The Town Board of the Town of Wallkill held a regular meeting
on October 10, 2002 at Town Hall, 600 Route 211 East, Middletown,
NY at 7:30 PM. Board members present were Supervisor Ward,
Councilman Valentin, Councilman King, Councilman McLean and
Councilman Depew. Also present were Louisa Ingrassia, Deputy
Town Clerk and Spencer MacLaughlin, Attorney for the Town.

New York Public Transit Association Conference
From
November 13-15, 2002, the New York Public Transit Association
is holding their 2002 Fall Training Conference and Expo in Saratoga
Springs, NY. A copy of the agenda is attached for your reference
where I have highlighted the sessions in which I am particularly
interested.
Realizing
that I was permitted to attend the CTAV Conference in Virginia
in August which gave me wonderful insight into Customer Service,
this conference is focusing more on updates of new legislation
and trends, new technology, and funding discussions and workshops.
Also, at the Expo portion, there will be exhibitors with computer
software in a hands-on situation which is precisely what I have
been looking for and did not find in Virginia.
For
the reasons stated, I am asking permission to please attend
this conference. Since the workshops on Wednesday, November
13, have little interest to me, I could leave after working
that day and arrive in Saratoga late that afternoon or evening.

knowledge,
RTAP funds will be available to cover all costs except my salary.
I am asking that the Town pay me for the two days that I will
be attending the Conference.
The
registration cost is significantly increased after October 18,
2002. Therefore, kindly inform me of the approval as soon as
possible so that I am able to procure a check from Phil Saler
for the registration fee (to be refunded by RTAP funds).

and two Duplicate Originals) in connection with the 2002-2003
Legislative appropriations to provide financial assistance to
the Town of Wallkill/ Veteran’s Memorial Park.
Please
review the contract for accuracy.
Also,
please execute all three copies of the contract. Please note
that the signature of the person executing the contracts on
behalf of your organization must be notarized. The form for
acknowledgement by a Notary Public is attached to each contract.
Return
all three copies of the contracts to me. You will receive a
copy of the contract for your records when the contract has
been signed by the Director of Veterans’ Affairs and approved
by the Attorney General and the State Comptroller. Our Administrative
Section will send the record copies to you, together with a
letter of instructions for filing vouchers to obtain payments

client wished to have the zoning changed from a zone which
allows moderate income apartments with Bonus Density to a
zone that will allow condominiums. R1 zone would allow this
and would be in accordance, we believe, with proper planning.

George Pataki has declared the week of October 28- November
1, 2002 to be School Board Recognition Week. This is the
eleventh year this event has been celebrated.
Governor
Pataki designated this special week to commend school board
members for their dedicated service to the children of New
York State, and he is inviting you to join him in demonstrating
your appreciation of these outstanding individuals. Over
these past eleven years, the Association has noted that more
and more school districts have chosen to celebrate this occasion.
WHEREAS,
each year, School Board Recognition Week is observed by the
more than 70 school boards in school districts throughout
the Empire State; and
WHEREAS,
the men and women serving as members of school boards are
dedicated to children, learning and community; they devote
many hours of service to elementary and secondary public education
and continually strive for improvement, excellence and progress
in education; and
WHEREAS,
the members of the School Boards in the Town of Wallkill (Middletown,
Pine Bush, Valley Central, Goshen and Minisink) school boards
are community leaders who provide an invaluable resource as
local decision makers; they not only respond to the respective
educational needs of their communities, but also serve the
best interests of school children and help prepare them for
the future; and
WHEREAS,
during the week of October 28 to November 1, 2002, special
activities and programs will be held throughout the Empire
State in conjunction with this observance; it is fitting to
join in recognition of the commitment and contributions of

were received and opened on Monday, October 7, 2002 at 2:00
PM to supply and install the required equipment to flow pace
the return activated sludge pumps at the wastewater treatment
facility. Two bids were received, in the amount of $64,900.00
and $129,496.00.
I
have reviewed the low bid with the Town’s consultant (Gerard
Associates) and we have found it acceptable. Therefore, I recommend
you accept the low bid of $64,900.00 as submitted by Boz Electric,
306 Route 94, Vernon, NJ 07462.

