The Town Board of the Town of Wallkill held a regular meeting at the Town Hall, 600 Route 211 East, on Thursday, March 28, 2002 at 7:30 PM. Board members present were Supervisor Ward, Councilman McLean, Councilman King, Councilman Depew and Councilman Valentin. Also present was Jeanne Gervasi, Town Clerk and Spencer McLaughlin, Attorney for Town.

SUPERVISOR WARD: Good evening ladies and gentlemen. First we will say the Pledge. I'd like to make a motion to accept the minutes of January 24, 2002 and February 14, 2002.

RE: Memorandum dated March 18, 2002

After discussion at the work session, Thursday March 21, 2002 and with the approval of the attending members of the Town Board, the following changes with direct reference to the memo dated March 18, 2002 subject "Town Board Meeting Procedures", concerning motions, resolutions or anything else that requires a vote of the board, will be implemented.

If something needs to be voted on at a public meeting, and it is on the agenda, and it has been discussed prior to the public meeting each councilperson will be asked publicly (1) so you have information and has been discussed enough to reach an informed decision and are you prepared to vote on the proposal/ resolution? If anyone's answer is no I can't vote, the proposal/ resolution will be tabled. The Supervisor will state publicly that Mr. (name) cannot vote because (reason) and the item will be tabled.

It is further agreed unanimously by the Supervisor and those Councilmen present at this work session that a tabled subject will be tabled only for two weeks, or the next Town Board Meeting only, to allow sufficient time for those members to gather and understand all the information needed to make an informed decision. At that time a vote will be cast.

I sincerely hope this makes a clearer understanding of the Voting and Motion procedures so that the governing body of the Town of Wallkill can do business in a more orderly fashion.

RE: Westwood Industries


March 28, 2002

John:

Mr. Steenrod came into the office this morning to let me know the outcome with Westwood Industries.

The noise that everyone has been complaining about is a scrubber machine. The manufacturer has been contacted and the will be putting a muffler system on the machine to cut down on the excessive noise. This will take about six (6) weeks, until then the machine will not be run in the evening and will only be run during the day when absolutely necessary.

Dear Supervisor Ward:

Last summer I was approached by Mike Cody in connection with planting some flowers at the Veteran Park at the corner of North Street and Highland Ave. Extension. I told him I would bring the matter up before the Garden Lovers Club and we would also advise him. At its meeting on March 19, 2002, the Club agreed that our Civic Beautification Committee could undertake that project.

In the interim, Margaret Dickover who is leader of Junior Girl Scout Troop # 393 contacted me. Margaret has two girls that are working on their bronze award, Mary Kate Dickover and Jenna McCarey. One of the prerequisites for obtaining that medal is undertaking a civic duty. Mary Kate would like to plant flowers at the park and Jenna would like to make a display in memory of "September 11th". I am also advised that Everett (Ace) Jones would like to involve his Boy Scout troop.

Our Civic Beautification Committee will be meeting with Mike Cody, Margaret Dickover and Ace Jones on March 30, 2002 at 1:30 P.M. to view the park and discuss a plan of action. We certainly would welcome you and/or a member of the Town Board to attend as well.

We would like approval from the Town to proceed with this undertaking. Please advise as soon as possible as we must put our plan in order prior to the coming growing season. If you have further questions, I can be reached at 342-3622.

Dear John:

Orange County Government has been working with our emergency services and government officials to make sure our County is prepared for the realistic possibility of a terrorist event. We have been working closely with Governor Pataki's Office, the New York State Office of Public Security and the Zone Four Counter Terrorism Committee made up of Orange, Rockland and Sullivan Counties Sheriffs, State Police and Police Chiefs to develop a law enforcement procedure and mutual aid protocol for dealing with these events. For the safety of all our residents, I ask that your emergency managers and police departments work together with you to help prepare your community.

To accomplish our common goal, I am asking for the full cooperation of all our County's municipalities. I am request that you please send a member of your law enforcement department to the meetings of the Counter Terrorism Committee. Within the next 12 months numerous police training opportunities will be offered. I ask that you make your police officers available to attend these important sessions.

All local police agencies have been sent a list of vulnerable assets and facilities. I ask that you and your police departments please review this list. Feel free to make changes and additions, as your local departments are more familiar with your area. I have also attached a copy of Presidential Directive 3, which outlines the Homeland Security threat levels...please review.

I thank you and your departments for your cooperation in this matter of utmost importance. I know that you join with me in our commitment for the health and safety of all our residents.

As you may have heard we will be adding new programming to our channel line up. Effective March 26 we will be carrying YES (Yankees Entertainment and Sports Network) and WPXN. This will result in us having to move a couple of channels to new locations as follows:

Effective March 26
Channel 50 - YES
Channel 17 - WPXN (PAX affiliate)
Channel 61 - TV Guide

We continue to strive to provide quality entertainment and feel that YES and WPXN are examples of our commitment. We hope you enjoy these new additions and if you have any questions, please feel free to contact us.

RE: Virag Zone Change Request PID to RA- Goshen Turnpike Sect. 1, Bl. 1, Lot 35

The Planning Board held an Informational Public Hearing on March 20, 2002 for the above zone change request. It was determined to recommend to the Town Board that the zone change be denied by a vote of 2 Ayes, 2 Nays and 1 Abstained.

