Mrs. Thompson: The mailings were reviewed by the Board and filed by the Secretary. The Public Hearing Notice was read at 8:23 pm.

Mr. Smith: Please present your application.

Jay Myrow, Esq.: We mailed in an amended plan and hope everyone got it. It’s the 3rd one. And it looks like what the Board suggested. It is dated ‘last revision 10/23'. (Additional copies handed out). When we were here we looked into an alternative design to eliminate the free standing and to add on to the existing, and to accomplish it in the same square footage. We appreciate the suggestions and have amended our plan to show the addition to each one of 3 buildings. The net result is eliminated rear yard set back and do require side yard from 50 to 20ft to 50 to 26ft instead.

Mr. Smith: Any coments from Board?

Mr. Oster; We appreciate the alternative plan and it is laid out nicer.

Jay Myrow, Esq.: This was a feasible alternative and you are doing your job.

Mr. Smith: Cost less?

Jay Myrow, Esq.: No, move electrical.

Mr. Smith: Any questions from the Public? (No)

Mrs. Thompson: I am hapy with this.

Mr. Oster: To night there are 5 members and your need 4 yes votes to pass.

PUBLIC HEARINGS:

SIMON deMONTFORT & ELIZABETH B. SPARR: Request for a variance of 249-3 (oversized building) and 249-8 (accessory building in front of primary building); Property located at 380 Sands Road; (SEC 7 BL 1 LOT 39); Designaged RA.

Mrs. Thompson: The mailings were reviewed by the Board and filed by the Secretary. The Public Hearing Notice was read at 8:29 p.m.

Mr. Smith: I Move to open the public hearing at 8:30

Mr. Oster: You have an existing small building and you would like to put in what you call an accessory which you will be living in and as you live in it while you build this (map). At this point what is before us is to approve the small building in front of what they are building. This is a residential building. They have to come in when they move in. There are time lags and everything else. We are being requested to approve an existing as accessory in front of a residence.

Mr. Smith: Unless you are doing the work in a year you’ll have to be back here at some point.

Mr. deMontfort: Okay.

Mr. Oster: You are not bringing down the smaller building?

Mr. deMontfort: No.

Mr. Oster: Do you have plans for a garage when you move in?

Mr. deMontfort: It is my play ground / dog house.

Mr. Oster: Because this is a residence... actually, you have good footage off your neighbors so that is not an issue as I see it.

Mr. Smith: Sever the sewer to the septic tank once the house is built.

Mr. deMontfort: I planed to keep it.

Mr. Smith: Any comments from the Public?

Mr. Wanser: I own the property across from this and am vehemently opposed to a zoning change in the area. Eventually I have a daughter and son want to build houses there and to cheapen it - we would not like that. That is my anwser to that.


Mrs. Thompson: This is just a variance so he can put a building in front.

Mr. Wanser: From what I read on the notice, it’s a building in front of a building and sounds weird?

Mrs. Thompson: How far off the road, are you Mr. Wanser?

(Looked at the drawing).

Mr. deMontfort: We want to build this behind this.

Mr. Wanser: I see.

Mr. deMontfort: We want to build back and because if it is in front of the main building you need variance, the garage is behind a house when you build it. We will fix up the chicken coup. The building behind this that is what the variance is for.

Mr. Smith: They will have a garage with small bath.

Mr. Oster: If you keep the plumbing where you are moving from it can be considered a residence.

Mr. deMontfort: The living quarters is a kitchen. That is coming out.

Mr. Smith: To my knowledge you can have a toilet. The kitchen will have to come out.

Mrs. Thompson: You are not going to have your mother move in?

Mr. deMontfort: No. That is why we bought 7 acres so we can have peace and quiet.

Mr. Smith: The house is close to this place and will have zoning issues and it may be denied on the house they want to build.

Mr. Oster: Accessory is not accessory while you are living in it.

Mrs. Thompson: Are you building as an investment?

Mrs. deMontfort: No, to get out of where we are paying over 1000 a month.

Mr. Morgan: The portion will revert back to garage with small bathroom.

Mr. Smith: They have to take out the kitchen according to the zoning.

Mr. deMontfort: That is our intent.


Mr. Smith: The building in front will be repaired?

Mr. deMontfort: Yes.

Mr. Smith: That is the accessory now.

Mr. Smith: Any questions from the Public? (No)

Mrs. Thompson: This is going to be very nice I believe.

Mr. Smith: I Move to grant the following variance: 1) permit an accessory building in front of primary building; 2) an over-sized accessory building; subject to the following: The kitchen is remove prior to occupancy of any main house being built in the future.; Seconded.

Mrs. Thompson: The mailings were reviewed by the board and filed by the Secretary. The Public Hearing Notice was read at 8:40 pm.

Mr. Smith: I Move to open the Public Hearing at 8: 41 pm.

Mr. Mattatall: If you had not told me it was covered patio I would not have known it.

Mr. Oster: The roof was there in line. Difficult to find the property line.

Ms Clark: The house was burned down some time ago.

Mr. Oster: I spoke to someone’s son who was getting ready for snow fall that was suppose to come Saturday.

Mrs. Thompson: The mailings were reviewed by the Board and filed by the Secretary. The Public Hearing Notice was read at 8:44 pm.

Mr. Smith: I Move to open the Public Hearing at 8:45 pm. Please present your application.

Mr. Witt: I have had a couple of people who have looked at the property. They are looking to build on left hand side of the existing property and the reason is to off set and to go on the left side. On right side swale and drainage problem and, one that we know of, large boulder on right side that would keep us from doing lines or water. We could build there if not for those problems.

Mr. Smith: It will blend with your home.

Mr. Witt: It will mirror the other side.

Mr. Oster: It is minimum relief and immaculately kept up.

Mr. Morgan: I see no problems with it.

Mrs. Thompson: Look like the other side?

Mrs. Witt: Yes.

Mr. Smith: Any questions from the Public? (No)

Mr. Smith: I Move to open the Public Hearing at 8:49 pm.

Mrs. Thompson: Its been there for a long time.

Mr. Oster: He is asking for a lot. One continuous building all along the lot. When was it added?

A. Johnson: Its been there for 35 years or longer.

Mr. Oster: How long has it kept continuing.

A. Johnson: He built the piece in the back 35-40 years ago.

Mr. Smith: Any questions from the Public? (No)

Mrs. Thompson: It was all there before zoning.

Mr. Oster: Have you spoken to your neighbors?

A. Johnson: No, they came a while after this was there. It has not been something that was stuck up in the last 10 years. Its been there forever.
