G. Lake: I think you hit it on the head. You're right. Everyone you go to.

R. Chmiel: I'll expand the building if you will let me.

A. Dulgarian: They should have been brought up originally. That's brand new and is a nice place.

R. Chmiel: There is a waiting area on the inside. There is a lobby and a waiting area. If it's busier than, I could put a waiting area in for one hundred and that could be busy.

D. McGoey: There's no more room in there than any other restaurant. I can tell you that. Can you put some benches out on the sidewalk?

R. Chmiel: Yes.

A. Dulgarian: Mostly to keep people out of the parking lot for safety reasons.

R. Chmiel: I don't have a problem at all. I have two benches on the one side. What I can do is I can expand that and put more benches on the left side. The benches are bolted down into concrete pads.

D. McGoey: That was a good point.

G. Monaco: I agree.

G. Lake: Can we add a few benches on the outside then?

R. Chmiel: Yes we can.

A. Dulgarian: If you think that will do, it's definitely a step in the right direction. I just think it's something that we need to look at now.

R. Chmiel: I can add benches to the side of the front door out of the way of the walkway on either side as long as I don't block the access.

A. Dulgarian: And maybe management will tell people this is where you can wait or what ever.

R. Chmiel: The outside dining, the way we do it as a company, you have to go inside in order to be seated outside. You don't just walk up and sit down. There is an opening in the fence right now but that's for egress. It is policed very well. We don't allow people just to walk up and sit down.

A. Dulgarian: My position is I have no problem with them having outside dining. I just think what ever they see fit.

P. Owen: I think that's really the only thing that can be done at this point.

G. Lake: You're right.

A. Dulgarian: Now we will know when the next one comes in.

R. Carr: I agree with that. The only other comment is the landscaping or the shrubbery along the driveway. I wasn't on the Board at that time but I remember there was a lot of talk about the backs of buildings.

R. Chmiel: The back of the building right now we are at the limits and I'm trying because of that problem I'm trying to come up with a way of shielding the back off doing more planting which I will have to come here at another time to do because I'm not prepared to do it tonight. It is definitely a concern of ours. I can't say right now what it's going to be but I had my architect there today and we're trying to propose something to make the back of the building a lot more presentable than it is.

G. Monaco: I think a couple more benches will help. Every time I've been there, those benches have been filled.

T. Ptak: I'm representing Autumn Sky Development. We're here tonight to request final approval of this three lot subdivision subject to a couple of Dick's comments.

G. Lake: I will go through the Board.

A. Dulgarian: Go ahead.

G. Lake: You can go ahead.

T. Ptak: The comments are we have to verify the septic approval with Eustance & Horowitz. I spoke with them today. They've approved it. They just haven't given me their letter. The iron pins have to be put at the angle points. We just have to add that to the map. The other is having sheet #1 signed. We have a signed copy. I thought we gave this to the Board but maybe we didn't. He normally any more doesn't sign the final maps. I will get those signed if the Board so wishes.

D. McGoey: Just give us a copy of that for the file.

T. Ptak: Okay. I will get another copy.

G. Lake: I will go through the Board.

A. Dulgarian: I forgot. He received Preliminary and now is in for final.

G. Lake: Yes. We've been around on this a number of times.

2. MAPLES FARM - SITE PLAN/SPECIAL USE PERMIT - Route 17M (36-2-10) #026-002


M. Fellenzer: I have with me the owners of Maples Farm, Dan Keller and Jeff Brown. We're ready to address the comments from our recent work session. I think they have been addressed on the plan. There's a copy of a letter that was attached with them that went over item by item the comments by the Town Engineer.

G. Lake: After the last meeting we did have a pretty good work session with this applicant. Dick had almost thirty comments.

A. Dulgarian: There was a few.

G. Lake: I think they have been addressed.

M. Fellenzer: The maps have all been adjusted to reflect those comments. We did talk about some mitigation in terms of traffic control during various events. The owners are taking measures and a note has been added that they will have off duty officers for traffic control during events especially during the Halloween season.

