THOMAS G. HINDLEY, JR.: Request for a variance of 249-d (accessory building) 40x60ft; Property located at 680 Dosen Road (SEC 6 BL 1 LOT 16); Designated RA.

Mrs. Thompson: The mailings were reviewed by the Board anf filed by the Secretary. The Public Notice was read at 8:39 pm.

Mr. Smith: I Move to open the Public Hearing at 8:40 pm.

Mr. Smith: Please present your application.

Mr. Hindley: This is for the storage of cars and the front of the building lies along a tree line and there is plenty of side and rear room. Excessive size.

Mr. Smith: Where will the doors be?

Mr. Hindley: In the front and I’ll get rid of all 4 sheds which will be removed.

Mr. Smith: Any questions from the Board?

Mr. Oster; The driveway will go around and trailer stay?

Mr. Hindley: The trailer will be moved at a later date and I want a modular there.

Mrs. Thompson: Who lives on the property?

Mr. Hindley: No one, I am going to move there.

Mrs. Thompson: You can’t have an accessory building without primary residence.

Mr. Hindley:

J. Owen, Esq: No one lived in trailer in 5 years?

Mr. Hindley: No. No one told me that.

Mr. Oster: I thought someone was in the trailer and you needed this for personal use.

J. Owen, Esq.: It has to be with the principal building. There are 3 things to make it accessory building.

Mr. Hindley: Its RA and is 2 acres.

Mr. Smith: The acreage?

Mrs. Thompson: 1.5.

Mr. Smith: You need two (2) acres for the residence.

Mr. Hindley: The trailer has not been used for 5 years.

Mrs. Thompson: He will need variance for the house because of the current acreage.

Mr. Owen: You are going to live there?

Mr. Hindley: Yes, move trailer and put modular on it.

J. Owen, Esq.: The zoning has been changed to 2 acres for 1 lot unless you get variance for that. You will have to come here for a variance. You have lost use for it since its been more than a year and replacing it with something different.

Mrs. Thompson: How big on Dosen Road?

Mr. Hindley: Its my parent’s house. It was surveyed when I bought it.

Mr. Smith: You can go see him and ask him to put the buildings on it.

Mr. Hindley: Last time I was just told about the size.

Mr. Smith: When we saw the mobile home it was thought someone might be living there.

Mr. Smith: Any questions from Public?

Marla Kopek / Jean Bock: No one has lived there for 20 years.

Mr. Hindley: The Oday’s owned it and came up on summers.

Marla Kopek: I am concern about the hugeness of it.

Mr. Hindley: It is on the street. Its on the wood line.

Jean Bock: You cleared the whole lot.

Mr. Hindley: The face of the building is on the wood line.

Scott Kopek (Public): I have a concern about a 46 x 30 building for car storage – hobby one thing and not a extension of stock car across Citgo station. The stock cars coming and going is different from storage.

Mr. Hindley: The race cars on are on a commercial lot.

Scott Kopek: The back is the front of my yard.

Mr. Hindley: There are trees between the two.

Mr. Smith: It has to be an accessory to a use.

Scott Kopek: (showed where the lots are)

Scott Kopek: Hobby and corvettes are fine.

Jean Bock: I have a concern about a commercial type on the residential street and bringing property value down. I would not want huge building in front of my house.

Mr. Smith: You are where in relation to this?

Mr. Owen: We can take a vote.

Mr. Smith: I Move to grant an accessory variance 249-3 to 40ft x 60ft; Seconded.

JAMES A. COOPER: Request for variance of 249-3 (accessory building) 40x60ft for construction of a personal storage building; Property located at Rt 302 (SEC 9 BL 1 LOT 1.2); Designated NC.

Mrs. Thompson: The mailings were reviewed by the Board and filed by the Secretary. The Public Notice was read at 8:55 pm.

Mr. Smith: I Move to 8:56 pm.

Mr. Cooper: I have new maps made and Dan Yonish came and re-did them and they are up to date.

Mrs. Thompson: Do you plan to take the sheds down?

Mr. Cooper: Yes. I’ll give one to may son and that leaves one there which was a hen house and eventually it will go. I don’t need it if everything go under one roof. The doors will coming in are facing the stone wall (Eustace/Horowitz) and the set backs , I have.

Mr. Smith: What is the height of the building?

