The Town Board of the Town of Wallkill held a public hearing on September 25, 2003 at 7:10 PM at the Town Hall, 600 Route 211 East, Middletown, NY. Present were Supervisor Ward, Councilman Valentin, Councilman King, Councilman McLean and Councilman Depew. Also present were Ed. Smith, Superintendent of Water and Sewer, Robert Hertman, Chief of Police, John Lippert, Superintendent of Public Works, Spencer McLaughlin, Attorney for the Town and Louisa Ingrassia, Deputy Town Clerk.

MS. INGRASSIA: Please take notice that a public hearing will be held by the Town Board of the Town of Wallkill on September 25, 2003, at 7:10 PM at Town Hall regarding the adoption of a Local Law of the Town of Wallkill for the year 2003, which would amend the Zoning Code to allow for two foot minimum setback from adjacent property lines for sheds in R-1 and R-2 Zoning Districts.

Any resident of the Town of Wallkill is entitled to be heard upon said proposed Local Law at such public hearing. Copies of said proposed Local Law are available for review at Town of Wallkill Town Hall, 600 Route 211 East, Middletown, NY 10940.

Please take further notice that the environmental significance of the proposed Local Law will be reviewed at said public hearing.

Smith, Superintendent of Water and Sewer, Robert Hertman, Chief of Police, John Lippert, Superintendent of Public Works, Spencer McLaughlin, Attorney for the Town and Louisa Ingrassia, Deputy Town Clerk.

MS. INGRASSIA: Please take notice that a public hearing will be held by the Town Board of the Town of Wallkill on September 25, 2003 at 7:15 PM at Town Hall regarding the adoption of a Local Law of the Town of Wallkill for the year 2003, which would amend the Zoning Code to exempt certain repair and maintenance activities from the requirement of a building permit.

Any resident of the Town of Wallkill is entitled to be heard upon said proposed Local Law at such public hearing. Copies of said proposed Local Law are available for review at Town of Wallkill Town Hall, 600 Route 211 East, Middletown, NY 10940.

Please take further notice that the environmental significance of the proposed Local Law will be reviewed at said public hearing.

I request authorization to receive bids on November 25, 2003 at 2PM to furnish a water meter Data Collector System. The components of the system are five (5) handheld data collectors, five cradle kits, software and two (2) days of training. The estimated cost for the system is $30,618.75. This will allow us to dispatch meter readers who will enter readings in the collector. At the end of the day, the collectors will be returned to Town Hall where the data will be automatically downloaded and a bill will be generated for each account.

Re: PO Kelly Scheuering
Sgt. Tony Spano

We are writing to inform you of the outstanding efforts of your two officers, PO Scheuering and Sgt. Spano. These individuals have gone above their call of duty on September 1 and September 2, 2003 when they responded to cardiac arrest calls on these two days.

These officers arrived quickly to the scene and became actively engaged in resuscitation efforts. On the later date, the patient did regain his pulse at the scene. Chances of survival increase greatly with the quick response and treatment of your officers.

We would like to offer our sincere appreciation to these officers and your department. We rely on your assistance and cooperation at all scenes.

Please include a copy of this letter in the fore mentioned officers' files.

The Orange County Legislature on August 8, 2003 unanimously passed a resolution authorizing you to sign a contract with Middletown and Wallkill officials to expand Maple Hill Park. It is vitally important that the people of Orange County be able to utilize these surplus county owned properties. It would be disappointing to the people of Middletown, Wallkill and Orange County of this project is delayed any further.

Please convene with the parties involved as soon as possible and inform me of the scheduled dates so that I may participate in concluding this project.

I just wanted to follow up with the correspondence sent to you from my office yesterday, 9/17/03.

As I indicated in that correspondence, the TOW Youth Soccer and the Pine Bush Athletic Department have a history of cooperation in servicing the soccer needs of both organizations. In spite of the oversight on my part, regarding formally requesting the use of the soccer fields, I hope the positive relationship we enjoyed in the past will continue. I have been the athletic director in Pine Bush for seven years and in each of those years we have used the fields without writing for permission. Due to this past practice, it did not dawn on me that a written request was necessary for our use of the fields this year.

I'm sure you are aware that a formal request was made for the use of the tennis courts, and TOW golf course. We have always requested the use of the golf course through a formal communique. This is the first year we used the tennis courts in quite some time and again made a formal request after calling your office regarding the use of the tennis courts.

My oversight should not cast a negative reflection on anyone in your organization. The oversight was fully my responsibility. Please extend to Mr. Eric Valentin and anyone else who might have been caught up in my oversight, an apology for not notifying the Parks and Recreation Office or following required procedure.

Again, the problem was caused by my oversight. I fully apologize and Pine Bush needs to avail itself of the TOW field, you can rest assured, you will receive a letter from my office and notification will be made to the appropriate individuals.

Re: Belmont Park

I have received a price quote for installation of a metal pavilion at Belmont Park, replacing the existing bath house. The new structure would be all painted metal and occupy the same footprint as the bath house. Lounsbury Builders will provide labor and materials to furnish and install the structure at a cost of $13,272. This does not include demolition of the existing building, which they can do for an additional $3500, including removal of material.

There will be an additional expense due to the fact that the existing building houses the electric service for the water pumps, aerators, etc. Rotolo is estimating the cost for a remedy for this which would probably involve relocation of the electric utilities to a tamper proof vault setup. Similarly the water service would be shut off or relocated and may incur additional expense.

I have recently received a flier regarding the training of management personnel in Drug & Alcohol Supervisory Training and Management Training for proscription/ over the counter drugs and New MIS Reports to take place in Orange County on Friday, October 10, 2003. There is no cost to attend this seminar.

It is a full day session starting at 9:00 AM and ending at 3:00 PM. I am asking for permission to attend the seminar on that day and to be paid for the hours in attendance.

My name is Ted Henderson and I reside at 180 Derby Road, Middletown, I am writing in reference to be given permission for a temporary relocation of my pre-existing home. We would like to relocate the trailer to the right rear portion of my property while our new modular is being constructed. The excavator and builder has already assessed the property and determined that relocating it to the rear of the property would be out of the way and easy to remove without causing any problem. It will be removed within six weeks from the time we get the CO to move in. I would greatly appreciate you granting my request for the temporary relocation of our trailer during this construction phase.

I spoke to Dr. Kumar at Eustance and Horowitz this morning. Dr. Kumar has prepared bid documents and specifications for the Woodlawn Acres drainage and pavement improvements.

Please read a resolution at the next Town Board meeting allowing the Commissioner of Public Works to advertise for bid and enter into a contract with the lowest responsible bidder. It is our hope to expedite this project in anticipation of conducive weather.

Re: Circleville Park Resolution

Enclosed please find the estimate from Robert Hanson, Design Architect, to complete the stone paver entranceway, crosswalks, sidewalks and two double freestanding retaining walls at Circleville Park.

The initial estimate is approximately $38,000.00 and will require a formal bid. Your authorization is hereby requested to advertise and solicit bids for the stone work. With your approval, we will solicit bids as soon as the bid documents are complete. Your authorization is also requested to allow the Commissioner of Public Works to award the bid to the lowest responsible bidder. We hope to have these improvements completed before the onset of winter weather.
