The Town Board of the Town of Wallkill held a public hearing on October 23, 2003 at 7:10 PM at the Town Hall, 600 Route 211 East, Middletown, NY. Present were Supervisor Ward, Councilman Valentin, Councilman King, Councilman McLean and Councilman Depew. Also present were Ed. Smith, Superintendent of Water and Sewer, George Tyndall, Deputy Chief of Police, John Lippert, Superintendent of Public Works, Phil Saler, Senior Accountant, Gary Greenwald, Attorney for the Town and Louisa Ingrassia, Deputy Town Clerk.

MS. INGRASSIA: Please take notice that the Preliminary Budget for the Town of Wallkill for the fiscal year beginning January 1, 2004 has been completed and filed in the office of the Town Clerk, 600 Route 211 East, Middletown, NY where it is available for inspection. Pursuant to Section 108 of Town law the proposed salaries of the following officers are hereby specified:

Supervisor - $51,980.00
Town Clerk - $42,911.00
Town Council (4) - $10,612.00 each
Justices (2) - $28,517.00 each
Receiver of Taxes - $17,895.00

A public hearing on the proposed budget for the fiscal year beginning January 1, 2001 will be held October 23, 2003 at 7:00 PM at the Town Hall, 600 Route 211 East, Middletown, NY. All persons in interest will be heard at the above time and place.

Present were Supervisor Ward, Councilman Valentin, Councilman King, Councilman McLean and Councilman Depew. Also present were Ed. Smith, Superintendent of Water and Sewer, George Tyndall, Deputy Chief of Police, John Lippert, Superintendent of Public Works, Gary Greenwald, Attorney for the Town and Louisa Ingrassia, Deputy Town Clerk.

MS. INGRASSIA: Please take notice that a public hearing will be held by the Town Board of the Town of Wallkill on October 23, 2003 at 7:20 PM at the Town Hall regarding the adoption of a Local Law of the Town of Wallkill for the year 2003, which would amend the Zoning Code to correct certain inconsistencies regarding lot width and lot depth in R-A zoned properties.

Any resident of the Town of Wallkill is entitled to be heard upon said proposed Local Law at such public hearing. Copies of said proposed Local Law are available for review at Wallkill Town Hall, 600 Route 211 East, Middletown, NY 10940

Please take further notice that the environmental significance of the proposed Local Law will be reviewed at said public hearing.

From: Barry J. Short, Orange & Rockland Community Relations Manager

To reduce the number of potential power outages caused by fallen trees or broken branches, Orange & Rockland periodically performs tree maintenance along our electric transmission right-of-way. This task is critically important to help insure electric service reliability for both our residential and business customers.

Transmission lines carry electricity from generating plants to, and between, electric substation facilities. These are not the same lines that run along streets and supply power to individual homes and businesses. Thousands of people may depend on the energy of a single transmission line. A transmission line outage will threaten those on life-support equipment, eliminate electronic security and fire protection systems, and turn off traffic signals and street lights.

We'll soon be conducting such work in the Town of Wallkill, and I want to keep you and your constituents fully informed of our planned activities.

A forester carefully reviews each project and notifies homeowners/ businesses along the transmission right-of-way to fully describe what work will be done. Professional contractors will then conduct the necessary tree trimming and selective tree removal. Low growing compatible trees are left untouched as a means of discouraging the regrowth of tall non-compatible species. A Public Service Commission representative visits our work sites to review planned work and inspect work already completed.

Beginning on or about October 22, 2003, and continuing for about four weeks, we'll perform tree maintenance within our right-of-way located near the following streets: County Route 78. Asplundh Tree Experts have been contracted for this project.

We will of course, notify you immediately if this schedule changes or if additional work is necessary.

Re: Marie Lane Zone Change Request

An Informational Public Hearing of the Planning Board was held on October 16, 2003 for Mr. Cappeluzzo for a zone change from MI to RA located on Marie Lane (81-2-1.1 and 81-2-1.2)

The Planning Board reviewed the zone change request and recommends approval of the zone change.

Re: Stony Ford Road Zone Change Request

An Informational Public Hearing of the Planning Board was held on October 16, 2003 for Ms. Irene Zeffiro for a zone change from MI to RA located on Stony Ford Road (69-1-39.22).

The Planning Board reviewed the zone change request and agreed the parcel is not contiguous with the RA Zone therefore creating spot zoning. The Planning Board agreed that it is not within their jurisdiction to either approve or disapprove this request.

