WHEREAS, the Town of Wallkill acquired various motor vehicles
for use by town employees in execution of their jobs; and
WHEREAS, said vehicles are no longer used for said purpose
due to age, wear and tear and heave been replaced; and
WHEREAS, it is no longer necessary for the Town of Wallkill
to retain said property for the purpose for which it was acquired,
thus making it surplus property, and
WHEREAS, it is the desire the Town Board of the Town of Wallkill
to sell said motor vehicles as surplus property in order to
recoup funds to be returned to the Town budget and used for
the good and welfare of the community; now
THEREFORE, BE IT RESOLVED, that the Town Board of the Town
of Wallkill, in regular session duly convened, does hereby
authorize and direct the Supervisor of said Town to cause said
motor vehicles, herein identified in Attachment A and identified
as surplus property, be offered for public sale through the
bidding process, as established and approved by the State of
New York that the Town Board directs the Town Clerk of the
Town of Wallkill to publish in the normal and legal manner
a request for bids for the purchase of said property; and
RESOLVED that the time for the opening of such bids be set
at two o'clock in the forenoon of the day of Thursday, August
28, 2003.

IT HEREBY RESOLVED, by the Town Board of the Town of Wallkill,
that said Town Board hereby amends the appropriate
Town of
Wallkill employment schedules to create an additional position
in the "Court Attendant" category, designated by
the Orange County Department of Personnel as "Court Attendant",
title #1199; and
THAT, William Welyczko, currently performing the duties required
of a Court Attendant in the Town of Wallkill Court, is hereby
appointed to the aforesaid title of Court Attendant herein
created.

WHEREAS, heretofore the Town Board of the Town of Wallkill
has introduced a proposed local law amending Chapter 194-48E(1)
of the Code of the Town of Wallkill by repealing existing Article
II and enacting a new Article II, and
WHEREAS, the Town Board is the sole Involved Agency and is
the Lead Agency, and as such caused to be prepared a short
Environmental Assessment Form, and
WHEREAS, the Town Board has conducted a public hearing on
the proposed local law and heard all persons interested in
the subject matter of the same, and
WHEREAS, following a public hearing on the proposed local
law and due deliberation having been had thereon, now
THEREFORE, BE IT RESOLVED as follows:
1. That after considering all of the information presented
to it, including the short Environmental Assessment Form and
comments presented to the Town, the Town Board hereby determines
that the proposed action will not result in any significant
adverse environmental impacts, and that the adoption of the
proposed local law will have a beneficial effect on the environment
on the environment of the Town of Wallkill in that the local
law updates the requirements for the use, operation and maintenance
of the public sewer systems within the Town of Wallkill and
in particular construction of the sewers and the monitoring
of industrial users, all of which the Town Board determines
will have a positive effect on the environment.
2. That the Town Board does hereby issue this Negative Declaration
and authorizes the Supervisor to execute Part III checking
the appropriate box and issuing a Negative Declaration.

WHEREAS, the Town Board of the Town of Wallkill understands
that it is in the best fiduciary interest of the Town to have
established a Capital Asset Policy for Town-owned assets, both
real and otherwise; and
WHEREAS, the establishment of a Town Capital Asset policy
by the Town Board is the first step in the GASB34 Procedure,
recognized as the standard of excellence in municipal fiduciary
responsibility of the Town to its citizens;
BE IT HEREBY RESOLVED, by the Town Board of the Town of Wallkill,
that said Town Board hereby adopts a Capital Asset Policy,
herein attached, as official policy of the Town of Wallkill.

WHEREAS, on June 29, 2003, the rupture of a fitting at the
Crystal Run Water Pump Station caused the loss of availability
of nearly half the municipal water supply of the Town of Wallkill;
and
WHEREAS, the Supervisor of the Town of Wallkill declared an
emergency condition existed, as a result of the aforesaid occurrence;
and
WHEREAS, emergency repairs to said facility were carried out
quickly and efficiently in resulting in the Town of Wallkill
water supply being brought back to 100% within the shortest
time possible; and
WHEREAS, the cost of said emergency repairs totaled $46,111.62,
consisting of $37,611.62 for four electronic pump starters
and $8,500 for pipes and reinforcement; now
THEREFORE, RESOLVED by the Wallkill Town Board, that said
emergency action and expenditure is approved nunc pro tunc
(now for then), as being in the best interest of the residents
of the Town of Wallkill; and be it further
RESOLVED,
by the Town Board of the Town of Wallkill, to render thanks
to the Water & Sewer Department under Superintendent
Edward Smith for a job well done in the recent aforesaid
emergency situation.

WHEREAS, the Town of Wallkill is thew owner of a parcel (37.1.30)
consisting of approximately 1/5 of an acre at the intersection
of Route 17M and Keystone Park, and
WHEREAS, the Town Board after investigation has determined
said parcel to be surplus land of no current use to the Town
of Wallkill,
THEREFORE, BE IT RESOLVED, the Town Board of the Town of Wallkill
hereby declares said land to be surplus land of no current
use and hereby authorizes the Town Supervisor to advertise
for written bids for the sale of said parcel to the highest
bidder. Said bids to be opened at the office of the Town Clerk
at the Town Hall on August 28, 2003 at 2:00 PM reserving to
the Town the right to reject any and all bids for any reason
whatever.

