WHEREAS, Town Board of Wallkill may adopt a local law to amend the Town Code of the Town of Wallkill for the purpose of establishing a moratorium on all residential construction within the Town of Wallkill; and

WHEREAS, the Town board of Wallkill is empowered by the State to adopt such local law pursuant to Municipal Home Rule Law; and

WHEREAS, said moritoria are listed as Type II Actions under 617.5 of the State Environmental Quality Review Act (SEQRA) and, as such, are not subject to review under SEQRA; and

WHEREAS, the Wallkill Town Board wishes to set a time and place for a public hearing for said proposed local law, so that the public may be heard;

NOW, THEREFORE, it is hereby

RESOLVED, that a public hearing will be held by the Town Board with respect to the adoption of the aforesaid Local Law at 7:00 PM on May 13, 2004, at Wallkill Town Hall, 600 Route 211 East, Middletown, New York; and it is further

RESOLVED, that the Town Clerk is hereby authorized and directed to cause public notice of said hearing to be given as provided by law.

WHEREAS, the Local Government Records Management Improvement Fund (LGRMIF) was created in 1989 to provide technical assistance and grants to establish, improve or enhance records management programs in New York’s more than 4300 local governments, and

WHEREAS, the closely related Documentary Heritage Program (DHP) for grants and technical assistance to non-governmental historical records repositories also is supported by the LMRMIF, and

WHEREAS, the sunset data for the LGRMIF was established in the original legislation to permit its operation as a five-year experiment, and

WHEREAS, the New York State Legislature in 1995 twice has extended the sunset date, most recently to December 31, 2005, and

WHEREAS, the LGRMIF has effectively supported essential advisory services and 6,300 grants totaling over $113 million to improve the management of records for over half of all NYS local governments, and

WHEREAS, the LGRMIF and the programs it supports continue to operate at a high standard of excellence and provide direct and significant benefit to local governments of no cost to the taxpayers, and

WHEREAS, the Town of Wallkill has benefited from technical assistance, training and publications supported by the LGRMIF, and

WHEREAS, the State Legislature created the closely-related Cultural Education Fund (CEF) to support the New York State Archives, New York State Library and New York State Museum on behalf of all New Yorkers, and the Office of Public Broadcasting, and provided the CEF with an identical sunset date, and

WHEREAS, the LGRMIF and the CEF continue to be critically important in the fulfillment of the many records and information related responsibilities of the Town of Wallkill, and to the cultural and scientific needs of the people of New York State,

NOW THEREFORE BE IT RESOLVED, that the Town of Wallkill supports the elimination of said sunset provisions in order to make the LGRMIF and the CEF permanent.

WHEREAS, Town Board of Wallkill may adopt a local law to amend Chapter 249 of the Town Code of the Town of Wallkill to amend the zoning code to provide for the size of areas to be included for purposes of notification of certain applications before the Planning Board and the Zoning board of Appeals; and

WHEREAS, the Town board of Wallkill is empowered by the State to adopt such local law pursuant to Municipal Home Rule Law; and

WHEREAS, said zoning changes are listed as Type I Actions under 617.4 of the State Environmental Quality Review Act (SEQRA); and

WHEREAS, in compliance with SEQRA, the Wallkill Town Board wishes to assume lead agency status and set a time and place for a public hearing for said proposed local law, so that the public may be heard;

NOW, THEREFORE, it is hereby

RESOLVED, that a public hearing be held by the Town Board with respect to the adoption of the aforesaid Local Law at 7:10 PM on May 27, 2004, at Wallkill Town Hall, 600 Route 211 East, Middletown, New York; and it is further

WHEREAS, the Town Board of Wallkill is empowered by the State to adopt such local law pursuant to Municipal Home Rule Law; and

WHEREAS, said code amendments are listed as Type II Actions under 617.5 of the State Environmental Quality Review Act (SEQRA); and

WHEREAS, in compliance with SEQRA, the Wallkill Town Board wishes to assume lead agency status and set a time and place for a public hearing for said proposed local law, so that the public may be heard;

NOW, THEREFORE, it is hereby

RESOLVED, that a public hearing be held by the Town Board with respect to the adoption of the aforesaid Local Law at 7:20 PM on May 27, 2004, at Wallkill Town Hall, 600 Route 211 East, Middletown, New York; and it is further

WHEREAS, Town Board is empowered to adopt such changes by resolution under Chapter 242 of the Town of Wallkill Code; and

