CLERK: ORDER CALLING FOR PUBLIC HEARING In the Matter of the Establishment
of the Stone Ridge Estates Lighting District in the Town of Wallkill,
Orange County, New York
WHEREAS,
the Town Board of the Town of Wallkill has received and filed
the petition of Horizon View Realty, LLC dated June 6, 2002 for
the creation of a lighting district encompassing certain land
lying within the subdivision known as Stone Ridge Estates, lying
within the Town of Wallkill, County of Orange, State of New York;
WHEREAS, the boundaries of the proposed district are described
by metes and bounds in Schedule A to the aforesaid petition, and
the boundaries of the lands proposed to be included in the lighting
district are also described on a subdivision plan, plan entitled
“Stone Ridge Estates”, prepared by Lanc & Tully
Engineering and Surveying, P.C. dated December 28, 2001 last revised
March 29, 2002, and said lands are also known as tax parcel number
19-1-50 on the Tax Map of the Town of Wallkill;
WHEREAS, said petition was duly presented to the Town Board, together
with the necessary map and legal description.

WHEREAS,
the Town of Wallkill Planning Board has completed its preliminary
subdivision review of this project, and granted preliminary subdivision
approval;
WHEREAS, in the course of its review and preliminary approval
the Planning Board and the Owner have agreed and determined that
certain lighting improvements should be provided and maintained
by the property owners, which improvements include the improvements
that are identified and shown on the aforementioned subdivision
plan;
WHEREAS, the aforesaid lighting improvements will be installed
by the Owner at no cost to the Town;
WHEREAS, there will be no hook up fees, and the cost of the district
to the typical one family house located within the district will
be the annual cost of maintaining the lighting facilities of the
district allocated among the lots comprising the district;
WHEREAS, the estimated maximum annual cost of maintaining the
aforesaid lighting district improvements is anticipated to be
less than one hundred dollars ($100.00) per lot;
WHEREAS, the Town Board will consider the Owner’s request
that a Town lighting district be created for the purpose of managing
and administering the lighting improvements shown on the aforesaid
plan; and
NOW THEREFORE, THE TOWN BOARD RESOLVES that
1. A public hearing shall be held on July 25, 2002, at 7:10 PM
at the Town Hall, Route 211 East, Middletown, New York, to consider
the petition and hear all persons interested in the matter.
2. Not more than twenty and not less than ten days prior to that
date , a copy of this Order shall be published and posted in the
manner prescribed by law.

WHEREAS, on June 13, 2002, the Town Board of the Town of Wallkill
adopted a resolution directing the owner in fee of the property
described in Exhibit “A”, Oak Hill Manor, Inc., subject
to the supervision and review of the Town Engineer, to construct
and install a lighting district on the property owned by the Petitioner,
Oak Hill Manor, Inc., fronting on Oak Hill Road, and shown on
the Wallkill Tax Map as Sec. 101 Block 1 Lots 1-30, and Sec. 101
Block 2 Lots 1through 3; and
WHEREAS, there is proposed a lighting district as shown on the
subdivision map entitled “Survey and Subdivision Plat, Oak
Hill Manor Townhouses”, as Map No. 10268; and
WHEREAS, Oak Hill Manor, Inc., the owner in fee, has filed a Petition
with the Town Board of the Town of Wallkill for the proposed lighting
district; and
WHEREAS, the improvement proposed is a lighting district is for
the benefit of the subdivision lots, and all are now owned by
the owner in fee, Oak Hill Manor, Inc.; and
WHEREAS, the owner in fee, Oak Hill Manor, Inc., is to provide
for and/or obtain and/or advance and/or pay the entire costs for
the construction and installation of the public lighting facilities;
and
WHEREAS, the said subdivision map with the proposed district shown
thereon, is on file with the Office of the Town Clerk of the Town
of Wallkill, and is available for public inspection, and said