WHEREAS, petition has been made to the Town of Wallkill for
the establishment of a lighting district in the proposed subdivision
known as Waterview Village in the Town of Wallkill, and
WHEREAS, said petition has been deemed sufficient by this
Board; and
WHEREAS,
the Town Board of Wallkill is empowered by the State under
NYS Town Law §194 to establish special lighting
districts in the Town that it determines to be in the best
interest of the public welfare of its citizens; and
WHEREAS, this board has determined that all property and property
owners within the proposed district will be benefited thereby;
and
WHEREAS, this board did hold a public hearing regarding the
establishment of alighting district within Waterview Village
on July 24, 2003, at the Town Hall, 600 Route 211 East, Middletown,
NY 10940; and
WHEREAS, said establishment of lighting districts has been
determined to be a Type II action under the State Environmental
Quality Review Act (SEQRA) criteria; now
THEREFORE, it is hereby resolved as follows:
1. That the Wallkill Town Board hereby declares the establishment
of lighting district in the proposed subdivision known as Waterview
Village as a Type II action under the State Environmental Quality
Review Act (SEQRA) criteria; and
2. That the Wallkill Town Board hereby establishes a lighting
district in the proposed subdivision known as Waterview Village;
and
3. That the Town Clerk be directed to file a certified copy
of this resolution with the office of the state department
of audit and control at Albany, NY, together all appropriate
papers with appropriate signatures where needed; and
4. All board, agencies, departments and contracted professionals
of the Town of Wallkill are hereby authorized and directed
to effect or otherwise facilitate the implementation of said
District.

COUNCILMAN KING: discussed Master Plan public forum to be
July 31st at 7 PM; Town Hall site committee visited the Town
of Crawford; new code regulations. NYS Dept. of Code would
like to meet with Dan. Depew; many options as far as new codes.
Meeting with Mr. Smith and Mr. Depew regarding Veterans Park
hydrant installation.
MR. SMITH: will try to bore it in Friday

COUNCILMAN VALENTIN: Jr. Boys were District 19, Section 2
champions; playing in the state championship and were 8-0 this
year. Discussed the police and the neighborhood watch; Greenway
Terrace. Cindy Lane residents are getting involved; next
meeting is August 5th at 7:30 PM. Police Department is in
need of a new server; he will be speaking with purchasing.
Howard Drive neighborhood watch to hold meeting. Many abandoned
cars; unregistered vehicles; might be able to register unlicensed
vehicles with Town- will bring it up at the next work session.
COUNCILMAN McLEAN: presented draft contract to Town Hall unit
president for review. Human rights meeting Sept. 22, 2003 at
7PM. Building site feasibility study due soon.
COUNCILMAN DEPEW: recreation meeting Tuesday, 6:30PM. Highway
- Whipple Road sign missing please replace as soon as possible.
Regarding Townley Hall, Board is negotiating purchase; attorney
is preparing contract. Waiting for union response to contract
offer. Cars continue to speed on Pocatello Road; Fair Oaks
road is an on going problem.

COUNCILMAN KING: call to NYS building Code; wants to talk
as soon as possible regarding 2003 Universal Code.
COUNCILMAN VALENTIN: building permit issues

Soccer tournament does a lot for Town businesses. Thanks to
the Parks Department.
COUNCILMAN McLEAN: impressed with Emergency Management Committee;
TOWVAC- feels safe in community. August 25, Battalion #1 meeting.
Bulk pick up went well thanks to the Supervisor
COUNCILMAN DEPEW: thanks everyone for fireworks; a safe event;
would like to see it happen again next year. Thanks to Water
Department. Rabies clinic, July 27th at Town of Wallkill Community
Center. Bulk pick up fourth ward; sorry it took so long. E-coli
scare at Lorelei Drive; private water source. Thanks to Ed
Smith and Ed Simms. Discussed tire drop off. Shawn Nolan, Pace
land use, will write up proposal regarding Shawangunk Kill.

SUPERVISOR COMMENTS
Open door July 26 from 9-12. Pine Bush School taxes can no
longer be paid in person; any payment questions call 744-2031
ext. 4019. Bulk pick up; $50,000 below estimates
Mr. King notes that he was wrong and will admit it regarding
bulk pickup.
Received second sales tax check from county; $584,878.15;
collected over one million so far this year. Girls will be
playing in the championships this weekend. No work session
on Aug. 8, 13, 14. Next meeting will be August 28. Town wants
to present awards to returning service people from war. Call
town hall with names. Read letter regarding tire disposal from
the county.
Mr. King says that tires can be dropped off at highway garage
August 11-16; limit of five tires per resident.