Resolutions:

Resolution of the Wallkill Town Board assuming lead agency status under State Environmental Quality Review Act (SEQRA) with respect to a change in zoning from R2 to PID in a certain area contained within the borders of the Town.

WHEREAS, the Town Board of Wallkill is empowered by the State to make changes in the zoning of the land use in the Town that it determines to be in the best interests of the public welfare of its citizens; and

WHEREAS, said zoning changes are listed as Type 1 Actions under §617.5 of the State Environmental Quality Review Act (SEQRA); and

WHEREAS, in compliance with SEQRA, the Wallkill Town Board wishes to assume lead agency status;

NOW THEREFORE BE IT RESOLVED, that the Wallkill Town Board declares itself Lead Agency concerning a change from R2 zoned property to a PID zoned designation for certain property in the Town of Wallkill and will send notice of said assumption to all involved agencies and conduct a coordinated review pursuant to 6 NYCRR Section 617.6

MOTION BY: Mr. Ward to hold Public Hearing on the Zone Change to be held April 11, 2002 at 7:15 PM.


RESOLVED, that the Town of Wallkill Little League be granted exclusive rights to all fields, at the future Town of Wallkill WTC Memorial Park from March 1, 2002 through September 15, 2002.

The Little League must provide to the Town of Wallkill a copy of liability insurance naming the Town of Wallkill as an additional insured.

WHEREAS, the Town of Wallkill is participating in the 911 emergency system, and

WHEREAS, it has been determined that streets in the Town with identical names will create confusion in responding to 911 calls.

NOW THEREFORE, the Town Board of the Town of Wallkill hereby determines the following:
1. The northern portion of Tarbell Road, from State Route 17 to Goshen Turnpike, shall be renamed Tarbell Road North.
2. The western portion of Shawangunk Road, from State Route 17 to State Route 17M, shall be renamed Shawangunk Road West.
3. The southern portion of Bart Bull Road from County Route 53 to the Consolidated railroad track be renamed to Bart Bull Road South.
4. The southern portion of York Road from Prosperous Valley Road to Dead End shall be renamed york Road South.
5. The southern portion of Midland Lake Road from Bisch Road to State Route 17 shall be renamed Midland Lake Road South.

These name changes shall take effect immediately.

COMMITTEE REPORTS:

Councilman King; Water and Sewer should interview engineers to help solve problem with sewer plant. Parks and Recreation- Poets Court Park will start work in late April; completed with playground equipment next year.

Councilman Valentin; remind people Easter Egg hunt at Circleville Park at 10 AM. Work is being done at the Little League field. Read following letter regarding Employee of the Month.

Dear Board Members:
We are pleased to announce that Glenn Benson has been selected as our February Employee of the Month in the Department of Public Works. Glenn was nominated by three (3) of his co-workers for his quick thinking and action he took to avoid a potentially serious accident. While flagging on Crystal Run Road, Glenn noticed a windblown drainage pipe rolling into traffic, and he jumped in front of the runaway pipe to keep it from hitting a car.

Please join us in recognizing Glenn for this award, and thanking him for his attentiveness and his dedicated service to the Town of Wallkill.

Also, Saturday is a work session. Mon., April 1st, the Police Chief will meet with residents from neighborhood watch.

Councilman McLean; discussed bus coordinator applications, assessment roll be filed by May 1. Grievance day is May 28th. Would like to have public meetings at DPW to discuss problems with work force.

SUPERVISOR WARD; position for bus coordinator must be Civil Service position; must go through the list before local applicants.

Councilman Depew; Highway Dept.- changing road speed limits, state mandate to raise limits on certain roads. Resolution from Assoc. of Towns to set own speed limits. Stop sign at Station Road- Highland Ave. Ext. near Maddy's diner.

Councilman King: Happy Easter and Passover; feels that the new Town procedures will help.

Councilman Valentin: Voting machines will be below Filene's with rent of $1.00 per year.

Councilman McLean: Homeowners meeting - Water's Edge with Supervisor & Chief at Meadow's on May 19, 2002, 7PM.

Councilman Depew: fishing season begins April 1st, asked residents to respect environment; town could create law to protect the Shawangunk Kill. Need to address problem of two Hill Roads in Town. Meeting - Pocatello FireHouse, april 15th at 7:30 PM. Happy holidays.

Supervisor Ward: Open door on Saturday- 8 AM to noon. Received check from Galleria - PILOT payment. Police Contract- Town gave proposal to PBA. Discussed expansion of Police Dept., Town Clerk, Acct. Dept., Parking & Animal Control to move into trailers. Looking into a building on Tower Drive. Annual report filed. Clean up front of building. Wishing happy Easter & Passover.

Chief Hertman: discussed drag racing at Caldor plaza. May 20- June 2 is Buckle-up Week; will start random checks for DWI's, August 16, 2002, Night Out Against Crime.

Ed Smith: needs water samples from 60 residents- prefer from houses built between 1983-1986. No hydrants will be flushed, no outside use of water- includes filling of pools, washing cars, etc. Town is not selling water to Village of Goshen.


PUBLIC PARTICIPATION:

Mike Cody; egg hunt, Memorial Day Parade- dedicate memorial Park, ask to close streets around park for 3 hours- 7 AM to 10 AM
