Mrs. Thompson: Do you have a fence?

Mrs. Thompson: Why is it five feet?

Mr. Beamesdorfer: It's a standard horse fence. It's smaller mesh and they can't get their hoofs through. The standard height for that fence is five feet. The indoor arena is 200 x 80 feet and the barn is 96 x 36 feet.

Mr. Smith: You will need to notify everyone within 300 feet of your property. Look in the Times Herald Record later this week for the published Public Hearing Notice. Take that and copy it and mail it to everyone on the list you can get from the Assessor's Office. Mail it at least ten days prior by certified or registered mail and bring the proof of mailings with you to open your hearing. The Assessor will have the list.


Hawkins

Mr. Hawkins: I bought a piece of property on Route 211. The Building Inspector had left a note. I tried to talk to him and left a note for him. I hired Roger Ferris to check the septic design to see if it was okay for a septic. I received a Stop Work Order when I had a dumpster there to clean up the property. It had been condemned and when I ordered the title there was no record of any violation. I was sent a letter in December of 2001 to have the mobile home removed.

Mrs. Thompson: How long has it been vacant?

Mr. Hawkins: Five years.

Mr. Smith: I want some comments by the Zoning Board Attorney before we do this.

Mr. Owen, Esq.: It is to be demolished and removed. He has to start all over again because the mobile home has been unoccupied for more than one year.

Mrs. Thompson: He can't put one back there?

Mr. Owen, Esq.: No, he can't put one back.

Mr. Hawkins: There was nothing on record to say it was condemned. The tax records still shows they pay taxes on the mobile home and property. I don't know when it was vacant. I didn't know anything. The Town says it is condemned and has to come down. The title report didn't have anything in it about any violations.

Mr. Smith: Take it up with the title company. You were instructed to demolish the trailer. The use has expired. I don't think we can even entertain this.

Mr. Hawkins: I didn't know.

Mr. Smith: No Action Taken.


Fotopoulos

Mr. Smith: Explain what you're asking for.

Mrs. Thompson: How long have you owned this property?

Mr. Fotopoulos: Eight months.

Mrs. Thompson: What do you want to do?

Mr. Fotopoulos: I need the variance for a garage, your code is 24 x 24 and we want to go with 22 x 42. Because of the property size we need that.

Mr. Smith: You need that size to store all your mowing equipment. Anything else?

PUBLIC HEARINGS


KENNETH ROSSI: Request for a variance of 249-19-D (side and rear yard setback) for removal of existing trailer and build new home; Property located at 46 York Road (Sec. 3, Block 1, Lot 104.24); Designated RA.

Mr. Smith: Continuation of Public Hearing was started at 8:30 P.M.

Mr. Rossi: You requested the builder but he couldn't make it tonight because he was working. Hopefully he is going to down size the house. We are negotiating with Tom Vernooy, who is the property owner all around and he didn't get back to him yet.

Mr. Smith: In that case, we will continue next month.

Mr. Rossi: He did submit a smaller house.

Mr. Smith: Could you . . .

Mr. Rossi: Locate that on the plot plan?

Mr. Smith: Get some copies to us.

Mr. Rossi: Show it on the plan?

Mr. Smith: It should be, yes. You had a larger house and you are down sizing it, you said?

Mr. Rossi: Yes.

IMPERIAL GARDENS: Request for a variance of 249-11-K (2) for a sign for their property located at Imperial Park Drive, Route 211 East (Sec. 41, Block 1, Lot 111) and designated PID.

Mrs. Thompson: The mailings were reviewed by the Board and filed by the Secretary. The Public Hearing was read at 8:33 P.M.

Mr. Shapiro: This application is for an area variance for the sign for Imperial Gardens (Park) right there on Route 21l. The main issue here is that the sign is simply too small, too inconspicuous to be easily seen by people driving by. What happens and apparently fairly frequently that people see it the last minute and swerve over to get into the complex. A larger sign is requested. The identical sign just on a larger scale but identical in all respects simply to make it more visible to people passing because of the nature of Route 21l here all the other signs are far larger and it would be certainly in keeping in line with similar signage that is out there. That's really the basic reason for it and the various grounds set forth in the code in the code we believe are well satisfied. It certainly won't change the character of the neighborhood in any way. It just would fit in with what else is really out there right now and it will hopefully be an improvement in public safety so there won't be any accidents.

Mr. Smith: Any comments from the Board?

Mr. Morgan: What is the size of the sign?

Mr. Shapiro: Six by ten.

Mr. Oster: You have twenty square feet now and you want to triple it to sixty square feet.

Mr. Rosenbaum: Right. Also, by the code we can't have the sign higher than forty eight inches, it will be six feet high.

Mr. Smith: You will have to change that also. You will need seventy two inches high.

Mr. Oster: On your other properties on Goshen Turnpike you have a nice sign and that's not six by ten.

Mr. Rosenbaum: Yes it is.

Mr. Oster: Is that six by ten?

Mr. Rosenbaum: I believe so.

Mr. Oster: You also have the pillar sign on the two pillars on Route 211 and that's part of Imperial Ridge.

Mr. Rosenbaum: Those signs on the pillars are on Goshen Turnpike property.

Mrs. Thompson: On Goshen Turnpike, Imperial Ridge they have landscaping.

Mr. Shapiro: We will put flowers there.

Mr. Oster: You will decorate or landscape around the sign?

Mr. Rosenbaum: Oh, yes. We want an attractive sign.

Mrs. Thompson: I am concerned about where the sign is near the highway.

Mr. Rosenbaum: It is actually twenty feet away.

Mrs. Thompson: That sign is twenty feet away?

Mr. Rosenbaum: Yes. We wouldn't go further out toward the street, we will be putting it further back on the property.

Mr. Oster: You have pillars out there which have signs and they say Imperial Ridge.

Mr. Rosenbaum: That's the other complexes.

Mr. Oster: I mean on Route 211 at Imperial Park you have signs on the pillars.

Mr. Rosenbaum: They are not at Imperial Park.

Mr. Oster: Those are vacant pillars with no signage on them at all.

Mr. Rosenbaum: No sir.

Mr. Oster: No letters.

Mr. Smith: Is there anyone here that have comments from the public?

Mr. Oster: I'm going to ask for landscaping around that sign.

Mrs. Thompson: Can you come up with a smaller sign?

Mr. Rosenbaum: I can try five by seven.

Mr. Owen: I think you have to consider the location of where it is when we talk about the size. A smaller sign even the size of the existing sign would be appropriate if it were out in a more rural area but given the domination of Route 211 by other signage, having the six by ten will really make sure that we get the necessary visibility to accomplish the code.

Mr. Smith: I went down Route 211 and had people swerve over into the passing lane real quick because it comes up and all of a sudden it startles them. I think a bigger sign would probably be beneficial for the safety of the area.

Mr. Cieslewitz: The other sign on Goshen Turnpike is a nice looking sign.

Mr. Rosenbaum: It will be the same sign. The only change will be it will say Imperial Park, that's it.

Mr. Smith: I don't think it will have any impact. It's a commercial area. It's a busy highway. It would probably improve site distance.

Mr. Cieslewitz: I agree especially for the safety issue.

Mr. Smith: Any more comments from the Board? (No.)

Mr. Smith: Any comments from the Public? (No.)

Mr. Smith: I Move to close the Public Hearing at 8:42 P.M.; Seconded; All in favor; Motion carried.

Mr. Smith: I Move to grant variance from 249-11 (K) 12 to go from a sign twenty square feet and maximum height of forty eight inches to sixty square feet and a maximum of seventy two

inches on the condition they do appropriate landscaping around the sign so that it doesn't hinder site.
