW: Explained he supports wind power. Announced meeting for GIS andcommunity meeting Thursday at 5:30 PM in the conference room at Town Hall. Discussed school board meeting and bussing to Townley Hall.

SUPERVISOR COMMENTS

SUPERVISOR WARD: Discussed article by Orange County Partnership on impact of commercial development in tax base by school district. Also discussed meeting with Board of Elections. Explained effective growth control plan in the Town of Clarence where he will visit Monday.

CHIEF HERTMAN: Discussed work with monitor and explained how complaints can be made against police officers.

MR. SMITH: Thanked Board for moving Water Department into 21st century.

MR. LIPPERT: Discussed bulk pickup, hazardous waste & tire day and waste reduction grant. Announced wood chips available free to residents.

PUBLIC PARTICIPATION

M. Cody explained about Easter Egg Hunt April 3rd with April 10th raindate - Asked for additional $100.00.

V. Ferri discussed lot line changes, he opposes electronic -- Voting machines, asked about Citizens Frontier franchise. Discussed article on Transportation Development District. Asked about tax rolls on website. Stated difficulty obtaining library card for his son. Asked Board to vacate Zoning Board decision because of conflict of interest and illegal businesses in the Town.

N. Guenste asked about Little League parade and if Little League and Soccer are announced on TV. Discussed carpeting purchase of $11,000.00.

K. Breeze complained about snow plowing on Pine Street.

Resident of Mechanicstown complained about garbage on Bellvernon Avenue and speeders. Asked for traffic study and extra patrols.

D. Reid presented letter for opening on Planning Board or Zoning Board. Discussed light on Ontario Avenue. Asked about test for Building Inspector Assistant and rights of homeowner.

V. Ferri thanked Chief for good job. Asked about police complaint policy.

M. Cody stated highway workers are careful, work hard and help people when snow plowing.

D. Reid commended highway workers for good job.
