The Town Board of the Town of Wallkill held a regular meeting at the Town Hall, 600 Route 211 East, on Thursday, June 13, 2002 at 7:30 PM. Board members present were Supervisor Ward, Councilman McLean, Councilman King, Councilman Depew and Councilman Valentin. Also present was Louisa Ingrassia, Deputy Town Clerk and Spencer McLaughlin, Attorney for Town, Chief of Police, Robert Hertman and Ed Smith, Superintendent of Water & Sewer.

RE: Middletown Pontiac/ Buick/ GMC Tent Sale

Below please find Middletown Pontiac/ Buick/ GMC's proposal for a tent promotion to be held in the parking lot of Lowe's, adjacent to the Crystal Galleria Mall. Thank you for your assistance in this matter.

Dates: June 19, 20, 21 & 22
Space: We would propose placing a 20 x 30 ft. tent in the far corner of the parking lot, we would further propose bringing 75 cars, however, this number is flexible in accordance with any recommendation of the Town of Wallkill.
Hours of Operation: Wed., Thurs., Fri. from 9 a.m. to 8 p.m., Sat. from 9 a.m. to 5 p.m.
Advertising: We would be advertising in local newspapers and radio, said advertising would promote the Mall as well as Lowes and the Municipality.
Cleanup: All evidence of the promotion would be removed by Sunday morning following the promotion, the site would be patrolled on a daily basis for trash removal as well as general straightening.
General: Middletown Pontiac/ Buick/ GMC would carry full insurance coverage and would acquire all necessary permits. Further, we would conduct the promotion in a professional, businesslike manner which would enhance the site as well as the local community.

The Rosado Group, parent company to Middletown Pontiac/ Buick/ GMC, has run this promotion with some of our other dealers in Hazleton, Leighton and Dickson City with great success. The business's that we co promote with have had no complaints, and have, in fact, invited us back. We have received only positive feedback from the Municipalities that we have worked with.

I am sending this letter in order to receive approval from the board to upgrade a mobile home that I presently own and live in. The address of the property and mobile home is 259 Goshen Turnpike, Middletown, New York, 10940 in the Town of Wallkill. My present home is a 1967, 10 x 50 mobile home. I would like to upgrade it to a 1988, 14 x 76 mobile home. The newer mobile home is vinyl sided and has a peaked, shingled roof. It is my understanding that the Board meets two times per month. I am requesting Board approval to make the upgrade/ change to a newer, more aesthetic mobile home.

Please inform me of your decision at your earliest convenience.

Discussion;

Mr. King; concerned with lot size and septic capacity; questions whether its good for the area. Approve but with conditions of Building Inspector.

RE: OakHill Manor Public Improvement Performance Bond

Please be advised that the undersigned of our office has performed a review of the engineer's estimate for the roadway and water and sewer utilities improvement bond prepared by T.M. Depuy Engineering, as forwarded to our office on 10 May 2002. In line with our review of the enclosed estimate, be advised that we increased the cost of many of the unit prices in consideration of the need for the Town to pay prevailing wage.

In line with the above and a revised copy of the enclosed, we are recommending that the bond be established in the amount of $655,000.

We are hopeful that the above is acceptable. However, if you should have any questions, please contact our office.

RE: Demo Day

As you know, H.O. Penn has purchased a building site in the Town of Wallkill and has made representation to the Town as to our intention to build a branch facility on the property.

As part of the ongoing promotion activities associated with the launch of the facility, we would like to stage an event on the property that in essence would be an equipment demonstration, or for want of a better expression, an equipment 'rodeo'. The rodeo would take place Saturday, July 13.

We would stage this event as we have with our typical branch open houses. Invitees would include key individuals from construction companies, landscaping firms, and so on, located within a 30 to 40 mile radius of our location. Attendance would typically run about 300 or so throughout the 10:00 AM through 3:00 PM timeframe. We will have two large tents on site - a food tent serving hot food cooked on site by a catering firm, and a large tent for seating. Power for the site will be provided by portable generator. Sanitary facilities will include a suitable number of portable toilets rented for the occasion.

Approximately 40 pieces of new Caterpillar equipment will be moved to the site with the intention of demonstrating about half that number. We normally set up separate and distinct areas on a site within which we operate the pieces of equipment. Obviously, safety is our paramount concern. Each one of these demonstration areas will be manned with an individual skilled in the operation of the respective pieces of equipment. Only adults will be allowed to operate any of the machines on site. No alcoholic beverages of any kind will be served or tolerated.

Our normal staff complement for an event such as this would approximate 50. Attendees would be directed to the parking area, registered by our staff and generally guided by individuals from H.O. Penn to the machines/ areas of interest.

Our intent is twofold, firstly to launch our new Wallkill facility, show the customer base in the area our plans for the branch facility and the services that will be offered from that facility. Secondly, we want to demonstrate the features and benefits of the Caterpillar product line, to let them touch, feel and operate the various models of machines typical to the area.

Obviously, we are very excited about the prospect of opening a branch operation in the town of Wallkill. We would like to invite yourself and any of the Town of Wallkill staff that are able, to come to the future branch site to share that excitement with us on July 13, 2002.

RE: Construction Work for the New York State Dept. of Transportation, Job D258744 Project Location #2, Route 17M, Town of Wallkill

We are a construction firm under contract with the New York State Dept. of Transportation (NYSDOT) to perform milling, paving and miscellaneous work on job D258744. This includes work on a section of Route 17M within the Town of Wallkill (see enclosure).

This NYSDOT has asked that we inform the Police Chief and Town Supervisor that this job will require lane closures during work hours only. We will begin construction sign installation on or about June 12, 2002 and work will begin shortly after that. This project generally consists of asphalt milling and paving. All work will be performed during the daytime.

Per our conversation of June 6th, 2002 I would like to request the authorization of the Town Board to once again conduct our Annual Tent Sale.

The tent will be rented and professionally erected during the week of June 24th, 2002. The sale will begin on June 27th, 2002 and is expected to run through Sunday, July 14th, 2002. The tent will be dismantled the early part of the week of July 14th. The tent will be 30' by 40', with sides attached to it, and will be located in the parking areas right outside our doors in the Galleria at Crystal Run. The location is the same that has been used in years past. Merchandise sold will be primarily clothing and footwear. The merchandise will be brought out each morning and brought back into the store each night.

I have had a conversation with Ed Smith of the Water and Sewer Department and would like to recommend that this Thursday evening at the town Board Meeting the Town Board remove all water restrictions except the watering of lawns. The restrictions for the lawns would be they could only be watered in the evening time between the hours of 6 PM and 8 PM.

We are pleased to announce that Michele White has received the Employee of the Month award for May in the Department of Public Works.

As you know, the Town received notice last month that we will be receiving a $72,103.50 grant from Orange County to build a new pavilion and improve the entrance at the Circleville Park. The application for this grant program was prepared by Michele, and feedback we received from various County Legislators and grant committee members was that our application was very well done. As one County official told me, "good applications receive good grants, and Wallkill's was one of the best".

Please join us in congratulating Michele for her selection as Employee of the Month, and thanking her for her fine effort in procuring this large grant to improve Circleville Park.
