The Town Board of the Town of Wallkill held a public hearing on August 28, 2003 at 7:15 PM at the Town Hall, 600 Route 211 East, Middletown, NY. Present were Supervisor Ward, Councilman Valentin, Councilman King, Councilman McLean and Councilman Depew. Also present were Ed. Smith, Superintendent of Water and Sewer, Robert Hertman, Chief of Police, John Lippert, Superintendent of Public Works, S. McLaughlin, Attorney for the Town and Louisa Ingrassia, Deputy Town Clerk.

MS. INGRASSIA: PLEASE TAKE NOTICE that a public hearing will be held by the Town Board of the Town of Wallkill on August 28, 2003 at 7:15 PM at Town Hall, 600 Route 211 East, Middletown, NY regarding the adoption of a Local Law of the Town of Wallkill for the year 2003, which would establish a Lighting District within that parcel within the Town of Wallkill to be known as Heritage Hills Subdivision.

Any resident of the Town of Wallkill is entitled to be heard upon said proposed Local Law at such hearing. Copies of said proposed Local Law at such hearing are available for review at Wallkill Town Hall, 600 Route 211 East, Middletown, NY 10940.

Please take further notice that the environmental significance of the proposed Local Law, if any, will be reviewed at said public hearing.

Smith, Superintendent of Water and Sewer, Robert Hertman, Chief of Police, John Lippert, Superintendent of Public Works, S. McLaughlin, Attorney for the Town and Louisa Ingrassia, Deputy Town Clerk.

MS. INGRASSIA: PLEASE TAKE NOTICE that a public hearing will be held by the Town Board of the Town of Wallkill on August 28, 2003 at 7:25 PM at Wallkill Town Hall regarding the adoption of a Local Law of the Town of Wallkill for the year 2003, which would amend the Zoning Code to allow for higher density horse population in R-2 zoned properties and set certain set-back minimums for same.

Any resident of the Town of Wallkill is entitled to be heard upon said proposed Local Law at such public hearing. Copies of said proposed Local Law are available for review at Wallkill Town Hall, 600 Route 211 East, Middletown, NY 10940.

Please take further notice that the environmental significance of the proposed Local Law will be reviewed at said public hearing.

Present were Supervisor Ward, Councilman Valentin, Councilman King, Councilman McLean and Councilman Depew. Also present were Ed. Smith, Superintendent of Water and Sewer, Robert Hertman, Chief of Police, John Lippert, Superintendent of Public Works, S. McLaughlin, Attorney for the Town and Louisa Ingrassia, Deputy Town Clerk.

SUPERVISOR WARD: We will go have a presentation by Mr. Valentin to the Junior Boys Team, 3rd Place in State Finals.

Mr. Valentin presents Merit Certificate to all players and coaches. Mr. Ackerman (from Little League) presents a plaque to the Town Board.

I am requesting a variance to replace my mobile home. The size of the existing mobile home is 10' x 55'. The dimensions of the new double wide mobile home is 28' x 70'.

For the past 10 years, I have been residing with my wife and four children in Arkville, NY and commuting to my job in Middletown during the week. In April 2003, my wife passed away. I find myself in a situation where I need to live full time on Derby Road so I can be closer to my children and they can go to school locally. Therefore, I need to upgrade my mobile home to support a family of 5.

Time is of the essence in this situation. I hope to be on the agenda for the next board meeting in order to get things going. If there is any other information that you may need, please contact me. My work number is xxx-xxxx.

Subject: Recommendation for Mr. Richard Gesner

I just wanted to let you know how pleased I was with the support I received from Mr. Richard Gesner and another individual whose name I did not receive but was Mr. Gesner's turnover at the July 20, 2003 Wallkill Soccer Tournament. I brought my father-in-law who is handicapped to watch my son play soccer. Both of these fine men drove my father-in-law to the respective fields where my son was playing in their golf carts allowing him the easy transportation to the fields and eventually to the parking lot for the ride home.

I commend these men for their spirit of giving and support. Please place this letter in their personnel file and I thank you for their assistance.

Please find enclosed a letter dated 30 July 2003, from Columbia SJA, LLC, requiring a reduction in the performance bond for subject subdivision. Be advised that although the letter requested a reduction from $310,000.00 down to $30,000.00. the Town Board previously reduced the bonds being held in the amount of $190,000.00 and $410,000.00 respectively down to a single bond in the amount of $100,000.00 in April of 2001.

Please find our letter dated 23 March 2001, recommending a reduction in the bond down to $100,000.00. Several items of work needed to be completed which are also outlined in our letter of 23 March 2001, as received from your office. Please advise as to whether all the items of work have been completed to your satisfaction including any new issues and further recommend whether the bond in the amount of $30,000.00 is sufficient to guarantee the repairs of the asphalt and other miscellaneous items.

WHEREAS, Town Board of Wallkill wishes to adopt a local law to amend Chapter 249 of the Town Code of the Town of Wallkill to allow for certain maintenance and repair to residential buildings without the requirement of obtaining a building permit; and

WHEREAS, the Town Board of Wallkill is empowered by the State to adopt such local law pursuant to Municipal Home Rule law; and

WHEREAS, said zoning changes are listed as Type I Actions under §617.5 of the State Environmental Quality review Act (SEQRA); and

WHEREAS, in compliance with SEQRA, the Wallkill Town Board wishes to assume lead agency status and set a time and place for a public hearing for said proposed local law, so that the public may be heard; now

THEREFORE, IT IS HEREBY RESOLVED that a public hearing be held by the Town Board with respect to the adoption of the aforesaid Local Law at 7:15 PM on September 25, 2003, at Wallkill Town Hall, 600 Route 211 East, Middletown, New York; and it is further

RESOLVED that the Town Clerk is hereby authorized and directed to cause public notice of said hearing to be given as provided by law.