Mr. Cooper: They plan on taking some of the knoll down. Now it goes up and quick and we went with that but will excavate it to the back lot evenly. Your approach is too abrupt if you go too high.

Mr. Smith: Are people living there?

Mr. Cooper: I live there.

Mr. Oster: What is stored there?

Mr. Cooper: A couple of antique cars, equipment in the winter and we will put up a fence in the back and it will look nice and neat and enclose everything. No more tarps.

Mrs. Thompson: You are in the paving business?

Mr. Cooper: Yes and in the Winter we would put equipment and trucks in there – under one roof.

Mr. Owen: How many trucks?

Mr. Cooper: Three (3).

Mr. Oster: I see another shed on the corner?

Mr. Cooper: We will move them and one goes immediately and one when my father in law takes his stuff out to go to Florida and the rabbit shed is the for grandson.

Mrs. Thompson: One of the neighbors looked at plans and had no problem.

Mr. Owen: A 12 foot door?

Mr. Cooper: Two - 12 foot doors and one 10 foot door. I’ll put the Mustang in there. We want to keep it a nice residential look.

Mrs. Thompson: Others have said you keep a nice place.

Mr. Smith: Any questions from the Public? (no)

Mr. Smith: Any questions or comments from the Board?

Mr. Smith: The relief is minor and it is a nicely kept place. You have been in business for quite a long time.

Mr. Smith: I Move to grant an accessory building variance from 28 x 28ft to 40 x 60ft; Seconded.

Mr. Vobis: We came to for variance for a sign structure at the former Heritage Motel which is to become an Economy Inn. We need it for visibility and to conform to code.

Mr. Smith: What are you putting up.

Mr. Vobis: The panel size is over sized and the actual is 10x10ft.

Mr. Patel: The corporation was made up by my dad it (name) means ‘good luck’.

Mr. Smith: Have you gotten notice on change on the interchange?

Mr. Patel: We have not heard anything.

Mr. Smith: Do you have permanent people staying there?

Mr. Patel: No. Only the manager.

Mr. Vobis: (showed photos of what changes have been made). The owner had renovated the interior and exterior and wants to take care of it.

Mr. Smith: The sign comes back toward and closer to the line (looked at the drawings).

Mr. Vobis: He has a small opening now for visibility. The existing sign is 32 feet to the Heritage (various pictures).

Mr. Smith: Any other comments then?

Mrs. Thompson: It is nice to be able to find a motel when you want one.

Mr. Vobis: The variance is for visibility. No sense in making an investment and not being able to see it.

Mr. Smith: Any questions from the Public? (no)

(side and front yard setback): side from 15ft to 12ft; front 35ft to 7ft 7 in;for a 10x10ft attached garage; Property located at 10 Abingdon Mews (SEC 93 BL 1 LOT 32); Designated R-1.

Mrs. Thompson: The mailings were reviewed by the Board and filed by the Secretary. The Public Notice was read at 9:11 pm.

Mr. Smith: I Move to open the Public Hearing at 9:12 pm.

Mr. Smith: Please present your application.

Mr. Ramos: Good evening and I am looking for a variance for an attached garage 15 x 10 to my home in the side yard area there.

Mrs. Thompson: I asked what you would put in garage and you needed a place for stuff. Do you need such a big addition to the house? You took the other car out so I could see how it fit. If just for stuff in attic or cellar could you use smaller area.

Mr. Oster: The Front yard is my concern – the garage so close to road and that neighbor.

Mr. Ramos: On the side here (drawing)?

Mr. Oster: With the garage 7.7 feet, even though the end piece its coming too close.

Mr. Ramos: 11 feet, what if I do 15? 22.7 and 4 feet 2 inches. So if I put 15 its 11 from the street.

Mr. Smith: I looked at it yesterday and lot of cars are there and in a planned development and most do come with garages - your garage will stick out further than the rest of them and garage there is not in keeping with development.

Mr. Ramos: Can I make it smaller. It’s the same garage as the others.

Mr. Smith: It will project out further and realize you have driveway on the side as well. Mainly its being planned development and to approve a variance like this brings it closer to the side streets.

Mr. Ramos: What about a smaller unit?

Mr. Morgan: What about 10x10.

Mr. Ramos: What about storage instead of garage?

Mr. Owen: You bought this 2 years ago?

Mr. Ramos: Yes.

Mr. Smith: Not an addition to the house.
