WHEREAS, on January 29, 2002, pursuant to consultation with Mr.
Charles Brodie, Aerodrome Development Corporation, an “ Off-
Airport Obstruction Removal in approach to Runway 8; Relocation/
Burying Above Ground Power Lines and Land

Donation
Credit of 0.96 Ac. Out of a Total of 61.75 Ac.” has
been undertaken by Randall Airport, Town of Wallkill, County
of Orange, State of New York by TriState Planning and Engineering
P.C. Consulting Engineers (TSPE), and submitted to the Federal
Aviation Administration who have issued a Federal Grant in the
amount of $135,000.00 (Federal Share) for the Project, Airport
Improvement Program (AIP) Project No. 3-36-0224-16-02
WHEREAS, such project and the improvements are necessary for
the operational safety and efficiency of the airport and does
not obligate the Town in any manner; and
WHEREAS, the improvements proposed under this Grant will not
effect the size and type of aircraft using the airport.
NOW, THEREFORE, BE IT RESOLVED, by the Town of Wallkill, County
of Orange, State of New York, as follows:
1. The Town recommends New York State Department of Transportation
funding assistance be granted in the amount of $7,500.00 (maximum
State Share payable- $8,625.00); State Contract: K550718/PIN
8909.15; to match appropriately the Federal Grant for the Project.
2. The Town of Wallkill shall send a certified copy of the resolution
to each of the following:
a. The Proprietor of Randall Airport
b. TriState Planning and Engineering
c. NYSDOT Aviation Services Bureau

WHEREAS, the Town Board of the Town of Wallkill is considering
the establishment of a water district to serve properties in
the Town located generally at the intersection of Route 17K
and Route 17, and

WHEREAS, it is necessary to develop a report from a hydrogeologic
consultant in order to prepare the necessary materials for the
Town to proceed pursuant to Article 12/ Article 12-A of the Town
Law to establish the district, and
WHEREAS, pursuant to Section 191-a/ Section 209-b of the Town
Law the Town Board by resolution subject to a permissive referendum
may appropriate certain funds in connection with the establishment
of a water district, and
WHEREAS, the Town Board adopted a resolution on the 7th day
of August, 2002 appropriating the sum of $200,000.00 for the
necessary hydrogeologic investigation in connection with the
preparation of the documents necessary to establish a water district,
and
WHEREAS, it now appears that an additional $61,000.00 will be
necessary to complete the hydrogeologic investigation,
NOW, THEREFORE, BE IT RESOLVED as follows:
1. That the Town Board, acting pursuant to the provisions of
Section 19a-a/ 209-b of the Town Law, does hereby appropriate
the additional sum of $61,000.00 for hydrogeologic investigation
in connection with the preparation of the documents necessary
to establish a water district pursuant to Article 12/ Article
12-A of the Town Law.
2. That this resolution is adopted subject to a permissive referendum
and that the Town Clerk is directed to publish and post a notice
of the adoption of this resolution in accordance with Article
7 of the Town Law

WHEREAS, the Town Code of the Town of Wallkill §249-34 requires
the payment of parkland fees for all developments and subdivisions,
other than two-lot minor subdivisions at a certain rate per unit
or lot; and

WHEREAS,
the owner of said proposed subdivided land subject to the aforementioned
fees, whose principal domicile is located
on said land, would be required to pay a parkland fee on the
owner’s already developed parcel; and
WHEREAS, the Town Board of the Town of Wallkill has determined
that said fee placed upon the post-subdivision domicile parcel
of an applicant for development or subdivision of property, is
unfair to that owner; and
WHEREAS, the Town Board of Wallkill is empowered by the State
to make changes in the Zoning Code that it determines to be in
the best interest of the public welfare of its citizens; and
WHEREAS,
said amendments to the Zoning Code are listed as Type I Actions
under §617.5 of the State Environmental Quality
Review Act (SEQRA); and
WHEREAS, in compliance with SEQRA, the Wallkill Town Board wishes
to assume lead agency status and set a time and place for a public
hearing for said proposed local law, so that the public may be
heard;
THEREFORE, IT IS HEREBY RESOLVED, that a public hearing be held
by the Town Board with respect to the adoption of the aforesaid
Local Law at 7:20 PM on April 24, 2003 at Wallkill Town Hall,
600 Route 211 East, Middletown, New York; and it is further
RESOLVED, that the Town Clerk is hereby authorized and directed
to cause public notice of said hearing to be given as provided
by law.

WHEREAS, the Town of Wallkill acquired various motor vehicles
for use by Town employees in execution of their jobs; and

WHEREAS, said vehicles are no longer used for said purpose due
to age, wear and tear and have been replaced; and
WHEREAS, it is no longer necessary for the Town of Wallkill
to sell said property for the purpose for which it was acquired,
thus making it surplus property, and
WHEREAS, it is the desire the Town Board of the Town of Wallkill
to sell said motor vehicles as surplus property in order to recoup
funds to be returned to the Town budget and used for the good
and welfare of the community; now
THEREFORE, BE IT RESOLVED, that the Town Board of the Town of
Wallkill, in regular session duly convened, does hereby authorize
and direct the Supervisor of said Town to cause said motor vehicles,
herein identified in Attachment A and identified as surplus property,
be offered for public sale through the bidding process, as established
and approved by the State of New York that the Town Board directs
the Town Clerk of the Town of Wallkill to publish in the normal
and legal manner a request for bids for the purchase of said
property; and
RESOLVED,
that the time for the opening of such bids be set at two o’clock
in the forenoon of the day of Thursday, April 24, 2003.

SUPERVISOR WARD: advises Mr. King to contact S. McLaughlin because
a lawsuit has been filed by the residents.

VALENTIN: Police Committee thanks D. Depew on parking fees
also grafitti; discussed moving impound lot to Highway Dept.
Looks forward to a bulk pick-up program. Little League parade

be put back.