The
Wastewater Treatment Facility has two secondary clarifiers that
are equipped with scrapers for the removal of scum and grease.
The original design is not structurally sound and often in the
winter months the scraper arm bends or breaks off. In 2000,
we replaced the scraper in clarifier #2 with one that works
much more effectively.
At
this time, I respectfully request permission to replace the
scraper mechanism in clarifier #1 at an estimated cost of $85,000.00.
I would like to receive and open bids at 11:30 AM on November
6, 2002. Money for this project was budgeted in the 2002 budget
under account number SS18130.200.

you know, Malcolm Pirnie recently submitted the Wastewater Treatment
Plant Process Assistance Summary report on our behalf to the
New York State Department of Environmental Conservation. One
of the recommendations of the report is to develop a more extensive
industrial pretreatment program than what currently exists.
Enclosed
is a proposal from Malcolm Pirnie to establish a pretreatment
program at a cost not to exceed $65,000.00. I recommend that
you accept this proposal.

Department of Public Works, Employee of the Month
Please
join us in recognizing Ronnie Fello as the Department of Public
Works Employee of the Month for September 2002. Ronnie was
selected for this honor after recently completing supervision
of the Town’s annual pavement management program. As
you know, Ronnie always displays a high level of enthusiasm
and motivation, and these traits helped him and his crew efficiently
prepare and complete the vast majority of our 2002 pavement
improvements.
Ronnie’s
high-energy work ethic is a real asset to the Town, and we thank
you in helping us recognize him with our Employee of the Month
award.
RESOLUTIONS:
WHEREAS,
heretofore the Town of Wallkill has instituted a proceeding
against John I. McCarey and Winifred McCarey (“McCarey”)
to acquire an easement through McCarey property located on East
Main Street, and
WHEREAS,
the town was successful in securing the property on April 15,
2001 filed a copy of an appropriation map together with a description
in the Orange County Clerk’s Office, and
WHEREAS,
McCarey filed a claim seeking the payment of money damages from
the Town, and
WHEREAS,
the parties have negotiated a proposed settlement subject to
the approval of the Town Board,
BE
IT RESOLVED, as follows, that the town Board does hereby authorize
the settlement of the McCarey claim for damages by payment of
$24,500.00 and authorizes the Supervisor to execute such documents
as may be necessary to effectuate the settlement.

WHEREAS,
petition has been made to the Town of Wallkill for the establishment
of a lighting district in the proposed subdivision known as
Oak Hill Manor in the Town of Wallkill, and
WHEREAS,
said petition has been deemed sufficient by this Board; and
WHEREAS,
the Town Board of the Town of Wallkill is empowered by the
State under NYS Town Law §194 to establish special lighting
districts in the Town that it determines to be in the best
interests of the public welfare of its citizens; and
WHEREAS,
this board has determined that all property and property owners
within the proposed district will be benefited thereby; and
WHEREAS,
this board did hold a public hearing regarding the establishment
of a lighting district within Oak Hill Manor on July 25, 2002
at the Town Hall, 600 Route 211 East, Middletown, NY 10940;
and
WHEREAS,
said establishment of lighting districts has been determined
to be a type II action under the State Environmental Quality
Review Act (SEQRA) criteria as so determined by Town Board resolution
dated September 26, 2002;
THEREFORE,
BE IT RESOLVED, as follows:
1. That the Wallkill Town Board
hereby establishes a lighting district in the proposed subdivision
known as Oak Hill Manor, and
2. That the Town Clerk be directed
to file a certified copy of this resolution with the office
of the state department of audit and control at Albany, NY,
together all appropriate papers with appropriate signatures
where needed; and
3. All boards, agencies, departments
and contracted professionals of the Town of Wallkill are hereby
authorized and directed to effect or otherwise facilitate the
implementation of said district.
