A review of the bids indicated that the apparent low bidder did not a bid bond and a portion of the work was not included in the bid. For these reasons, I recommend that you disqualify the bid submitted by EIMCO Process Equipment and that you accept the bid in the amount of $83,995.00 as submitted by Envirodyne Systems, 50 Utley Drive, Camp Hill, Pennsylvania.

The original estimate for this project was $85,000.00. These monies are in the 2002 sewer budget in account SS181130.200.

I have received your letter of October 25, 2002 and I am again asking for your assistance. Please take the time to reconsider my request.

I am enclosing a preliminary site plan via Mr. John King, for your consideration.

You may find the following language helpful in granting this.

The Town of Wallkill here-by grants a “Temporary permit” to Mr. James R. Barnett and his tenant under Town Code 249-28 sub 19, “Outdoor storage of building supplies, raw materials or equipment”, to be used as a “Contractors equipment and materials yard” for a period of time not to exceed 6 months with the following conditions:
A. Barnett/Tenant shall make application to the planning board within 15 days of this permit.
B. Barnett/Tenant shall comply with all town codes.
C. Barnett/Tenant shall proceed directly to the planning board with an adequate site plan as per town requirements for consideration by the planning board, within 45 days of this permit.
D. Barnett/Tenant shall upon the expiration date of this permit, any violation of this permit or rejection from the panning board, vacate said premise within 30 days of official notice from the Town of Wallkill.

RESOLVED, that the delinquent water statements submitted to the town Board by the Town Clerk from the Water Department pursuant to Town Law Sec. 198-3 (d) shall Be filed with the Orange County Legislature by the Supervisor so that the County Legislature shall levy such sums against the property which is liable for said delinquent water statements and shall state the amount of the tax in a separate column in the annual tax rolls for the year 2003, and it is further

RESOLVED, that a copy of this resolution with the delinquent water statements shall be immediately transmitted to the Clerk of the orange County Legislature for immediate action.

Total amount to be collected $340,775.14.

WHEREAS, heretofore the Town Board has determined to hold a special election on December 9, 2002, and

WHEREAS, in connection with the special election the Town Board must select election inspectors and ballot clerks from the list of election inspectors and ballot clerks previously designated for general elections, and

WHEREAS, the Town Board has determined that there will be two dates for personal registration, and

WHEREAS, the Town Board has determined further that the twelve polling places within the Town will be open for personal registration and for voting, and

WHEREAS, the Town Board has determined further that there will be two election inspectors and ballot clerks at each polling place, now

THEREFORE, BE IT RESOLVED as follows:

R-A. Rural Agricultural of the Town Code, and

WHEREAS, notice of said public hearing was duly advertised in Times Herald Record, the official newspaper of said Town, on October 13, 2002, and

WHEREAS, said public hearing was duly held on October 24, 2002, at 7:15 P.M. at Wallkill Town Hall, 600 Route 211 East, Middletown, NY and all parties in attendance were permitted an opportunity to speak on behalf or in opposition to said Proposed Local Law, or any part thereof, and

WHEREAS, pursuant to part 617 of the implementing regulations pertaining to article 8 State Environmental Quality Review Act (SEQRA) it has been determined by the Town Board of said Town that adoption of said proposed Local Law would not have a significant effect upon the environment and could be processed by other applicable governmental agencies without further regard to SEQRA, and

WHEREAS, the Town Board of the Town of Wallkill, after due deliberation, finds it in the best interest of said Town to adopt said Local Law; now, therefore,