D. McGoey: Did you get these? They were faxed to you last week. Do you want to just go through those?

G. Lake: Are those from the work session?

D. McGoey: No, those are for tonight. They were substantially reduced from the work session but I have a couple of additional comments.

G. Lake: Do you want to go over them?

D. McGoey: Do you have a problem with item #1, the legend to clarify the different types of pavement.

M. Fellenzer: Okay. I have no problem.

D. McGoey: Handicapped signs have to read by permit only.

M. Fellenzer: Okay.

D. McGoey: Item #3. The width of the entrance drive must be shown and it must be twenty four feet for two-way traffic.

M. Fellenzer: Correct. The overflow area you had a concern is the one adjacent to Maples Road?

D. McGoey: Right.

M. Fellenzer: I will have to look at that.

D. McGoey: Parking requirements require that parking is set back ten feet from the front and side lot line.

M. Fellenzer: In terms of the overflow spaces again is what you're concerned about?

D. McGoey: Right. Item #5 is for the Board. The event parking, you only show one sign to the event parking and I just thought that maybe the Board would just want to see a little more direction. I'm just wondering as you come around the turn here whether there should be something up front that sends you down the road a little further for event parking.

M. Fellenzer: On the event parking I tried to do it in both ends of all the parking but you're correct. It doesn't give any direction for someone on Route 17 or Maples Road in particular for that. I didn't know if that was something the Planning Board can think about if they would like us certainly to add something on Maples, we could do that. I was thinking that the traffic control officers that were there during the day could get the flow to the location but that's fine what ever the Board would like is fine with us.

G. Lake: I will go through the Board.

A. Dulgarian: I have questions either for Mark or Dick.

G. Lake: Do you want the additional sign?

A. Dulgarian: Yes.

P. Owen: Yes.

R. Carr: Yes.

G. Monaco: Yes.

M. Fellenzer: On the road on Maples, is that what you are saying?

G. Lake: The event signs that we were just talking about.

M. Fellenzer: On Maples Road.

D. McGoey: As you make the turn so they can see it.

G. Lake: Before I go back to the Board, you have no comments on these comments from Dick?

M. Fellenzer: No. We have no problem with them.

G. Lake: Okay.

M. Fellenzer: We would like one clarification on the comments that were sent. Comment #1 regarded the display of rental equipment on the property. Just to refresh my memory our discussion was really concerning any displays in the front area. I just want to make it clear and let Mr. Keller explain the rental equipment. We did say in our note, no display of rental equipment to be located on the site. Let me ask the owner to describe that a little.

G. Lake: Did we discuss that?

D. McGoey: We discussed it at a work session.

D. Keller: The question that I had is that what we do is we do rent equipment to contractors if they come in. We shouldn't have them parked where we have them parked up on top of the road there but we may have it down in our bulk yard and have them parked there. I don't know why that should be an issue.

D. McGoey: You have to show it on the site plan.

D. Keller: It's in our charter that we can have rental equipment.

D. McGoey: At the work session you said you weren't going to rent equipment. All we wanted to know is show us the area where you're going to display the equipment.

A. Dulgarian: The place where they are going to be. It's not a big issue.

M. Fellenzer: We do show equipment parking spaces.


A. Dulgarian: If he wants them down by the bulk area, that's fine. Just show us a spot and let's get it done. It's not a big deal.

G. Lake: So, the comments you have no problem with?

M. Fellenzer: Correct.

A. Dulgarian: That was one of my questions about the equipment. The second thing, have the sheds been addressed?

D. McGoey: That's on the site plan?

A. Dulgarian: Right. There was a question before the work session on that.

D. McGoey: The question about setbacks. They resolved that.

A. Dulgarian: The second thing that we brought up before was lighting, has that been addressed?

D. McGoey: Yes.

P. Owen: I'm good.

R. Carr: Nothing.

G. Monaco: Nothing.

G. Lake: I don't have anything else. I was at the work session.