WHEREAS, said proposed changes are Type II Actions under 617.5 of the State Environmental Quality Review Act (SEQRA); and

WHEREAS, in compliance with SEQRA, the Wallkill Town Board wishes to assume lead agency status and set a time and place for a public hearing for said proposed change, so that the public may be heard;

NOW, THEREFORE, it is hereby

RESOLVED, that a public hearing be held by the Town Board with respect to the adoption of the aforesaid changes at 7:00 PM on May 27, 2004, at Wallkill Town Hall, 600 Route 211 East, Middletown, New York; and it is further

WHEREAS, the Town Board of the Town of Wallkill did appoint Betty J. Pepper to the position of Dial-A-Bus driver, part time, to serve in said capacity in the Town of Wallkill Dial-A-Bus program; and

WHEREAS, said appointment should have been to a full time position of Dial-A-Bus driver; and

WHEREAS, it is the opinion of the Town Board of the Town of Wallkill that Betty J. Pepper is qualified to fill said position, full time;

NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wallkill hereby amends its resolution of March 11, 2004, appointing Betty J. Pepper to the position of Dial-A-Bus driver, part time, to serve in said capacity in the Town of Wallkill Dial-A-Bus program, in that said position shall be full time; and

RESOLVED, that said amendment shall be retroactive to April 1, 2004.

WHEREAS, Entergy Corp., owner and operator of the Indian Point Nuclear Power Plants, has expressed its intent to apply for operating license extensions of 20 years for IP2 and IP3, and being that the Westchester County Board of Legislators has previously expressed its concern over the continued operation of the nuclear power plants at the Indian Point Energy Center through several resolutions passed by the Westchester County Board, including Resolution No. 142-2002 which calls on officials from the Federal, State and Local governments to work with relevant parties to develop a plan that includes the below listed action steps, namely:

1. The development of an alternative, uninterrupted, and affordable energy source to replace the power currently produced at Indian Point,
2. The development of a financial plan that will mitigate the negative real estate tax implications on the local communities, school district, and county government,
3. The development of a plan to positively consider the current employees, such consideration will include job placement, retraining of affected workers, and other employment strategies, and
4. The development of a plan that ensures that spent fuel rods will be immediately secured and properly protected on site from the threat of a terrorist attack or accident, and

That and orderly closure and decommissioning of the Indian Point Nuclear Power Plants begin at the earliest possible time, and

WHEREAS, this Honorable Board supports the Westchester County board, based on the potential of a terror attack on the plants, a concern about the age of the plants, and the potential results of a failure of equipment or human error in the operations of the plants, and

WHEREAS, Indian Point 2 and 3 were initially licensed based on Nuclear Regulatory Commission (NCR) regulations promulgated over 30 years ago, and if plant owners were to apply for a license to operate a nuclear power plant at the Indian Point site today, it would not likely be granted by the NRC under its current standards and regulations, specifically prohibiting the siting of nuclear power plants based on population density considerations,

NOW THEREFORE BE IT RESOLVED, that the Town of Wallkill Town Board opposes the re-licensing of Indian Point 2 and Indian Point 3 when their current licenses expire in 2013 and 2015, respectively, and that the NRC prohibit Entergy Corp.’s Indian Point 2 and 3 from being re-licensed, and to make this finding as soon as possible so that all concerned and involved parties can devote their time and resources to finding alternatives to the existing nuclear power plants, and be it further

RESOLVED, that the NRC should modify, through its GEIS process, it’s siting regulations to reflect current considerations including that of terrorism, and be it further

RESOLVED, that the Clerk of the Town of Wallkill forward the text of this resolution to Orange County’s State and Federal delegation, to all legislative bodies and elected officials within the 50-mile zone surrounding the Indian Point Nuclear Power Plants, the Nuclear Regulatory Commission and Entergy Corp., so that the intent of this Honorable Board be widely known.

WHEREAS, the Town of Wallkill is conducting a search for real property conductive to the housing of the Town of Wallkill Police Department and/or the Town of Wallkill Courts and/or the Town of Wallkill Town Hall; and

WHEREAS, at least one site has been identified within the Town of Wallkill that may be appropriate for said Town facilities; and

WHEREAS, it is necessary for the Town to inspect said property in order to facilitate a decision regarding that property.

NOW, THEREFORE, BE IT HEREBY RESOLVED, by the Town Board of the Town of Wallkill,

THAT said Town Board hereby authorizes an expenditure of funds sufficient to cover the cost of an inspection of said property by the Town Engineer.
