Silver Lake Dead Ends
I
spoke to Dave Knapp at Eustance and Horowitz this morning.
Dave has prepared bid documents and specifications for
the Silver Lake Dead Ends Community Development block Grant
drainage and pavement. Once the bid documents are approved
by Joanne Fazzino from the Office of Community Development,
we will be ready to solicit bids. I would recommend advertising
the bid on October 3, 2003, with the bid opening scheduled
for 2:00 PM on October 17th.
If
you agree, please read a resolution at the next Town Board
meeting allowing the Commissioner of Public Works to advertise
for bid and enter into a contract with the lowest responsible
bidder. Our hope is to complete this project before the
onset of winter weather.
If
you have any questions, please give me a call. Thank you

RESOLUTIONS
WHEREAS,
heretofore the 2004 special assessment roll has been filed
with the Town Clerk, and
WHEREAS,
Town law requires that after the roll is filed with the
Town Clerk that the Town Board hold a public hearing on
that roll for each special district where charges are raised
on a benefit basis and that notice of the public hearing
be published in the official newspaper of the Town, and
WHEREAS,
a New York Court of Appeals case now requires that notice
of the hearing be mailed to all affected property owners,
now
THEREFORE,
BE IT RESOLVED as follows that the Town Board hereby sets
the public hearing on the new special assessment roll for
each special district where charges are raised on a benefit
basis for October 23, 2003 at 7:25 PM at Town Hall, 600
Route 211 East, Middletown, New York and instructs the
Town Clerk to publish the annexed notice of public hearing
in the official newspaper of the Town and that notice of
the public hearing be mailed to all affected property owners.

WHEREAS, a flooding condition exists during times of heavy precipitation events
in the vicinity of Silver Lake Scotchtown Road; and
WHEREAS,
it has been determined that said flooding condition is
the result of improper drainage infrastructure on Town
property and/or easement; and
WHEREAS,
the Town has a responsibility to its residents to insure
that public access and appurtenant private properties are
free from the hazards of flooding as a result of Town drainage
infrastructure; now
THEREFORE,
BE IT HEREBY RESOLVED, that the Town Board of the Town
of Wallkill hereby directs that said improper drainage
condition be corrected by Town Department of public Works;
and
RESOLVED,
that the Town Board authorizes no more than $9,000 from
the Highway budget to effect said repair.

with Orange & Rockland Utilities for the installation of two fiberglass

on Patio Road at a cost to the Town not to exceed $3,600.

of the use of exclusive street names within the Town for purposes of
efficient dispatch in times of emergency; and
WHEREAS,
the Orange County E-911 system requires exclusivity of
street names within a municipality for efficient dispatch;
and
WHEREAS,
there exists within the Town's Fourth Ward a Beakes Avenue,
a Beakes Street, and a Beakes Road;
THEREFORE
BE IT RESOLVED by the Town Board of the Town of Wallkill,
that the previous resolution adopted and ordered by this
Town Board on September 11, 2003, be amended to effect
the name changes as contained herein; and
THEREFORE
BE IT RESOLVED, that the street known as "Beakes Road" is
hereby changed to "Barra Road", and
RESOLVED,
that all street signs, maps, and relevant allusions within
the Town from here on after be amended according to this
change.

efficiency of Town Sewerage Treatment Plant; and
WHEREAS,
there exists a sewer infrastructure problem in the general
vicinity of Johns and Elizabeth Roads; and
WHEREAS,
the Sewer and Water Superintendent has determined that
said condition can be ameliorated with certain infrastructure
improvements; and
WHEREAS,
it has been determined that said improvements will require
the transfer of funds from the Sewer Reserve Budget to
the Sewer Collection Budget;
THEREFORE
BE IT RESOLVED by the Town Board of the Town of Wallkill
that said Town Board hereby authorizes the Town of Wallkill
Sewer and Water Superintendent to cause to be made all
repairs and improvements of the sewer collection system
on the vicinity of Johns and Elizabeth Roads; and
FURTHER
that a transfer of not more than $275,000 from the Sewer
Reserve Budget to the Sewer Collection Budget is hereby
authorized for the purpose of the execution of said sewer
repairs and improvements.

WHEREAS, Town Board of Wallkill wishes to adopt a Local Law to amend Chapter
249 of the Town Code of the Town of Wallkill to correct certain inconsistencies
in the Zoning Code regarding lot width and lot depth in R-A zoned properties;
and
WHEREAS,
the Town Board of Wallkill is empowered by the State to
adopt such local law pursuant to Municipal Home Rule Law;
and
WHEREAS,
said zoning changes are listed as Type I Actions under §617.5
of the Stae Environmental Quality Review Act (SEQRA); and
WHEREAS,
in compliance with SEQRA, the Wallkill Town Board wishes
to assume lead agency and set a time and place for a public
hearing for said proposed local law, so that the public
may be heard; now
THEREFORE
BE IT RESOLVED, that public hearing be held by the Town
Board with respect to the adoption of the aforesaid Local
Law at 7:20 PM on October 23, 2003, at Wallkill Town Hall,
600 Route 211 East, Middletown, New York; and it is

WHEREAS, the Town Board of the Town of Wallkill, as a result of an arbitration
between the Civil Service Employees Association on behalf of one of its
members and the Town of Wallkill, has received notice of Consent Award
by the arbitrator; and
WHEREAS,
the Town Board wishes to accept the terms of said award,
as being in the best interest of the residents of the Town
of Wallkill; now
THEREFORE
BE IT RESOLVED by the Town Board of the Town of Wallkill,
that said Town Board hereby creates the position of Heavy
Equipment Operator II (hereinafter HEO II) at the Department
of Public Works and hereby appoints Stephen Lercara, currently
holding an HEO I position in said Department, to the position
of HEO II, effective immediately; and
FURTHER
RESOLVED that Stephen Lercara shall be paid retroactively
for the period May 1, 2003, through September 24, 2003,
the difference between the rates of pay for the HEO II
and the HEO I positions for each day he did not receive
HEO II pay.

KING: sewer tests are being done; Master Plan meeting November
6th at Town Hall and it will be televised.
ED.
SMITH: second reading is being done today; will decide
next week if enough data has been collected
COUNCILMAN
VALENTIN: contractor is donating his service to work on
soccer field; won't mention his name, not sure if he wants
to be known. Two new police officers sworn in; 18 full
time officers. Leaf collection will be November 1st through
December 1st. Regarding golf financials- weather has affected
income. Other area courses have revenues down too.
COUNCILMAN
McLEAN: contract negotiations in final stages; final draft
will be presented next week. Human rights commission has
four active members, would like volunteers.
COUNCILMAN
DEPEW: accept Nancy Wilson's resignation from Master Plan
review. Good work of P.O. Scheuering and Sgt. Spano who
helped save a life; there is a situation with cars being
vandalized in Pocatello area; just wanted residents to
know. Thanks to park workers; great job on the soccer fields.