The Circleville Kids on the Block 4-H Club has, with the help of Bill Philips of the parks Department, planted the entrance to the Circleville Park on Route 302. The club met on May 16th and planted the spring flowers provided by the Parks Department. We planted thirty mums for the fall.

The club photographed our work in progress and used this information for our community service project submitted to the Orange County Fair. We received a blue ribbon award at the County Fair and went to the NY State Fair where we won another blue ribbon award. We took pictures again of our fall planting project for future community service documentation.

As the coordinating leader for the 4-H Club, I am inquiring as to a letter of recognition for the work done by the members. The letter can be sent to: Lauren Sperling, Circleville Kids on the Block 4-H Club, 8 Baldwin Hill Road.

Thank you in advance for your attention to this matter. The kids would also like to display our planting posters at Town Hall for a club marketing project.

Re: Circleville Park Entrance Bids

I have reviewed three bids for the entrance way work at Circleville Park. Listed below are the summaries reflecting the bid amounts:

Maples- lowest bidder $29,950.00
McCarey landscaping- highest $43,502.20
Luzon landscaping- lowest responsible bidder $30,350.00

I am recommending Luzon Wildflower Landscaping for this bid award. They have submitted the bid documents properly and reference checks have been favorable. They have completed projects for the Orange County Parks and others. They have also indicated that they can start work within one week of the award and complete the project in ten days less time than the other bidders. They are the lowest responsible bidder.
The lowest bidder, Maples Farm, did not include a certified check for the proper amount and failed to properly complete the bid forms, therefore necessitating rejection of the bid.

RESOLUTIONS

WHEREAS, Town Board of Wallkill wishes to set maximum and minimum fees allowed to be charged for the collection of residential garbage in the Town of Wallkill; and

WHEREAS, the Town Board of Wallkill is empowered by Section 200-12A of the Town Code to set such fees by resolution; and

WHEREAS, although not required, the Town Board wishes to give the public an opportunity to be heard regarding the setting of such fees, setting a time and place for a public hearing for said proposed resolution, so that the public may be heard; now

THEREFORE, it is hereby RESOLVED, that a public hearing be held by the Town Board with respect to the adoption of the aforesaid Resolution at 7:25 PM on November 13, 2003, at Wallkill Town Hall, 600 Route 211 East, Middletown, NY; and it is further

RESOLVED, that the Town Clerk is hereby authorized and directed to cause public notice of said hearing to be given as provided by law.

BE IT HEREBY RESOLVED by the Town Board of the Town of Wallkill that the Town of Wallkill Town Board hereby directs that no parking zone be established on both sides of Mud Mills Road form Bisch Road to maples Road and on Maples Road between Mud Mills Road and to the point on maples that crosses over the Metro North Railroad tracks; and that said zone shall not include the parking of responding emergency vehicles.

COUNCILMAN KING: Water & Sewer meeting at 2:45, Monday with Mr. Depew. Nov. 6th, Master Plan presentation at 7:30PM

COUNCILMAN VALENTIN: Halloween activities at the golf course; soccer showcase- Girls Nov. 8 & 9, Boys Nov. 15 & 16. Entrance will be completed in three weeks. Basketball will be at Circleville elementary; thanks to M. Habeck. There will be extra police out for Halloween. Police meeting will be Wed., Oct. 29th at 6PM with Chief regarding the Pine Bush High School. Leaf pickup Oct. 30th - Nov. 30th; thanks to Ted Youngs for cleanup work

COUNCILMAN McLEAN: contract is almost done; Oct. 29th is the meeting to ratify contract.

COUNCILMAN DEPEW: thanks to Deputy Chief for speeding concerns on Keasel & Derby Roads. Boy scouts fly fishing on going. Thanks to EMS volunteers in chlorine leak response. Howells Ladies Auxiliary set up coffee for displaced residents. Code enforcement is looking at Ben Lomond mess.

SUPERVISOR WARD: next Thursday the Town Board will vote on the budget and the contract. Payments from Pyramid for school taxes (Middletown & Goshen) was received. The Town saved $13,191.86 by changing electric companies. Working on Building permit refunds; will sign vouchers when law has been filed with the state.

CHIEF HERTMAN: Police Officer exam will be on Dec. 6, 2003. Police will be at the Halloween festivities; distributed 40 gunlocks so far.

ED. SMITH: no comment

MR. LIPPERT: leaf pick up Nov. 1-30, can be in bags. Final delivery of new truck and plow.
